  1. Just need some advice. As within my rights, I have sent a letter to my car finance company to inform them I am going to VT the hp agreement. They have replied and stated I need to return the car to their offices. Is it up to them to come and collect the car? Their offices are some 250 miles from my home and the trip would be expensive for me with the cost of fuel going and a train fare home. Can anyone advise me? Thanks
  2. I need some advice from anyone out there who knows about cars and legal matters. I have a 2004 Espace 2.0t petrol automatic. I sent the Espace for a oil and filter change last week and now have serious problems. It runs rough, wont accelerate or power dies. When I accelerate it makes a sort of whirling noise. Its smoking grey, stinking and there is oil coming out of the exhaust and I noticed oil on the drive. The wife said she could smell a rotten egg smell yesterday. Ive just checked the oil level and its way above the max mark. Could there be serious damage? BTW it was sent to a garage for this service. Also, if it comes to it will I have a problem proving the garage caused this damage. I have an itemised receipt for the work and a mot issued a few days previously and also the emissions pass results slip. #UPDATE# To update you all. The garage manager came to my house today and has taken the car back to the garage. I have been informed by them that the turbo is defective, they wont take any resposibility saying it could have been defective for a while. They checked oil level and it is fine, I expect it is now as the car has leaked it everywhere. I have pictures showing the level of oil on the dipstick. Anyway as a gesture of good will they will replace turbo for £1400 including 10% discount. What to do next and being realistic would I have a legal case? The car was fine before I sent it to this garage and had been issued with an mot and emmisions pass slip a couple of days before. Although they deny it I firmly believe it was their overfilling of oil which caused this. Thanks for any advice JG
  3. Hi texel, I hope they do stick to their offer. I think they just want rid of me. My charges all started when I had an illness and at the moment I am unable to work for the forseeable future, as such I have only been paying them through a DCA a token payment of £1 per month so I would say its there only hope of getting anything out of me. I don't own my own home so they have no claim there.
  4. To be honest I'm happy with the offer, and I wouldn't be too bothered if I couldn't claim any more from them.
  5. I have a claim for £1700 with HBOS for bank charges. I have a debit balance on my account of -£2500. If I drop my court case they are willing to wipe my balance of -£2500 and close my account with nothing more owing. Seems good to me as I am saving £800 and I have a parachute account anyway with another bank. I have asked for this "deal" in writing and with no conditions attached, but little do they know I am preparing papers for a further £300 in charges. What do you think? :-)

  7. Hi, I'm going to Dunfermline court on the 17th April. I have a claim with HBOS for £1732.22 and Abbey for £1118.21. These are both for bank charges and include 8% interest. The return date is today and Abbey have stated they intend to defend but HBOS haven't replied so I guess I win by default. I am starting to get nervous now about going to court.
