Claimform from Shares Finder company for fees - help

Hello everyone reading It's been a long time since I posted on here but here's my query About a year ago a ' Finder' got in touch with us and informed me and my husband that we had some shares in a company that my husband was once employed by. We were aware of these shares but to be frank thought they weren't worth much . Our finder gave us the information via e mail how on how to claim for our shares. My husband did agree via email to pay the finder 15% . We claimed the shares and intended to pay the finder his 15% but our circumstances have changed and now we cannot pay him. We have received a claim from the court now . We did not sign any contract but did agree in an email to pay him . Is this legally binding and how do I respond to the court claim? Have already started the ball rolling, I believe they have 6 days to acknowledge my appeal and 40 working days to give their response. Just as a point of interest my sister works in the complaints dept of a large well known bank and said it is always worth saying you are going to the ombudsmen as it costs the company £500 each time there is a complaint made against them regardless of which side of the complaint is upheld. If disputes are resolved prior to your complaining to the ombudsmen then it doesn't show on their complaints figures. So they are always trying to resolve before you take it any further. Also , as in my case, the cost of the phone is less than the their costs if I take it further, so always give it a go !

Just checked with home insurance and it is insured under them ( so far) but there is a £250 excess in place which makes it not worth claiming , I have a week to decide whether or not to claim then they will close it. Does this then mean I cannot return to the claim if I get nowhere with my appeal against gadget safe? Can you only claim against one policy at a time?

Thanks for the prompt reply. Did think it was clutching at straws a bit but seems unfair that you have to be practically mugged on the street before they consider a phone to be stolen and worthy of replacement . My phone was stolen, cannot understand why it matters where it was stolen. You are almost encouraged to ' make up' stories to fit with their rules of replacement. If i'd said it were lost I would have a new phone by now. Will still make an appeal anyway and take it to ombudsmen. Just cannot get over my feeling of unfairness. Will have a look at my home insurance but i'm quite sure they don't insure mobile phones. Many thanks

Hello everyone, Long time since I posted on here, its lovely to be back. Well I'm fuming! My i phone is insured with my husbands ' signature current account ' Yorkshire bank, ( gadget safe insurance) pay extra for account and reap benefits...if only. Went to visit my daughter who lives in London, didn't have enough room in my handbag for my phone so put it in her handbag. We were invited to a house party at one her friends houses , I kept the bag near me all night, some light fingered Larry liked the look of her bag and stole it from under my nose! Unbelievable. Reported to police and provider as soon as we realised it hadn't been taken ' by mistake' and within the timesales they expect. Thought it would be plain sailing only to be told that in section 1.3 states not covered if' theft from any building , land or premises unless force, resulting in damage to the building or premises , was used to gain entry or exit' . It seems extremely unfair as I kept the bag with me , no one knew this fella that walked in and stole whatever he fancied, the phone wasn't on display or left out anywhere. If I appeal do I stand any chance of winning? Just because they have it in their T&C's does it mean they are right? Just soooo mad Any help most appreciated

Hi there, just interested reading your thread, I too am from M'bro and had very similar directions from the judge ( see my thread , its in the WON section) I left it as late as possible to send in my bundle, as it happens, a cheque arrived the day before it was due just as I was about to leave for the post office, so you too could be VERY close to your cheque. Hi there, just to let you know, I received my cheque for the full amount just 3 days before my court bundle needed to be submitted. This was the day after I spent 2 hours in a photocopying room at work hoping I wouldn't get caught. What a nightmare! Hang in there, your money not far away now.. -

Hi there, don't get too dis-spirited now. YB settled my claim 2 days before they were ordered to disclose documents to me. I started my claim in November , so it's been 5 months from beginning to end. I know I have been lucky, but I think the judge helped with the order. Hopefully won't be too long for you, stay 8) x -

Absolutely, can't stop smiling. There were no letters to sign ' in full and final settlement' just a request to send in the notice of discontinuance. Time to start on my husband's claim now, watch this space... ( already got half the bundle prepared and copied):grin: -

RESULT! Got a cheque this morning for £5492, just as I was preparing to go to Staples to bind up my bundles. I have deposited my cheque today, it will take up to 5 days to clear, my documents are due in court by Friday so there is an overlap. Should I still take in my documents and then send a notice of discontinuance when cheque clears? I'm totally thrilled, can't believe we got another one over the bank. Couldn't have done it without your support, thank you very much, donation when cheque clears for certain . xx -

Still no news of another offer. Waiting for 27th April deadline for disclosure of documents. Have my bundle prepared and ready to send off tomorrow.What happens if YB miss the deadline as I suspect they will? This court bundle was a mammoth task and I will be super narked if I comply and they don't. Can I ask for judgement?
