  3. i asked them for £500 to keep it confidential but they refused lol and agreed to drop that clause!!!!! looking forward to going into my branch and discussing my account after they told me i was ill informed what i was doing lol

  5. yippppppppeeeeeee its been 3 months since i handed in my aq and i was getting worried!!!! until now that is when i opened a letter offering me the full amount yippppeeee meeee!!! i havent signed anything yet what happens if i dont agree to the conditions??

  7. as the title says i handed in my aq almost 3 months ago and ive never received an offer and havent as yet been given a court date. my partner started his claims about the same time as me and has been paid out by halifax and received 2 offers from abbey. is there anyone else in the same situation as me. just worried ive done something wrong???
  8. im sleeping on friends sofa until moving into my first home. i exchange next friday. the problem i have is that i expected a payout by now on my charges (my claim is with the judge). i need £10000 to exchange and only have £7500. if i dont get £2500 ill lose the house and have to pay £4500 costs to the seller. i have a ccj with 3 years still to run and not sure how they accepted me for a mortgage but i need a loan. can anyone point me in the right direction for who might lend me?? im thnking hfc might i want as short a term as possible as im gonna pay it off when my charges pay out thanks fiona x
  9. its almost 7 weeks and ive heard nothin. rang the court a fortnight ago to be told it was with the judge.. has anyone waited this long for a court date and i also havent received any sort of ooffer???

  11. yesterday i phoned the solititors to let them know i was still waiting for my copy of the aq so i could forward it to them. they told me they had a copy sent to them. they couldnt tell me anything else because its in the hands of the judge. 1) i know i wasnt supposed to call them but as 2 weeks had passed without me getting a copy of the aq i thought they should know. 2) considering they have asked for a month to try and settle why is it she said it was in the hands of the judge?? 3) should i be expecting an offer in the last couple of days of the month given??? generally how long into the month do people get offers??

  15. ive just received the court allocation questionaire from sechiari clark and mitchell and not sure if its good or not... A SETTLEMENT THEY TICKED YES TO -do you wish any further action in this claim to be postponed for one month so that you and the othe party can attempt to settle the claim either by informal discussion or by alturnative resolution? D WITNESSES THEY PUT 1 TO - so far as you know, how many witnesses do you intend to call to give evidence at the hearing? G OTHER INFOMATION - the defendant wishes to rely on its defencefiled on the 29th june 2006 together with the terms and conditions that govern the account in question which appears to form the subject matter of these proceedings ALSO from sechiari clark mitchell a letter asking for a copy of my court allocation questionaire my my earliest convenience
  16. incase they dont settle before court what should i be thinking of collating to take with me if my day in court comes round. should i be sorting out the peter mcnamara interview onto cd to take with me and what other evidence should i be getting together.

  18. i just rang the soclititors and asked if they were willing to settle before i handed in my court allocaqtion questionaire to save both parties time and money and was told there was no compremise and to go ahead and file my papers at the court... wondering if ive made a mistake somewhere??? doubt it so off to hand in the questionaire:D

  22. decided that im not going to claim anymore. i have 4 1/2 years of a ccj to run and if they close my account ill lose my debit facilities because my parachute account will only give me an electron card. its been a difficult decision as its £4500 and i got into this financial mess because i was robbed of thousands by an ex-boyfriend:-x:-x:-x ive also been finding it harder to get answers recently and feel maybe this isnt such a good idea.. good luck to all in your claims, i hope you all win:D:D
  23. below i have copied my particulars of claim. i have used the rough template and added the section about the 8% interest... a couple of things 1) it comes to 1006 words 2) the very last bit about daily rate of interest???? what do i put here 3) please can someone ok what ive done and even better shorten it for me so its under 1000 characters thanks I have a contract with the defendant bank dated nov 1997 and which is conducted on their standard terms and conditions. I am claiming the return of money taken by the defendant in the way of charges over the last 6 years. The bank's charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law. Further, as a disproportionate penalty they are invalid under the Unfair (Contracts) Terms Act 1977 s.4 and under the Unfair Terms in Consumer Contracts Regulations 1999. Para.8 and sch.2(1)(e). In the event that the charges are not a penalty then they are unreasonable within the meaning of the Supply of Goods and Services Act 1982 s.15. I have repeatedly asked the bank to justify their charges but they have declined to do so. i also claim interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from 01/08/2000 to 10/03/06 of £917.24 and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of ?.
  24. received the standard fob off letter ..... so do i now just wait for the 14 days and proceed to court or is there anything i need to do beforehand?
