  3. It is a for a secured loan BUT the house it was secured on was reposessed in 2006. They are trying to just get as much as they can now I guess.

I have paid more than the money they loaned me plus a good interest rate to them already Am i the only letter who have received the letter already for a discount (not that I intent paying it) I love the part that say "our dedicated staff will be able to take payment as quickly and easily as possible" I bet they do and are real experts at this esp now with this news

How Did They Secure The Loan - I really dont know as I have no paperwork and they didnt send me any details of the legal charge as per my access request Were You Given A 14 Day Cooling Off Period - NO Did You Sign The Secured Agreement At Home Or At A Welcome Office - not sure but my guts tells me it was at home as I was really depressed at the time and welcome finance were really the last on my mind since it was about a month before repossession Did They Send You A Pre Contract Agreement - A Definate NO Did Welcome Contact You In Those 14 Days - they just got a signature from me and that was it no further communication from them DID WELCOME GIVE YOU ANY EXTRA CASH AND IF SO HOW LONG AFTER YOU SIGNED DID YOU GET THE DOSH - No extra cash just a rewrite Possggj I am sorry some of my answers are vague at the least its because I have no recollection of ever signing this last document. Infact it was a a shock receiving this when I did my access request. I checked all my files and have no paperwork at all regarding this rewrite and I am sure I never got anything Like I said before at this point when they did the rewrite which i am still in shock about, I had made it very clear to them I couldnt afford to pay this loan as I wasnt working. I told them about the impeding repossesion too and I am thinking its along here they somehow managed to get me to sign for this rewrite. Hope this clarifies my situation.
  7. I received my subject of access today and I am feeling really down about it all and that welcome really cheated me when I was most vulnerable. All I thought was the last agreemnent I had with welcome was in april 2005 and today I received I creadit agreement I signed on the 19th of September 2006 (a month before my house was repossed). I have no recollection of ever signing this agreement but the signature is mine and this is what must have happened. I was being pestered the hell by welcome and they were coming to my house all the time and I am sure I was cohersed into signing this at one point and I am so sure it was at my house as I would never had gone into their office and it seems it the only agreement I dont have. I doubt I ever got a copy from them. I was very depressed at this time with pending repossession and wasnt working which i had told them I didnt get any money and this was a 100% rewrite and and what they did was make the loan 300months instead of the 120month. In addition I received a letter last week too from Lewis Group debt recovery saying that I could save £8406 on my outstanding debt with welcome of £12 931. Apparently they want me to pay £4525 and they will clear my credit record and all. Its all sounding very iffy to me.   8. I had a basic account with natwest and due to charges, natwest claimed I owed them about £400 sometime last year. I told them this was unfair as these were basically charges. I tried reclaiming and they buffed me off and I didnt persue it and they registered a default for me on Jan 09. How do I go about contesting these and get this default removed from my credit file esp in regard of the recent court ruling?

Today I have received my PPI Schedule from Direct Group and here is the scan I did PPI Schedule from Direct Group picture by welscamsherry - Photobucket There were other documents but they are just the small print terms and conditions I am wondering if anyone can look at them and see if there is something odd. I did notice the welcome lifecare is for 60moths yet the loan was for 120 months Also the monthy repayment is listed as £230.53. This was the amount I was paying for the whole loan not the PPI, shouldnt it list only the amount of premium I pay for this insurance. I guess the reason they havent done it that way was the loan agreement lumped everything together and didnt list PPI separately...I hope u can direct me if there is anything I need to do now or wait for my request from welcome

  11. I know this may not be the course of action suitable for all but seriously sometimes to let go and get repossessed from SPML can be the most SANE thing to do... I fought with them as much as I could and eventually got round to the fact that letting go was probably the best thing around mid October 2006. It was tough coming to that decision but I felt such a relief and then I had to deal with the buggers at my local council who didnt want to hear...The fact I had a child and repossession letter did not move them a bit. I still wasnt a priority, I would only become a priority on the day of repossesion on the 25th of November when they would put me in B&B and it could be miles away even though I had a child going to a local school Fortunately I found private accomodation in a very nice area (I am still living here) and at that point I was very much known to the council and I was writing to them loads of complaints and visiting them. Finally they offered to pay the deposit which I had to repay back at £15 a month and I also started getting help with Housing Benefit until I was earning more than the threshold. It was tough but I can tell you even dealing with the council wasnt as bad as dealing with SPML, being dragged to court and facing those judges being a nobody is not easy Since then life has never been so good, it was like I was bonded in prison i couldnt escape and finally my life began again after repossession...I must admit I was a bit naive with debts...I had gone through divorce and maybe in my heart wanted to show I could go it alone and ended up with so much debt from all these loansharks including one called Welcome Finance....I have now stayed away from debt and am happy to say since the day of my repossession I have not applied for any form of credit. So if there is anything positive that I got from SPML is they scared the hell out of me about borrowing to this day. It was hard and had to do with driving an old reg micra and not having a credit card. The best card I had was an electron debit card which isnt always accpeted but that was upgraded to a visa card about 2years ago which was a relief. I have a partner now and another baby and things have moved on. At some point I may have to face and get a mortgage but for some reason that repossession doesnt show on my credit file...Is that normal? Actually there is nothing at all about SMPL....I am just working at improving my credit rating so that it will never be with another [EDIT]. I know all these companies arent perfect but SPML is in the TOP league of [problematic] The reason I am here is I still feel i suffered a lot on injustice from SPML and continue to be interested to see what else I could do them for...In a good way it happened before the housing crash so I dont owe them a penny now... So what am I saying if you are struggling and getting no where with these [problematic] it maybe best to let go. For me it certainly was (even though it wasnt my choice)...I had my life back and my sanity back. I could finally concentrate on my daughter who indeed sufered the agony of going through repo as mummy could hardly do anythings else. It really was such a relief and reading these post just seals that really was the best thing for me anyway BUT I am keen to see justice done, these people are just getting away with it and supported by all the privileged man in suits, the Etonian boys and all that

