  1. We just had our OR interview after worrying ourselves silly she was really nice and we get to keep our car and no IPO. Thanks to everyone for your advice it feels like a ton weight has been lifted off my shoulders
  2. We have our OR telephone interview tomorrow but have not been asked to fill in a questionare is this normal?
  3. Me and OH have telephone interviews next week with the OR and I have a couple of questions if anyone can help? 1. They haven't asked for any bank statements even though I have them, will they get this info themselves and how far do they go back? 2. I have an overpayment from tax credits which they are collecting off me through future installments - should I have wrote this on my debts? I read somewhere they can reclaim their money during your bankrupcy periord but as I am the only one working and part-time I rely on tax credits to buy food every week. 3. How much excess income do you have before they make you pay a payment order? Thanks:)
  4. I have just got my bill in from Virgin media for phone line, internet and tv from before I went bankrupt. Would this bill be written off if I rang them? would they be allowed to cancel my services? Thanks
  5. I went BR on Thurs and spoke to the OR on fri - have a telephone interview on 24th March. She said I should be able to keep the car if it is valued below £2k as it is needed for work. I was just wondering what price they would value it at as when you go on websites it gives a price for trade, private, part ex ect - value for private exceeds the £2k so I am worried we might lose it.
  6. Ive finally filled in all the forms - it has taken me all weekend! I am going to try and apply for the court fee remission but not sure which grounds to claim them on. Hubby no longer works but does not get any benefits, I work part-time and claim them in my name. Where it has claims on grounds of annual income he was working until the end of Jan, would I need to put this down on the forms as it shows on my tax credit award??
  7. Thanks for all the advice Im busy filling in the forms on-line and a bit stuck on a couple of things - any ideas? Im doing hubbys first and have listed his debts - some of these are in both our names, do I need to write joint debt or half the amount he owes? His credit card accounts were all transferred to DCA do I put the DCA in the creditor box or who we originally owed the debt to? On the creditor type will it be enforcement agency? My hubby is not working at the moment and not claiming any benefits - we had a benefit check up and were told we would be better off claiming in my name as I work part-time rather than him having to sign on ect. So the only thing he gets in his name is WTC which is paid into my account, do I need to say yes he gets benefits and put the details in even tho they are in my name or should I put the amount in other members household contribution along with my wages? We live in a council house and though I am listed as living here the tenancy is in my wifes name and as she recieves the housing benefit, she pays the rent which section do I need to fill in? Please help if u can my head is done in x

The car is worth £1700 and I use it to get to work and take the kids to school also my hubby is looking for a job so needs to use it too - do you think we will be allowed to keep it? Should I redo my budget and increase the food or clothing to compensate for the sky tv, kids pocket money ect - do you think we would get a payment order?

  11. Our german shep Max cried and howled whenever we went to bed or popped to the shops. We had to move him into our room as we were worried about the neighbours but as he was too little to be toilet trained it was a nightmare we had papers all over the floor and the carpet was ruined, not to mention he was up and down all night wanting to play. He came from a litter of 13 so it is understandable he was lonely we ended up getting another puppy the same age - Shadow, the first night we had him we put them both to bed together and he did not even whimper all night and they are the best of friends, plus when you go out or cannot take the puppy out they will play together and wear each other out - hard work but good fun!
  12. Hi wonder if anyone could give me any advice on behalf of my lil sis. Her and her hubby moved down south, bought a home then decided to move back up here as they were homesick. They tried for a year to sell their home but couldnt so decided to rent it out to cover their mortgage. As they thought they would sell the house down south, they bought a house up here to live in. As they hadnt sold the house and had to pay a shortfall between their mortgage and what they were charging in rent, they couldnt afford to live in the house up here either so have to rent that out as well. So basically they own two homes on interest only mortgages and even though they are rented out, there is a £1k shortfall every month. They were living in my mam and dads tiny 2bed flat for three years - sis was working full time from home and her hubby doing building jobs here and there to pay their mortgages. However my sis lost her job and had a baby she is getting maternity pay which is due to run out soon and child benefit. Her hubby invested all their savings in buying stocks and shares and put them all into one company which has crashed meaning all his money is frozen. I have told them they should be entitled to some benefits but he is proud and wont even look into claiming anything, he thinks as he has the two houses he wont be entitled to anything as they will be classed as assets but I have told him they are probably worth far less now then what he paid for them and as his mortgages are interest only he will make a massive loss if he managed to sell them. Any advice?:?

