  3. It's been 6 months since I received the 'guesture of goodwill' £1,560 from Abbey. Due a mixture of being lazy and busy I have never pursude the matter further - something which annoys me everytime I remember. So my question today is, have I left it too late? I have the N1 form filled in and a cheque ready to go, shall I send it off to the court today?? Do you think the lapse in time will go against me? Your thoughts please Thanks! Reenie
  4. I sent off my LBA based on the template in the library at the end of August. I then received two letters from Abbey both dated 8th September. The first arriving on the 11th which was a standard letter saying they are still looking into my complaint etc. The second, received on the 12th, saying as a gesture of goodwill they have refunded me £1,560 plus £150 charges which were due to be taken from my account this month (they actually haven't refunded this). My next step was to go to court but my Dad, a man in the know, suggests that I write to the Abbey instead. Something along the lines of thanks for the money but not enough. He also thinks that I should ask them to make me an offer. Should I do this or should I just go for the full remaining amount? Can anyone tell me where they got to the figure of £1,560 from? My original claim was for £4,913.00. Seems an odd amount Amazing how disorganised they are to send two letters on the same day!
  5. Hi Just started and want to check I'm on the right track I already had statements going back to 2004 with charges totalling just under £5k. I sent a letter on the 10th July to Abbey based on the preliminary approach letter from the library. I got a standard reply on the 19th saying that they are sorry I am unhappy and someone will investigate and get back to me in the next 4 weeks. I was in the process of drafting my response when I received another letter - the one saying they do not feel the charges are unfair, that I have operated my account badly, I should have been monitoring it more carefully and they may decide to give notice to close the account. This is all to be expected, right? If it is the Abbeys tactic to scare people off from continuing their claim they are doing a good job. I have managed my account very badly and their letter certainly makes me feel like I have no case against them. I think this is why I am now posting a message on the site, I need some moral support Thanks Reenie

Before I set off on my quest to reclaim what is rightfully mine I have a quick question regarding something that is mentioned in the FAQ - Can I claim beyond 6 years I'm not intending to claim beyond this period but in this section it says... "However, do note that you will only be able to rely directly on the Unfair Terms in Consumer Contracts Regs.1999 if your bank contract was entered into post 1995" If I opened my account before 1995, say 1986, am I still able to claim?

  8. I have a joint Abbey account with my partner. I have to admit we're both a bit rubbish when it comes to managing our money. The main problem is that my boyf gets paid weekly (but randomly) by cheque which is not an ideal siutation as there are many direct debits coming out of this account and we always seem to be waiting for cheques to clear. Also I have recently returned to work after 6 months maternity so money has been a bit tight. The problem we are now facing is £600 of charges that are due to come out of our account next week where there will not be enough money to cover them. This is becoming a recurring problem with the charges increasing each month. I have called telephone banking - they want to take away our cheque and debit facilities and cancel the direct debits. I have declined the offer. I have tried to get an appointment with someone in the branch but have been told they have no authorisation over these matters What do I do?
