I Have A Copy Of The Letter Of Acceptance That I Signed From The Bank And It Only States That Im Signing For The Money And That The Existence And Terms Of The Final Offer Are Confidential Between Them And Myself. There Is No Mention Of Me Keeping My Account In Order In The Future.
  2. HI, I WONDER IF ANYONE HAS ANY ADVICE ON WHAT I CAN DO? I HAVE FILED A MONEY CLAIM AGAINST BANK AND HAVE JUST CHECKED INTO SEE THE STATUS OF IT AND IT SAYS ITS BEEN SUSPENDED AND I CAN TAKE NO FURTHER ACTION. IM NOT SURE WHAT THIS MEANS AND WHAT I CAN DO? I RECENTLY WON A CASE AGAINST THIS BANK AND AM WONDERING IF ITS ONLY POSSIBLE THAT I CAN TAKE BANK TO COURT ONCE. THIS IS A NEW CLAIM I THOUGHT I WAS ABLE TO CLAIM AS THIS WAS REFERING TO CHARGES APPLIED TO MY ACCOUNT WHILST I WAITED FOR FIRST CLAIM TO BE REFUNDED. ANY ANSWERE ANYONE???:confused:
  3. Hi Bluto, Yes it wouldnt do any harm in chasing it up. The telephone number at Barclays you want to ring is: 02071164664 and speak to Laura Wrage. She will probably ask you for your claim number and ask if you know who is dealing with your claim. So you just want to give her your claim number and she will put you in touch with who ever is dealing with your claim.. (I HAD CHARLIE SPARLING & HE WAS OK ACCOUNT WAS REIMBURSEDTHAT AFTERNOON.).   4. Hi Bluto, No allocation hearing is not the final one. Allocation hearing is just to decide on where your case is to be heard be it a small claims court (which if you are claiming £5000.00 or less is the one you want) or a fast track (claims of £5000.00 and above. But, as i mentioned to you before i managed to settle mine once i recieved the allocation hearing date, BY CALLING bARCLAYS AND KUST TELLING THEM I HAD A HEARING DATE THROUGH. (LET THEM BELIEVE THIS DATE IS FOR THE FINAL HEARING YOU NEVER KNOW YOUR LUCK & IT WORTH A SHOT). I have the number i contacted if this helps. I too had Adrian St John fitting for Barclays against me. Let me know how you get on. Best o luck Allie:)
  5. Hi Nikki, I too had adrian st john fight for barclays in my case. Youll find that no barclays cases ever get to court as they seem to be settling a week or so before court.When you get your allocation hearing date through its worth giving barclays a ring to see if they want to cough up before court, (dont let on its only an allocation hearing though) As long as the courts and barclays have copies of your spreadsheets i would go ahead and try this. It worked for me and money was transfered the same afternoon. Hope this is of some help to you. Kind regards Allie:)
  6. Hi Bluto, Basically yes, just sit back and wait for the allocation hearing date to come through this should be for your local court.Shouldnt have too much longer to wait. Once you recieve a court date through for allocation hearing its definately worth giving Barclays a call. But dont let on its just a court date for an allocation hearing. Say you just have a hearing date set and you would like to give them this final oppourtunity to settle up before it goes to court.. This is what i did and the money was transfered to my account that very afternoon. OH to start your own thread just go to the barclays/ barclay card form page and scroll down for new thread.   7. Hi Sally, When i claimed i wrote to Barclays Head Office, Customer Relations in London.E14 5HP. Expect the entire process to take around 6 months from when you request statements to when you get you cash back.. Hope this helps and good luck. Allie:)

