Well, for those of you who are wondering how this protracted malarkey is going, well things are progressing in line with the process.....And the process I am using is basically the process that Shelley used succesfully with a few blips of my own!! I will comment in detail later on and sorry for being reserved at the moment but I have my reasons....When I do finally reveal all, hopefully I will have some useful comments for you to take away and use yourselves....Many thanks to those who have sent support and continue to do so.   3. At poc stage with HALIFAX VISA. Has anyone got a copy of t and cs going back to 2004 for sight of? Any recent successes on here with regards claims over 6 years with Halifax. Can't see any. Many thanks if anyone can help Bun

  6. On the N1 Claim form there is a heading called VALUE. Do I put anything here or just fill in the box at bottom right? Do I need to put anything about daily interest accruing on this front page or put it at the end of my POC on an additional sheet? Thanks
  7. Sorry for wasting your time Slick. You're right. I accidentally got my dodgey info from a dodgey claims website that claimed to be offering decent information. I realised after I had made my post that I had been misled. Cheers.....
  8. What is the court fee for claims up to £5k? I have read £120 plus another £50 admin fee to be submitted with N1 form. Is that right? So the court fee on the N1 form should be really £170????
  9. Hi Noomill. Thankyou for your support. Yes it does complicate things with a dca trying to interfere. I know what needs doing and with a bit of help here and there from good people on here I will see it through. Bit busy at the mo but will try and catch up with your thread later on.   12. Hi BARCLAYS were sent claim letter for unfair penalty charges with all copies of relevant statements dating back to 2004 with regards a credit card. In the letter they were told 24.9% interest in restitution was being claimed and charges over 6 years with relevant case laws quoted. Told to send me cheque and not to any other organisation or third party.Letter sent proof of delivery. The account has recently been bought by a dca with an alleged amount owing on it (within days of making the claim funnily enough.......). There is no ageement between HALIBUNNY and DCA and that is being dealt with separately. HALIBUNNY does not acknowledge any debt to DCA. Finally received letter from BARCLAYS. Main points as follows: "Further to your request for refund of fees to 2004, in accordance with guidelines issued by FSA , BARCLAYS only hold copies of statements for 6 years and therefore I regret we cannot access info before 2006 BARCLAYS is prepared to credit you with £20 and £22.10 contractual interest at 21.9% in full and final settlement of your claim. The agency responsible for your account has been notified and your account balance will be amended accordingly..... (This offer was based on one charge in the last 6 years. All the others over 6 years have been ignored even though copy statements were sent). I understand that you would like refund to be by cheque. However, in accordance with policy as there may be a balance outstanding on your account the refund has been offset against any balance owing. Sorry if this is not the answer you would like but hope my explanation is helpful.... For purposes of financial ombudsman please consider this to be our final response" And that's about it. So I need a response letting them know 1. I want the refund and no other party and 2. to get the 30 other charges refunded. Can someone give me some help in replying and plotting a course of action to remedy the errors of their devious ways? Many thanks HALIBUNNY
  13. As I have already said.........I am not asking about any past succesful cases!!! I am asking for comments about the legalities which might detriment my suggested process. Yes they might say it is full and final settlement in which case it would be accepted only on condition that it is accepted as part settlement. In such a case they might not agree and not pay it which means I go to court. Or they do pay it under my conditions that it is only part settlement. I then go to court and claim the difference. As this issue applies to all bank threads potentially I don't see any value in putting it under one particular bank thread. They most often offer less than you want and I'm asking about the principle of accepting offers as part settlement. From your comments it seems nobody has been succesful after accepting part settlements but you don't say whether there are any situations like the one I'm describing..... I find some of your comments a bit sarkey to be honest dx and getting towards being a bit personal which is very unnecessary. If you want to try and help please answer the questions I am asking, not what you want to answer which is something completely different. If you can't answer my question, don't post. See if anybody else knows. Thanks
  14. I'm not asking about past records of banks. I'm stating the situation and I'm asking about how the courts might see the situation of me accepting the bank's offer as part settlement and going for the difference to get true restitution in court. To me it seems a fair claim on my part but I'm biased. I'm wanting to know if there are any legalities which would be against me accepting part settlement and going for the rest in court. Or would it be detrimental to accept as part settlement and go for the rest in court? Has anybody got any ideas?...Thankyou
  15. Don't want to say. They monitor sites like this. It isn't important who they are anyway. I'm just questioning the principle of doing what I am saying. Can you see any lawful reason why the difference would be denied in court?
