  6. Sorry to start a new thread but I don't want this one to get lost. I just got my microfiche copy statements from Abbey for 2003/04. It was my first year as a student and I distinctly remember fuming at Abbey most fo that year with lots of charges going on. Thing is - these microfice copies just look like a spreadsheet print off and there are only 4 x £33 worth of charges!!! Where's all the rest. I even went to the States that year and came back to an unauthorised o/d, but that's not on there!!!! Obviously if I had the complete run of statements from then until present, I could input the lot into MS money and see if it bablanced, but 2004/5 is missing still. Anyone else found any discrepancies?
  7. Yeah - I checked the letter and it says in full and final settlement of THIS court claim. Noi mention of any other dealings I may have in the future. Anyway, they have got back to me and they are sending a cheque out . They better hurry as I've just had my allocation questionnaire. I didn't realise it cost another £100 to send that in as well!!!
  8. Yeay!!! Got a letter today from Abbeys solicitors making an offer to settle. Must admit I was starting to get a bit antsy, expecting to go to court etc. Anyway the full amount was £760 + Intererst and Court fees. Abbey have agreed to pay half + interest and court fees. So I'm happy with that. Still waiting for the rest of my statements that they say are micro-fiched etc etc. Data Protection are on their case about that now though.
  9. Got my case going online via Moneyclaim and Abbey have said they are defending. How do I get the case moved to a court near me - I'm in Leamington Spa, in the horrible instance that I have to turn up and do my thing??? May have to as well - no offers of settlement been forthcoming - just a solicitors letter asking for all the evidence.
  10. HAs anyone taken Abbey to court under non-compliance of DPA yet??? I've written to the Information Commissioners Office ages ago - sent it recorded adnd it was received by them on 19/05, complaining that Abbey hadn't replied to me asking for statements, apart from the last 12 months worth. They haven't replied to me either!!!! Anway - I've just issued the court case (Not appearing in Litigation forum yet) as of today for 899(inc costs) for the last 16 months worth that I've got on statements. How do I get them to stump up the other statements. Tell the truth - it hurt to stump up the £80 costs for this claim as I'm a single mum and ft student so unless I get the money for this one then I can't afford to splurge again on another case, esp if no-ones been successful yet. I wrote to them just before I write to Data Comssion asking for other statements but they haven't even bothered to reply!!!
  11. OK - thanks for that - I have now filled in the form on the Informaton Commssion(Data Protection) site and sent that off. I suppose I wait to see what this claim results in and then take them to court if my complaint is upheld. Money claim all filled innow and saved ready to go in a fortnights time.

OK - Bit stuck now I've got last years (2005-2006) statements and am about to send off a letter before action to Abbey for £760 - (Actually do I add the £55 interest onto that letter or when I file the case?) But I sent a stern reminder letter for the rest of the statements recorded(09/10) and it was signed for on 10/05, but now - nothing???? I remember geting loads of charges for those last 5 years as I was mocving house, ex hubby leaving me, trouble with Income Supports etc but how can I take them to court for unknown amounts??? Or how do I take them to court for non-release of my data under Data Protection?? Do I infoirm the Data Protection commissioner and let them take care of it? I've had a look at the FAQ's and can't see anything in there - or am I looking in the wrong place? TIA
  13. Same thing happened to me and my claims about the same time as yours as well - last years statements today but nothing further back so i sent off a snotty letter as well - recorded of course - lol. £750 of charges just for last year - and that was a good year!!!
  14. Well I just got my statements for last year but no sign of any from 2000-2005. I've written them a follow-up chase letter now as the 40 days runs out next Tuesday "I have received bank statements from 13th Jan 2005 to present. However, I have not received any of the earlier statements from April 2000 to 2005 as requested, or any listings of events in my account history over this period which have required manual intervention by any member of your staff or any other person. I still require disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my banking business with you, and have paid the £10.00 to you as required by the Data Protection Act. I sent the original letter to you on 3rd April and it was recorded as received on 6th April. With the cheque clearing on 10th April. I initially asked you to send these statements within 40 days. You now have until 16th May to comply before I report your non-compliance to the Information Commissioner and I will also begin a County Court action under the Data Protection Act." So hopefully I'll get the rest through soon and I can start adding up - over £750 for last year so far.
  15. I sent my letter under DPA rules and it was received as signed for on 06/04. £10 cheque was then encashed on the 10/04. It's about at the halfway stage now so should I follw up with a letter to remind them and get their a*ses into gear, and if so - should I send it to the same address or someone else to hurry it along??? TIA