  9. :o:D I WON!!!!!!!!!!!!!!!!!!!!!!!!!!! Didnt even have to go to court. Phoned through to Barclays told them i had a court date for next week (didnt let on it was only an allocation hearing). They sent me a final settlement offer. Whats even better is its for £500.00 more than id asked for. HA HA HA Their fault for not doing their sums! Thanks to everyone on this site that has helped me win. Will be donating when money clears in my account this afternoon.
  10. Thanks Advoc, Am now printing 2 more sets of spreadsheets off along with my letter of apology to the court. Is there anything else i should done? Cant remember if my particulars of claim included my account number (it all seems so long ago now and my brain is getting very fuzzy).
  11. Have an allocation date set for 3rd april. Im just going through my claim and looking at a copy of the AQ from Barclays that i received from Northampton court. In their defence it states; The particulars of the claim do not provide details or particulars of the account in question and/ or the precise charges alledged to have been unlawful, or the date thereof. Can anyone tell me what this means (i know im probably being a bit thick here). Its begining to worry me asi know i sent of all the letters to barclays along with copies of my statements including the dates and my account number. I have filled in the AQ which i sent of to the appropriate court providing all the info they asked for. I have done my spreadsheets, should i have sent these off to anyone? Really bigining to panic now and am starting to think they may strike out my case. Please anyone help....
  12. Hi Glen, Im not worried, it's just been reading lots of threads ie: Milo's thread and was wondering whether or not to give Barclays a call to see if they want to settle before it goes to court as it seemed to work for him. Only prob is i dont have the number of who to call. Allie
  13. Hope there is someone out there who can help me, as no one seems to be replying. I need to know (roughly) how long it takes from when you go for your allocation hearing to when you have your final hearing. This is assuming the judge gives directions for your case to be heard in a small claims court. Anyone .........................all answers greatly appreciated.

  15. Hi Advoc, Have been in touch with courts and it is a allocation hearing so ive been doin my homework and am now prepare. LET THE BATTLE COMMENCE! Just one small question:rolleyes:................. Do you have any idea as to how long it takes say if you win the right to have claim dealt with via "small claims track" to when the final hearing commences? Regards Allie:)
  16. Hi, Have you looked at the sucess story threads for Barclays they should put your mind at rest. Its entirely up to you and your current financial situation as to wether you choose to accept or reject the offer made ( this goodwill gesture is standard from Barclays), I f you choose to reject look in the templates section for letter threatening to take court action. It will take longer to get all your money back but you have to look at your own situation. It may help for you to have a read through all the Barclays threads. This is what i done & it really does help.
  17. Hi Atia, Its really up to you and your current financial situation. The goodwill gesture is a standard move by Barclays. If you chose to reject it just write back saying you still wish the whole amount owing to you (there are letter templates in the bank forum section which will help you do this). If you take the matter further you want to be looking at taking them to court, i know this seems very worrying but this is the stage i am at. There are many useful threads on this site Ie: look under the sucess stories for Barclays. Hope this helps.
  18. Advoc, Ive just spent the last hour or so going through this site again ie; prelim hearings and allocation hearings. My printer is going ten to the dozen.......... Im absolutely sh..ing myself now!!!!!! This has been going on now for 5 months and i cant even see a chink of light at the end of the tunnel! Am really begining to wish i hadnt started it now. There seems so much paper work to get in order. Do you think it would be worth giving Barclays a ring to say i have a court date (even if it is just for a prelim or allocation hearing) in the hope that they might settle?

  20. Hi Advoc, The claim is for nearly £4000.00 (this incluse the money claim costs & transfering cost to be heard at my local court). Do you think at this hearing they decide if you get the money or not. I wonder if Barclays dont turn up in court if i will be awarded the money then.......... what you think?

  23. Please anyone out there i desperately need help. Have received court date but not to sure if its for an allocation hearing or a prelim hearing as it mentions both of these. not sure if i have to attend. ther is no mention of submitting a court bundle. It just says " the claimant may make representation to the court in writing provided these are received by the court and served on the defendant no less than 5 days before the allocation hearing. It then goes on to say if either party is prepared to abide by the decision of the judge as to the directions to be given, that the party is excused from attending the prelimanary hearing. SO WHICH IS IT A PRELIM OR AN ALLOCATION HEARING???????? Do i have to attend should i call the courts and ask my hearing is on 3rd april. Any replies greatly appreciated.
  24. Not sure if i have received a court hearing through. it says before district judge xxxxxx at xxxx court 3rd april 2007. Then it goes on to say in paragraph 2 "At this hearing the court will consider either: staying the claim pending the decision in a test case or giving directions for this claim to be heard as a test case. It finally says in the last paragraph :The claimant may make any representations to the court in writing provided these are received by the court and served on the defendant not less than 5 days before the allocation hearing. If either party is prepared to abide by the judges decision as to the directions given, that party is excused from attending the preliminary hearing. So i am confused in what this means ie; is it a prelim hearing or an allocation hearing. Whats the difference. Do i have to attend and do i send my court bundle in???????? Very confused.
