Hiya, My son was sold a car just coming up for 6 months ago. a week after he got it, someone ran into him and it was off the road for 2 months. When he bought it he had a 3 month warranty. he got the car back as it went out of warranty. Then the clutch went to which the local garage said it would have been picked up when the car was sold, so the guy who sold him the car knew this was happening. He had to spend £800 there to get the clutch fixed. Now, the engine dropped in the car when he got it back today, he went back to the garage and the guy checked it over, the underplate was missing, so he decided to check for other faults and the catalytic converter has been removed by the guy who sold it after the MOT. So instead of buying a newly MOT'd 2.0 turbo diesel car, he has a 1.2. The garage is willing to give him a statement of everything they've found. We've just noticed that in the first 6 months the buyer can approach the seller to ask for a full refund if they cant prove the problems werent there when they sold them. The fact the car was off the road after the accident is proof it wasnt being driven for the plate to fall off and the catalytic converter didnt just vanish between the MOT and the seller's mates garage and the time of selling it. Poor son spent his Afghan bonus on a family car for his wife and baby and he's been shafted by this guy. Can anyone give me some direction as I've only just been made aware he has 6 months and we dont know if this is true as the garage he bought it from only gave him a 3 month warranty. Ok back to Charges No1.. I got a letter this morning saying - Before district Judge blabla bla at County Court, my town.. IT IS ORDERED THAT 1: Claim struck out as the Particulars of Claim disclose no basis for the claimants claim against the defendant.. Any idea what this is?? I got the refund last wk and the AQ 2 days ago, do I still send in AQ. Can they claim the money back:o

Hiya sry for not being around. I ended up in hospital that day lol. No it wasnt shock:o Anyway I apologise my other half spent the 1st lot of charges refunded but claiming the 2nd lot to which I WILL make a contribution as he's in Canada now:p Anyway I got paperword showing defence this morning for the 2nd account and its showing Eversheds as being the defendant now.. Does this mean its getting tougher to claim now??

Now that things are going via Eversheds does it make any difference?? Mine is going via them now:confused:

HELPPP I went to see the MCOL status and press for judgement... It now says Defence (12/03/2007):o Does this mean good or bad??

I am seriously losing faith in getting any charges back. I cant pay for my next MCOL until this one is finished and time is running out:( I really wanna press the judgement button but I wanna give them a chance.. am I too nice?

Well I called the court and the 28 days are up today.. I am gonna hang on till 2moro to continue. Although it would kinda come in handy if they paid up before Friday as my other half is off to Canada to take up a new job:eek: I am however getting kinda worried. Has anyone NOT been reimbursed??

Hmm.. The account I am claiming for has been sitting overdrawn since Jan.. But - NO charges have been applied since then. Normally I would get one for being overdrawn in Jan, Feb & March but its the same amount still:confused:

Mine is up on 16th. They said they want to defend it. But do I do the same as u guys if nothing by 17th then?? Did they say they were gonna defend to you.

Not heard anything as yet so called the court to ask where I stand. They have until the 16th to file their defence.. If I aint had payment or heard anything I call the court on 17th and they go from there.. Next MCOL is getting done on Friday for joint account too:)

I'm a bit concerned.. MCOL was done & they defended it on 13th March.. I aint had nothing yet from court of them... Am I supposed to get any papers or something??:?

I have a little question.. 3 yrs ago I got a bill from the taxman saying I owed them £20K for overpayments:eek: Anyway in the 2 yrs prior to that I only had £13K... So they stopped ALL Child tax credit & WTC.. I asked them to look into it. Anyway last wk I got a letter saying I am due them £364, which is kinda less than the original debt. My issue is that for 3 yrs I have been done out of CTC & WTC and not sure what way to go about complaining etc.. Any advice would b greatly appreciated..

Its ok I get it.. Showing Acknowledged (14th Mar) now & that they have 28 days to reply.. woohoo getting there.. Wonder how long now8-)

I claimed on Friday.. On MCOL it says Issued 12/03/07 and that they have 14 days now to defend the claim. It also has another section which I am unsure of - Start is written under Judgement section... Do I use that section after 14 days??

Congrats:grin: Just a quick question if u dont mind.. When they said they were defending the claim, what did u do then? If anything.. Or did they just say that & paid up anyway?

I just noticed I may have put this in the wrong section... I purchased the laptop from Currys.. Sry pls move me:)

I purchased a laptop on 23/06/06 and in Jan it started switching itself off if u moved it.. Here is a run-down of the action.... This originally was returned because of the following errors - When you tried to move the laptop it would cut off... If you plugged in power-lead it would cut-off..If you touched the top-left corner it would cut-off.. Every time I turned my laptop on I had to take the battery out & power-lead & reset the MOBO by pressing the on/off button.. Sometimes the screen would shake eratically as well. Returned on 6th Feb... with Service Report saying - Replace MOBO.. So, I switch it on... guess what - When you try to move it the laptop would cut-off!!!!!! If you plug the powerlead in its cuts off!!!! If you touched the top-left corner it cuts off!!!! NOT only that but now the Wireless adapter wont enable and there is a bare wire sticking out on of the headphone/mic sockets on the front... I tried to enable the wireless but it disabled itself straight away!! Called Tech guys back - its to go back yet again!!! Get collected on 8th Feb for 2nd time..(B615193) Returned to me today 20th Feb!!!! Following errors - Exactly the same as the last ones..... I am sick fed up with this.. On the engineer report it says "No fault found".... So why then when I turned it on is the Wireless not on (when I have 2 pc's in the house & XBOX Live working perfectly wirelessly). The wire is still sticking out the front AND shock horror - when you move it or plug in power lead it switches itself off... So now its booked in to be collected on 22nd, fingers-crossed Now I aint being awkward here but I spent £500 on a laptop that I aint been able to use for the last few months.. Just wanna know what happens if it comes back again with the same problem.. Do I really want THAT laptop back??

Just an update - LBA was delivered to them last Monday (12 Feb), the 14 days I gotta give I am assuming is 14 Working Days?? I also finally just got the copies of my statements through for my other Nationwide Account which I sent for on 12 Jan,, 39 days later.. Cutting it a bit fine I must add:rolleyes: I have now got my Initial letter for that one all ready and waiting..
