  1. I was surprised as anyone as I had a letter stating they would ask the judge to stay the case - due to the lack of settlements in recent weeks - I wonder if my judge refused......but also Eversheds in error emailed me and said I had been paid - so maybe that is another reason I have been settled. I would still proceed as the website says you will at least be first in line to be settled. Good luck:)
  2. I had not a court date - actually I did not even get formal notification from the court they had submitted their defence - still cannot believe I have been paid - I think that was the additional happiness when I was paid - was not expecting it as thought I would have to wait until the OFT case!
  3. really really surprised thought I was going to have to wait until the OFT case so I wonder if they have changed their view or maybe my judge refused to stay the case!
  4. Thank you - just wondered if anyone else has been paid out?
  5. OMG - Nationwide said they would not pay my charges as they were requesting for the judge to stay the case until OFT case was resolved - got a letter today and they have said they refunding everything. Looked online and interest and court costs paid - so rung them and in error did not refund the bank charges so they are putting that in today! So very very shocked and going on holiday tomorrow so the refund has come at the ideal time. I really had thought to myself I would have to wait for the outcome of the OFT case - anyone else had a refund!
  6. I Cannot believe it - Nationwide said they were not paying and would be asking Judge to stay the case - well got a letter today and they are paying the lot!!!!! Interest and court costs gone in and charges to go in later today - I cannot understand it - does this mean they paying out on all court cases!!!!!!!!!!!!!!
  7. I did and got fobbed off saying Eversheds should not of said that as their policy had changed on that date - can you imagine how frustrated I feel...knowing that I would have had the money if if wasn't for the court case. In addition, the guy at NAtiownide said the case could take up to 2 years....2 years!!!!!
  8. Well I rung Nationwide and they said cos they have changed their policy - it won't be paid. Surely I can provide this to the court - as I have it in writing I was refunded and I have not. How cruel receiving that email and not receiving a single thing!!!!!!!!!!!!
  9. Now I am confused had this email from eversheds:- We have filed in a defence stating that our clients have denied your claim. However, please be advised that you have been refunded the following on 25 July 2007: Bank Charges £2,845.00; Interests £1,241.47; Court Fees £ 120.00; Total £4,206.47. In that manner, you have been fully refunded in regards to your claim. However no money in the bank and a letter of Nationwide that they are asking the court to wait for OFT resolved!!!!!! What should I do?????
  10. I am not going to back down don't worry but with the Natwest case being thrown out also yesterday - makes me think most judges will think the same - but may be wrong! Am I right re the court bundle that it is the basic court bundle, schedule of refunds already taken place and my correspondence.....
  11. Well Nationwide had until saturday to submit a defence - and got a letter today going on about the OFT court case but also said the following:- You should be aware it is our intention to apply to the court for an order to stay your action until resolution of the bank's proceedings with the OFT. As a result your case is likely to be put on hold until the outcome of these proceeding is known. Looks like I am at the judge's mercy

  13. I thought it was our responsibility to provide them!
  14. Hi Totally agree with all what is said - Nationwide had until saturday to enter a defence in my case. The Nationwide site does say they will ask the judge permission to suspend the case until the court case is resolved but there are no guarantees the judge will say yes..........so I will be very interested what happens with mine and certainly will let the site know what the judge says!
  15. Well I cannot see how they can ignore the court - if the court decides to go ahead then surely Nationwide will have to deal with it! It may be an idea to do an individual thread and confirm what they have said to see if a moderator has any comments! Yes I can understand it if, the court claim has not started yet but surely for the likes of us, it should still be able to go ahead. I don't think they feel confident they are going to win - even if it is a partial refund some sort of refund should be given and yes I am very annoyed also at paying the court fee for this!!!!!!! They are not dealing with the general public but OFT! Just wish I done it sooner seems very very unfair!
