  1. Thanks for that, although I'm fairly certain that all the charges on this account are from the last 2 years, before they froze the account. I'm sure I read somewhere that if you don't get your SAR, but have kept old invoices, you total up the charges and average that out over the 6 years and then claim for that (bet that'd scare em) in the hope that they'll then cough up the actual charge info? Think I may do that anyway, I realise the banks are snowed under with requests, but how long does it take to log a letter onto a system and generate a bog standard 'we have recieved your request etc etc' letter? Certainly not over 40 days! MBNA are awful, and after reading various posts over on MSE regarding their bullying, intimidation and downright rudeness, the sooner I pay up what I owe and sever all ties with MBNA the better!!
  2. Not much help to you, but I'm in the same position. Sent MBNA 4 letters and not heard a thing from them, they've not cashed the cheque either. I have downloaded the complaint form from financial ombudsman (?) but I'm not sure what to do once the complaint is lodged. If I hear anything useful I'll let you know
  3. Got my reply today, they've actually offered 1026, but this amount is to be paid by them direct to the DMC who now have my debt. Fine by me, I'm not going to quibble over the 50p!

  6. Well I eventually told fd that i'd accept £850 as I decided i'd rather take the money and run than take them to court. Not heard anything back yet tho...
  7. Sorry if I've posted this in the wrong forum. I recieved my statements back from Morgan Stanley, and they sent all statements since my account opened (August 2000). This is obviously outside the 6 year limit, so if MS keep records longer than 6 years, do you think other institutions do too? Would it be worth asking for ALL statements for an account? Just a thought.....

Ok I'll send the SAR again with a PO, if they later cash the cheque ok I've lost 10 quid, but as I think they probably owe me alot more than that it's worth it! I can see MBNA are gonna play tough on this, and I get a nasty feeling i'm gonna have to go as far as LBA at least Shame really cos Morgan Stanley were v good, sent out statements from the start of my account (August 2000) and not just the last 6 years, think they were so helpful cos I only had 1 charge for £20 lol....... :idea: if they had all my statements from over 6 years ago, does that mean MBNA might too? Maybe I should ask for copies of ALL my statements????? As always, your comments/ideas are most welcome W x

    Boing v MBNA

    Hi there and thanks for reading..... My account with MBNA is part of my DMP with CCCS. I wrote to MBNA requesting my SAR on 18 Jan 07 inclosing the £10 cheque. Had no response so wrote again on 29 Jan 07 requesting SAR and acknowledgement of receipt of previous letter and cheque. Still NOTHING lol. The 40 days is up on 27 Feb 07 and as of today the cheque has not been cashed. Both letters were sent via recorded delivery so I KNOW they recieved the letters. Do I write again, pointing out they only have x days in which to respond? Or just leave em to it for the moment whilst I compile a letter of complaint to the Financial Ombudsman? W x

  11. Sorry if I'm repeating a question posted elsewhere, but how long are/did you wait until you recieved your statements? I posted my letter requesting statements on 18 Jan, giving them 40 days and they've not cashed my cheque or made any contact as yet. 40 days is due up on 27 Feb. Thanks
  12. I've already had my statements, sent my claim letter with schedule of charges i'm claiming back, and recieved an offer letter yesterday. Claiming £1026.50 plus £123 interest. They offer partial settlement of £700 for my claim of £1026.50, and state.... "I am not prepared to consider a claim for charges relating to unpaid direct debits or for debit interest." The unpaid direct debit charges total just under £200, and the rest of the £300 they've cut from my claim relates to the 8% I would be claiming if the case went to the small claims court. Now I think they've got themselves confused here as the amount they're taking this £100 and £200 from is the amount I'm claiming not including interest. This is first direct we're talking about tho, so I'm not suprised they got it wrong lol. They replied before I prepared my LBA, so do I send the LBA now as I will not settle for a partial refund?
