The Judge made several referances to the fact that i was a part missing from my bundle and when i pointed out politely that the bank were the whole lot missing and that was was the judgement was based on , it was as if i hadn,t spoke. She accepted every argument he gave for not having produced the requirements on the order of directions, work load, the complexity of the case etc etc etc. I pointed out that my case was similar to hundreds of others previous over the last eighteen months and therefore an international organisation with virtually unlimited resources couldn,t justify their lack of responce, again to no avail. My feeling is that this decision was made long before i set foot in the place. Steph

Judgement set aside and stayed, hearing to have stay lifted to follow. Just about managed to follow proceedings, made notes of the banks arguments as he made them so that when i got my chance i could argue the necessary points. I did that to no avail. The judge said that on balance of point 3.9 she was setting aside the judgement and did not have time today to deal with the stay issue and would allocate another hearing for that, she also advised me that there are a couple of cases available on the internet that i might like to read (not tonight josephine) Steph

Thanks Debbie,I have just printed it off ,I had already sent a letter containing some of these things but i am going to go through it all in case there is something i haven't covered, then if i get a chance to speak i can cover it then. i intend to have a list of bullet points to jog my memory in case i do speak, i'm hoping not to, i tend to waffle rather badly when i'm nervous, although at the moment i don't feel particularly concerned. What will be will be. i'm sure the judges minds are 90% made up prior to the hearing. The good thing is that the judge i have been allocated is the same judge who made the first order, which they ignored. What are the other Things you mentioned that i might need? thanks Steph
