Receieved today a letter from 1st credit..introducing their debt help team quote" Our department has been asked to contact you and make every effort to reach an agreement to clear the above debt" !!!??? It goes on to offer me advice and loans!!! Sent email to 1st Credit asking them to answer my questions posted on the 14th March. It is now 5 days until they have commited a criminial offence. Q Then what..........help!!!
  2. Watching with interest DJ..I am on the exact same track as you lol. If it is the LBA you sent then the next step is court action. I am in Scotland and will have to go through the FO complaint procedure to reclaim my charges. If you are England then go back and read the step to step guide..I printed it off and refer to it constantly..it is a great help. Good luck
  3. Well done and congrats. Gives us all hope lol. I have received no reply from NAt West but live in hope. Enjoy the moment Kazzor.
  4. Hi all..just thought I would update everybody and myself. No response at all from Nat West. Not even a get lost letter lol. So due to the court procedures I have decided to reclaim my charges through the FO route. Any assistance on completing the form appreciated. I also intend to complain about the non-responsive approach from NAT West. Hope everybody else is having more fun than me lol
  5. Hi Finlay Just read your thread, very interesting. I too am having a nightmare with 1st credit..see my own thread 1st credt/lloyds who are they! I have sent them a CCA and received exactly the same letter you got re client..month etc. They have missed the 12 days and are now eating into the 30. Waiting until the 25th May to make complaint. BUT 3 days ago I received a letter from LSC Solitiors threatening me with legal action..I followed gingerheids advice and emailed 1st Credit re this letter. Now it is a waiting game again..will watch your thread with interest. Thanks to everybody on this thread for the advice given to Finlay, it has helped me alot too.
  6. Ok slight hiccup..1st credit solicitors sent me a letter saying they are starting legal proceeding!!!! Sent email to 1st credit re debt in dispute and not answering my questions posed on the 14th March.......god they make my blood boil!!! Nothing from LLoyds...7 days and counting!!!
  7. Ok sent email to them..I intend following up with a letter. This is the email Further to my previous communications with your company. I received a letter from LSC Solicitors. I would advise you that due to the fact I am disputing this debt AND you have been informed of this then I will be seeking legal advice regarding this continuing harassment PLUS when are you going to answer the questions I put to you on the 14th March?
  8. Hi just reading your thread as 1st Credit are hounding me as well..I received a letter from LCS Solicitors today, threatening court action. I have sent a CCA, dispute letter but still they sent this. They have already defaulted on the 12 day's now counting down the 30 days...BUT I now need to send a letter re this latest threat. The best form defence I think is to attack them as much as they attack you. Hang in there and check my thread 1st Credit/Lloyds who are they and we can swap notes lol
  9. Thank you to all for responding and it helps to know it is just a normal nasty letter. Any suggestions on what to do next?
  10. Ok..now I am angry lol! received a letter from LCS Solicitors today. Dear Sir/madam We act on behalf of 1st credit who has instructed us to write to you concerning this seriously overdue account. You will appreciate that the debt has been formally assigned to our client by LLOYDS TSB. Unless full payment is made to our client within 14 days from the date of this letter we are instructed to issue proceedings against you in the County Court for recovery. Should that step prove necessary our client's claim will include statutory interest, Court fees and Solicitors costs. If judgement is obtained against you then, after a period of 28 days, it will automatically be registere at the Tegister of County Court Judgements and will have an advers affect on your credit rating. Please note that we are not instructed to enter into correspondence with you regarding this matter prior to the issue of legal proceedings. Then they told me to send payments and communication to 1st Credit. Any advice would be appreciated...can they do this when I have sent a dispute letter and a CCA letter to 1st credit PLUS asked them on numerous occasion to prove they own this debt as I dispute the amount!!! I need to calm down and think my next move!!! Help.........
  11. My son has only made a claim against BOS..he then changed Banks. Hope you get your wages today..this might have been a one off.
  12. Yippeeeeeeee! Received a cheque from GE Capital today for £467...it felt soooooooo good. Now I will send the letter accepting it only as partial settlement. But for the moment..I am just enjoying having some of their money in my hands(or my money should I say!!!). Thanks to everybody for support and help..big kiss especially to Steven for his patience:D But the fight isn't over yet....
  13. Hi I am looking for some advice and the chance to get this of my chest! My son has just phoned me in a terrible state. By accident his work put his wages for this month into his old account with BOS. He has started claiming bank charges from BOS so had opened a parachute account elsewhere, which his wages were being put into. When he phoned the bank this morning regarding the mistake he was informed that the Bank had withdrawn his overdraft facilite and most of his salary had been taken up by this..he told them he needed the money to live on asked for it back. They refused and so left him with barely enough to feed himself for a week let alone a month. My question are they allowed to do this? What can he do to get his money back..if anything. Any advice would be appreciated. We do intend to complain to somebody..the bank is definitely starting to play nasty.
  14. You get about abit yourself parkvale:D Nice to know your out there as well!
  15. Thanks pers..I have that one waiting incase they send another nasty...thought I would try the polite one 1st! Though I don't know why they have never been polite to me
  16. Thanks Nattie..nice to know your out there:)
  17. Ok update Lloyds sent my statements after I sent a LBA. I have now sent them a Pre letter with my claim and put the account into dispute so 1st Credit can't do anything. I have another thread relating to 1st credit! Now just waiting on Lloyds reply...15 days and counting.
  18. So as it stands, even though they sent me a letter stating they where getting in touch with their clients Lloyds and it would take at least a month, the 1st 12 days are up and they are in default! I think:confused: I will just keep waiting!
  19. Ok yesterday I sent my LBA, recorded delivery. I included the schedule of charges with the interest. I also sent them a dispute/default letter..as they are threatening me with putting the account into default. Now just sit back for 15 days and see what happens. Well not sit back read and prepare for the next stage:)
  20. Ok sent away the LBA today, recorded delivery. Still no response from Nat West so lets see if the LBA will get any response. 14 days and counting well 15 days posted it yesterday.
  21. Right decided to accept both claims as partial payment...especially for the Debs account as it is only 2/3 roughly of my charges. Will be sending letter of soon..might wait for the cx 1st!
  22. Thanks for that Steven..I did read the letter you sent them and thought it was brilliant..I especially liked the bit about the interest. What gets me is their statement about not paying interest "One of these is that we will charge interest on any outstanding balance on the due date of each month. As your balance was not solely consistent of charges, the interest will not be removed" it is not that interest I am claiming back it's interest on the charges they charged me! So does this mean their argument for not repaying the interest doesn't stand up? I think I will send them a partial acceptance letter.
  23. Vampyra I sent them exactly the same letter..lets see if I get the same reply! Sent mine on the 7th April..heard nothing since. I email them and send letters..as suggested on the Gingerheid thread..no phonecalls from them since. They are just using the usual bully boy tactics we have come to expect.. Whats wrong with blonde!!
