  1. do you mean £1000 if so this sounds about right for the sharks im afraid you can challenge all you want but if you don't pay they will take the car. if it is £100 your daughters got it wrong not even these sharks work on that intrest rate
  2. i its not me giving strange advice ive been through it with these people. they can and will reposses without a court order the car is secured on a bill of sale and secured debt cannot be added to a dmp. as for the muppets you call them they don't need to be court baliffs to take the car the one that came to take mine who worked for a well known recovery firm said he hated doing logbook loan work and after I showed what I had paid he rung his company and told them the car was not at my address even though it was but told me to move the car as someone would be back. when the logbook loan company knew the car was hidden they issued a county court sommons I borrowed £2000 to pay back 5000 id paid back £3500 the result of the court hearing was give them the car back to sell at auction and pay any remaining money owed given 1 week to hand car back or pay just short of £7000 including all charges and court costs how can these be unlawful if ordered by a county court please let me know because I don't want to pay them not strange advice just speaking through experiance
  3. first no you cant add a logbook loan to a dmp the loan is secured on the car secondly they can and will reposses the car they don't need a court order because logbook loans come under the bill of sale act. are you on weekly payments or monthly every time you miss a payment you will be charged if they do send out the recovery truck this will be another £200 to £300. you say you owe around £1200 you need to contact them to find out exactly what you owe tell them you have hidden the car this will stop them sending out the recovery truck every time they send a letter to your old address they will charge you. you need to act soon or else that £1200 will soon be up to the full value of your car. you should check that they have registered the bill of sale with the high court this should have been done within 7 days of taking out the loan. you will not win with these people I am speaking through experience they really do hold all the cards. my advice is and you wont like it is find out exactly what you owe try and raise the funds to pay them off or give them the car back you say its worth £5000 but they sell these cars at auctions it will probably sell at £3500 at best with their costs and auction costs you could end up with no car and still owe them money which they will then chase you through the courts for sorry I couldn't be more positive I know how you feel but these people are ruthless
  4. this is the other story . fair enough the claims company initially got the claim moving but after that was useless. the loan company asked for certain details but the claims company did not get the imformation right so I ended up dealing with the loan company myself. all they did was send me an automated letter every couple of month saying my claim was still being assessed due to the backlog. ive had to deal with the ombudsman and the loan company myself many times to get things moving otherwise I think id still be waiting for my claim to be settled. anyone thinking of using a claims company dont
  5. decided to accept their offer as Ive waited 2 years for it. just had the letter off the claims company I regrettably used, that's another story. they want the 20% I agreed to which I don't mind at all but they have added 20% vat onto it. there was no mention of this when I was visited by their agent just the 20% on any refund I received. why do I have to pay vat ive already paid income tax on my refund. anyone help
  6. had offer back today on the smaller loan of 5k. ppi payments made 758.39 plus 8% interest 264.83 less income tax of52.97 total 970.25. second amount ppi settlement cost 1243.05 less rebate when loan was settled 507.42 plus 8% interest 166.56 less income tax 33.31 sub total 868.88 . total net redress 1839.13 can anyone help with the figures should I accept or should I still try and claim charges they made when I was in arrears im a bit of a layman when it comes to all this so any advice would be appreciated thanks
  7. sorry should have explained I took out two loans one for 17k and one for 5k both with ppi and ombudsman has upheld both claims .total 22k over the 3 years and 6 months I had the loans I must have paid back 10k but when I settled the loan central trust wanted just short of 30k before they would release my deeds
  8. my claim was was first dealt with by the ombudsmans adujicator who upheld my claim but central trust appealed against his decision it went to the ombudsman for a final and binding decision which he also upheld my claim I have no figures yet and the only thing I have signed is the form accepting the ombudsmans decision
  9. hi just won 2 cases of ppi against central trust I took out the loans for a total of £22k in 2007 secured on my home. all was going well until I lost my job in 2009. for the next 12 months I struggled to make my repayments to them and fell into arrears eventually giving up and decided to sell the house. with the housing market at rock bottom in dec 2010 I sold it to a property company for two thirds its value. when I came to settle the loans with central trust I had to pay them just short of £30k which they said was for charges of being in arrears letters and phone calls. I had paid the repayments for 2 years no problem but for 12 months was in arrears I couldn't argue with them over the charges because I needed the deeds for the sale of the house on the £22k I borrowed I paid 370.00 per month for 2 years and what ever I could in arrears sorry for being long winded but could enyone let me know if I could claim back some of these charges
  10. 12 months ago I took out a logbook loan but fell behind with repayments my repayment was £75 per week but as I got paid monthly I agreed to pay £500 a month which I did for 2 month but then got letters from them saying charges had been added for late payments because I had not paid weekly the cost of the loan was £5700 for borrowing £2000 I have paid back £4000 but in total they have added £1800 in charges which include 2 visits from the baliff to be fair to him the first time he visited he said he hated this company himself and if I gave him £100 he would tell them the car was not at the property and he would ring me when the next visit was due so I could move the car. ive now hid the car and it will not be found I have contacted the loan company asking to set up a new repayment plan of £300 per month if the will cancel some of the charges but they say the charges stand. sorry about this being long winded but this is what I need advice on I have been approached by a guy who says he will buy the car he has the same car and says he will use my car for spairs only so the car will basicly disappear nobody else will be lumbered with it would my debt with the company become unsecured so I could then add it to my debt management plan payments maybe then the loan company would drop some of the charges I want to pay them but not all the charges and intrest they have added any advice i would be grateful
  11. a few months ago i was desperate and stupidly took out a log book loan. the loan was for 2000 pound and i have to repay 5000 pound i know i was stupid but i was really desperate. the thing is the car and the logbook are both in my wifes name although my wife knew about the loan when the agent called to fill in the loan documents my wife had been called away to save him having to return the agent forged my wifes signiture on the loan documents . does anybody know if this loan is legally binding i know its a strange case but it did really happen the agents signiture looked nothing like my wifes he was just as desperate as me to make is sale can anyone help please
  12. thanks for the advice everyone capital one have sold my debt to a debt collector who i am paying off at 20.00 pounds a month so the sooner i get this sorted the better thanks again
  13. i have started a claim against capital one for charges made against my credit card. They have sent me a letter stating that it as been agreed that a fair charge is 12 pounds so they have said in the letter that they will only refund the difference from their charge of 18 pounds which leaves me with a refund of 6 pounds per charge are they within their rights or should i still reclaim the full ammount advice please
