  1. Just phoned Luton court, and they said that they are staying all cases on their own initiative without any application from the bank, apparently I will be getting a letter to confirm this. All outstanding and new cases will be stayed untill 31st march 2008 at the earliest.

  3. Hi all, I have in the last 2 days recieved an offer from the bank, for £98 less than my original claim(before interest and court fees). The letter I recieved mentions all the test case stuff and that if the case goes to court they will apply for a stay etc etc. My current thoughts are that I am more incined to accept this offer with there being so much unknown at the mo with this test case. What do others think.
  4. Under value i did yes, in section 5 I entered the seperate amounts, but in the box in the bottom rh corner of page 1 i dont have it on the one i have, so i think i will have left it off the other ones too. Is this a problem, or a slight oversight?
  5. Yes, It has: 'notice of issue' (unspecified amount) To the claimant then a box with my address in it then the dates of when it was issued and when the defendant has untill it needs to reply. Looking at the claim form i might have missed the amount claimed/court fee in the bottom box, dont know if i missed it on all forms or not.
  6. Thanks again Hedgey, you are certainly living up to your title 'site helper' as you are clearing things up for me. I had some post waiting for me when i got home, the notice of issue from the court, do i assume the bit in brackets (unspecified amount) is just a standard for the form, there is no mention on the notice to stay how much i am claiming from Natwest, I assume the notice they sent to Natwest will be different and will have the amount on it.
  7. TOTALLY CONFUDDLED NOW!!! I have been reading the various threads on this site and across some other websites, and I am now totally confused as to what is happening or is likely to happen in respect to my claim. I sent the claim form and list of charges(inc interest) to the bank a few weeks ago, after a week i phoned to see what had happened, cheque not presented etc, and they said they hadnt had the forms, so I sent it all again end of last week, check my online banking and see that the cheque got taken from my account today, confirming that the forms have been recieved this time around. Would the courts still bank this cheque if there was an automatic stay applied to all claims? Is there or is there not an automatic stay applied to all claims? Will my claim get so far and then the judge apply a stay due to the OFT/FOS test case? Will my bank now be even more dismissive of the claim I have filed against them? I appreciate everyone has lots of questions, but it seems I have sent my claim form in and had the cheque paid in a particularly difficult spell in the whole bank vs anyone scenario. Is this just my (as usual) bad luck, or would no one really batt an eyelid and worry about something else instead. Obviously I havent heard anything from the court and with all the postal disruption at the moment things could be delayed. I guess I am just looking for some case specific advice as i am just confusing myself even more with everything i read. Thanks again in advance, I know I am being thick.
  8. I have just read on some other sites that all actions, including that of county courts/small claims courts, have or will be suspended. I sent my claim forms off on saturday, including the cheque to pay for the action, and note that the cheque has not been paid in yet, what is anyones advice to me in this case, would i be best to put a stop on the cheque, or phone the courts to see what they are doing? I am reading several different reports and am getting confused as to what is happening, what will happen, what i need to/not need to do? I am sure i am not the only person to ask, but i am at a stage that i think might be critical. PLEASE ADVISE ANYONE.

Thanks all for the good advice up till now, unfortunately due to personal reasons i was unable to carry forward with this claim, but i am back on track now and have just completed the court forms and printed them out. The only bit of confusion i have in this is the last box, where it makes reference to claimants solicitors firm, as i am not using a solicitors i assume i just leave this and any other reference to it blank. I also seem to remember reading somewhere on this site, but cant find it now that you can request the fees be refunded in a cheque as oppose to being just paid into the relevant account, where do i need to state this or how do i request it? Thanks again, looking to get the claim forms in the post today.
  10. Hello again all, I have completed the court claim form, but cannot see any mention of court fees, do i need to pay this with the form, and if so, where can i find out how much i need to include?

  12. OK all, its now been just over 14 days since I sent the LBA, the next step is to file a claim or whatever, with the spreadsheet printout but to include the interest at 8%, how do i work this out, is there something in the excel sheet i am missing?

  14. Ok all, a little update, but not sure how good news it is, or just stalling tactics. I got a letter 10 days after i sent the list of charges, it says: Thank you for your recent letter regarding charges applied to your account. We are currently investigating your claim and will respond to you as soon as possible. Do i proceed with the second letter after the 14 days saying that I am seeking legal action? Thanks all in advance of the advice i hope to get.
  15. QUESTION AS STATED ABOVE! I asked for the statements for the last 6 years, which going by my calculations I would expect them to send the statements from Feb/Mar 2001, but they sent from July 2001, should I send a request to them for the copy statements between Feb/Mar till July?

Hi again all, I have been through my old statements and transferred the relevant charges to the spreadsheet, although I haven't done the interest bit yet(as it gets done later on), the total on the spreadsheet is £2,949, although I do have question that has been brought up through getting my statements, but I will ask that in a seperate post, see below. I will be preparing the letter and tidying up the spreadsheet this evening and will send off to the address above(thanks for posting it, great help), see what they come back and say. I did however get a letter from Natwest(with a RBS frank on the envelope) thanking me for requesting the data protected information, and then some less than friendly words, is this the same as everyone else? Thanks again all for your assistance, I guess this is now the stage I will get some less than pleasant letters from the bank.

Well everyone, I got my statements for the last 6 years, all 230 or so pages, so will go through them and highlight the charges, then enter them into the spreadsheet as is posted on this site under the templates section. Once i have done that, am i right in understanding I send that spreadsheet with a letter to my branch, or is there a department within Natwest who I need to send it to?
  18. Thats the letter I have ready to go, either in an envelope to the branch or to the data protection guy, think I will try the branch first, see what they have to say, if I get no joy with them i will try the other guy. Thanks.

  20. Well dont on the result Dave, encouraging to hear of the ease. Did you have all your old statements or did you have to send off the Data Protection request letter, and if so, did you send it to your branch, or did you send it to the place in scotland, I am no a little confused where is best to send it to.

Hi all, Have started the ball rolling on this now after looking around the site making sure I had a fair idea what to do, I have the statement request letter waiting to be posted when I get home this evening, although I now see that there is an address is the sticky section of the Natwest section with an address to send the request to, is this the best way to do it or is sending it to the branch my account is with sufficient? I am sure I will have more questions on this case as I proceed and hear stuff back from various people within the Natwest, fingers crossed I have some element of success in this. I will of course keep you all posted with how I am doing, with any replies and correspondance I get. Thanks to everyone in advance for the help and support I anticiapte I will recieve. Megy

Hello all, just thought I would do the decent thing and say hello, I have been registered on the site for a few weeks now while I was looking into all the pros and cons of whether to actually claim my charges back, and I can now say that the first letter(statement request) has now been sent. Well waiting for 1 question to be answered in the relevant bank section. I do however have 1 question that I have not seen an answer to, What can the banks do if you are currently using an overdraft, I have read that they have been known to close an account of someone who has claimed the charges back, but if you are using an overdraft with them what can they do? I am sure this will not be the only question I will have in the coming weeks, and if I need to ask the question above in a different area of the forums, please guide me that way. Do I need to start a new thread to chart my progress to post questions and get answers? Thanks all, hope I have as much success as most on here!