  14. Hi all, I wonder if anyone could give me some advice? My hubby and me have been told by CCCS to go bankrupt as we have around £43k in debt (most of it from a shortfall when our house was repossed last year). We were both working until recently and sharing our surplus income between our creditors, however it was still going to take us 29 years to pay the debts off hence we were advised to go bankrupt. My hubby lost his job last month so we are now living on my part time wage and tax credits, housing and council tax benefits so I have wrote to all our creditors telling them we are only able to afford token payments. We currently have two cars -mine worth approx £700 and my hubbys worth approx £1600 - would I be allowed to sell my car before going bankrupt to raise the bankrupcy fee? Also do you think we would be able to keep my hubbys car which is needed for me to travel to work and take the kids to school? At Christmas time we bought the kids prezzies which will show up on our bank statements - highest was £279 for a tv for our son. We also spent £399 on a tv for the sitting room as our old one was broken - would there be any danger that the official reciever would be interested in these? Please advise.
  15. Hi, just wondered if anyone could give me any advice please.... My husband and I have just had our house repossessed and in the current climate we are expecting a shortfall. We also have lots of other debts - credit cards old car loans and gas and elec supplier from our old house which amount to possibly £16k between us plus the shortfall. My husband has also found out he is to be made redundant and I only work part time so we will have no money to even make token payments, we have no savings ect. I just wondered if bankrupcy is our best option and if so should we wait until we find out how much the shortfall will be but my hubby could possibly be working again by then. Can you also tell me how long it takes how much it costs and which of our possessions we could lose. My hubby will be getting a redundancy payment should we wait until after he gets this before we start the ball rolling -we desperatly need this money as have been rehoused and have no carpets or cooker ect.   16. Thank you for your replies. However I have already been on these sites and put a claim in for income support, housing benefit etc and have been told i am not entitled to any money. I cannot afford to pay the normal monthly mortgage payment never mind the arrears and as my husband will be off long-term i do not wish to keep the house and was wondering how soon the council would be able to rehouse me.
  17. Hi My husband is sick and only getting ssp looks like he will be off for a long time to come. We have a mortgage and no payment protection on Friday I will be almost 3 months behind - they have already sent me letters threatening legal action, I have spoke to them and they want me to pay normal payments and they will spread the arrears over 12 months but the payment will be £1000 a month which i just cannot do. They are not reasonable and horrible to deal with (kensington mortgages). I have done everything i can to keep the house i have sent back our two cars we had on hp and contacted cccs and iam only paying token payments to our creditors i have also went back to work full time but i cannot afford to pay the normal payment never mind anything off the arrears this is stressing me out i feel so ill and tired. I am going to the citzens advice on friday and have registered with our council for a house but have not got my password yet so i am unable to bid on anything. A house has just came up not far from where we live on the doorstep of our childrens school - what chance do you think i would have of getting it? Is there anything you think i could do to improve my chances? I have also applied for income support council and housing benefit and was told i earn too much to qualify which is a joke as at the time i was only getting £700 a month. please help
  18. Hi thanks for your reply. I rang job centre plus and they went through our details to asses us for income support hb and ct benefit they then rang me to say i was not intitled to anything. Do you think it will make a difference that i have now split up with my husband?
  19. Hi I wonder if anyone can help me. My husband works full time but has been on the sick with stress and depression for 10weeks now and is only recieving statutory sick pay - he is still ill and it does not look like he will return to work for a long time. I only work part-time and temporary and I put in a claim for income support but was told I did not qualify as between us we have £200 a week coming in - even though I explained to them our mortgage is £200 a week. We have two children and no mortgage protection. Due to my husbands illness and worries over money we have now split up but he is still living here with me as we both have nowhere else to go and the house is in both of our names. I am recieving child benefit and tax credits as well as my wages he has no other income other than his statutory sick pay - would either of us be entitled to claim benefits on our own? He has barely enough to live on so contributes barely nothing towards the house and I am struggling to pay mortgage poll tax food etc and am living on next to nothing. Any advice would be appreciated.

I am just filling the court claim forms in now and I am going to post them off registered post tomorrow but I have a couple of queries; How do I find the address of my local county court? on the claim form under values I have listed the charges, under the overdraft interest is that the amount of interest of 8% that the have charged on the charges? How do I work out the interest under s.69 of the county courts act 1984? I think I will not have to pay the court fee as all the charges and penaltys from various banks and credit card companies have left us in financial difficulties and I have a budget from the CCCS showing this - should I send a copy to the court and apply to be exempt from charges? Also if I am exempt do I put the charge down for the court fee I should have paid? Sorry for all the questions but I want to make sure I have filled out the form properly before I send it off.
  21. Hi - I sent my LBA to the Co op and today is now the 15th day - do I now file in court or do I need to send them another letter first? The only reply I have had from them is a letter stating that they will look into my complaint which can take them up to 40 days. Thanks
  22. Hi Thanks for your reply. The DCA is called Scotcall Debt Collecting Services, based in Glasgow. I did send them my budget statment and have been paying them token payments ever since but they must have been adding charges to my account as my last letter from the Coop states that I owe them £200 and they are transferring me to them and a recent letter from Scotcall states that my outstanding balance with them is £600.