Also I signed that secured loan for £8000 on the 6th of April 2005 and on the 12th of April 2005 I received a letter thanking me for doing business and enclosing copies of agreements etc. I signed this at their office, were they not supposed to wait 14 days before contacting me? and I am sure the money went in before 14 days too but havent got details right now I have called the direct group and they said I should receive the paperwork regarding the insurances in the next couple of days. Reading this thread has reminded me of my dealings with SPML when they repossed my (or their) house of the 25th of November 2006 They were so many tears dealing with them and in a strange way it was such a relief not to have a mortgage with them any more.... They lent me £104K and they sold property for £116K and they netted £113K on top of my repayments for over 2years and all that was left was about £200 no wonder they are in the business of repossessing as quickly as they can.

Will be sending that off tomorrow, do i need to request anything from Howard Cohen as they are the ones sending me all the nasty letters threatening to take me to court? I have also just checked my credit history and seen that welcome record it as a mortgage when in fact it was a secured loan. The final secured loan amount was for £8000 ( i presume now unsecured since that house was reposessed) but here is the history of the loans I took out that were rewritten 1st unsecured loan £1500 in July 04 2nd secured loan of £4135.37 in Dec 04 (but include whatever balance I had from the 1st loan 3rd secured loan of £8000 in April 05 (but include balances from the above)

  16. I took out a loan first as unsecured and then it became secured and I think the loan was rewitten twice and to cut long story short. The last secured loan was on 13/05/2005 for £8000..I was a bit naive and I lost the house due to reposession this loan was secured on on the 25/11/2006. Now about 18months ago or so ago, the welcome finance people came to my new address and I told them I was in financial crisis thats why I had not paid any money and the house that the house the loan had been repossed which they had loan secured on...The sweet talked me claimimg they would take some money off etc if I made some payments if I could make some sort of payments. I agreed £30 monthly which I have been paying by Direct Debit since then Fast forward about 6 months ago I received a letter saying the local branch was closing (or something like that) and that my account was being transfered to Head Office - The Nottingham Branch THATS WHEN ALL HELL STARTED I started getting letter that they were now registering defaults and arreas against me and I just continued with payments until today when I received letter from Howard and Cohen threatening legal action and if I fail to apy £13 221. Being annoyed I rang Welcome why they had forwarded me to debt collector when I had stuck to my agreement and they didnt want to hear and they put me forward to Horward and Cohen and they said I have to do another agreement with them BUT first I had to send them my statement of earning. I told them no way, I wasnt going to do that and that I was cancelling my DD with Welcome. Now what should I do? ALSO Since my account was moved to Nottingham, in all the paperwork they have spelt my surname wrong so all the defaults and arrears are in wrong surname. I havent told them this....my surname is a little unusual it has "zi" in it and Welcome has put "u".insteas...It just show how these guys dont really bother hecking their stuff....However all my agreements I did local have my surname right
  17. To answer some of the questions i got the intial notice to owner and the last communication i got from the council before i moved was that they were rejecting my appeal. I didnt advise the council of my new address and i didnt receive any other communication from them at the new address apart from the bailiffs letter i got last week. Its a different council from where i live so not sure if its the council that got my new address and passed it to bailifs. Also dont quite understand the interpretation act but if i moved and didnt notify the council will the blame not be put on me. I have read the stuff about not opening door etc but i presume they will keep coming. I just want a way of dealing with it. What should i do then now to try and sort this mess i have put myself in?
  18. I am in a pickle and panicking so i hope you can help me. Last year August 2006 i got a parking fine ticet from folkestone council which i appealed saying i didnt notice i had to pay. To be honest i was just trying to buy time doing the appeal. they turned down the appeal sometime last year. I moved house in Nov 06 and i didnt do anything about the ticket. On friday i received a letter from JBW Enforcement ltd (Bailiffs) saying due to non payment of penalty charge notice the matter of collection by distraint has been placed in their hands. There is alsoa note saying they had traced me from my previous address - not sure how they did it since i sold the car i used a last year too. The letter just says if full amount is not paid in 10days then they will come to take inventory and remove the goods. There is no mention of how much i owe and i am really panicking. i am assuming the council took me to court. My main worry is i have no clue how much i owe now considering they may have tried to contact or even visit my old address. i am so scared how much this might be and i am too scared to call them just incase i activate the case. I would want to pay but can only afford small payments maybe £50 top max a month and i have heard bailiffs can be very difficult trying to arrange payment with. Can you please help on what i have to do now
