  1. I have some queries with the admissions form. I am a student so i'm assuming I put unemployed? But I want to let them know i'm a student and studying to enable me to get a job when my children are at school so can I attach a letter explaining this? I have no income other than child benefit, and my husband is self employed. Do I fill his income in and our joint expenditure and joint debts? Thank you for your help.
  2. An instalment offer being "monthly instalments"? Yes we have an agreement with our mortgage company in place. Shall I attach a copy of this with our form?
  3. I have today received a County Court Claim form the claimant being Capquest Invesments Limited. The particulars of the claim are as follows:- Monies are due under regulated credit agreement number xxxxxx between Citifinancial Europe Plc and the Defendant which was assigned to the claimant on XX/XX/XX. The agreement terminated upon the defendants failure to comply with the terms of the agreement and/or the statutory notice of default served by Citifinancial Europe Plc. The claimant seeks contractual interest pursuant to section 69 of the County Courts Act 1984 at the rate of 8% per annum from the date of the issue continuing the daily rate of 1.22. Any payments or queries should be directed to the claimant on: XXXX XXXXXXX or XXXXX XXXXXXXX. What do I do now? Yes I do owe the money, can't afford to pay it. I hope somebody can advise me.
  4. Also forgot to mention that I sent the CCA requests on 26/3/07, got reply from the on 30/03/07 stating that it might take more that 12 days and if it did they would let me know, received CCA's today 11/03/07.
  5. Got the CCA's back on the 3 accounts today. One of them is a full page copy with name address and account number on, but the other two are just the box at the bottom of the page and it looks like they have stuck a piece of paper over the top with our name and address on and copied it. They also enclosed with each CCA a couple of copies of statements. I'm, very confused though, as the account numbers on some of the accounts don't add up to the original credit card numbers. Also these debts were sold to Lowell on 19/01/07 so why do some of the statements that Capital One have sent to Lowells still show a debit balance and yet one account shows a nil balance? What do I do now? I'm concerned with all the mix up with numbers, i've only ever owned one account with C1 and yet they have 3 different numbers. My husband two accounts seem in order though. Any advise would be grateful as the letters say we need to make payment within 7 working days.
  6. They have accepted our offer of monthly payments and they also got pressure from the council to be more agreeable as I sent a letter of complaint to the council telling them that they were requesting full payment.

I have received a Final Notice from Lowell Financial stating the following "Our agent has failed to make contact with you as a legal requirement we must now inform you that 7 days from the date of this letter we intend to instruct our Legal Department to review your account. This may involve applying for a County Court Judgement to be registered against you. If successful, dependent on your circumstances we will enforce the Judgement by one or more of the following steps:- Blah blah blah" How do I respond? I've infact receied 3 of these letters as Capital One has sold 3 credit card debts onto them. Your advise and help would be appreciated.
  8. Will any of this affect my mortgage which is with one of their offspring companies? Thank you so far for your help, I'm so glad I found this place.
  9. That suits me, if I can get them off my back I will. I'm assuming that if I get a postal order from the post office that I need to make it payable to "Halifax" ? And this should be for £10 to accompany my letter for copies for statements?
  10. I had a halifax joint account with my husband which we defaulted on and was overdrawn. We are paying the debt back in small amounts each month as we have other priority debts to consider. Am I able to start a claim for charges in the position I am in with the Halifax? Worried, scared but willing to give it a try.
  11. I'm behind with my council tax for years 2005/2006 and 2006/2007. The 2005/2006 is with Equita, and the recent year is still at this point with the council. I have been trying to make a payment proposal plan with Equita but they will only stop the Bailiffs if I make a full payment which obviously I can not afford. I have been receiving letters sometimes two sent on the same day from equita, and they just seem like garbage. Equita send a removal notice threatening to send a van around to collect goods then they sent me a Notice Prior to Committal to Prison then another 12 removal notices, then the heading changed to a removal order, then back to removal notice, then a formal notice, another formal notice and then recommending committal to prison. I'm sure there were a few more along the lines which I destroyed in dispair and mental state. They blatently refuse to accept any offer. Today I visited my council offices with some cash in hand as after I spoke to somebody over the phone at the Council Tax Offices I was advise that I could request for the Council to take the case back from the Bailiffs. They council today said this was not possible unless it was an error which of course it isn't as I do owe them the money. The council lady told me I would need to negotiate with the bailiff's only about that portion of the debt, however she could give me a form to fill in for consideration of time to pay on the council's portion of for the recent year's debt. I'm so confused, i'd heard of people being successful in getting the council to taking the debt back, but I don't seem lucky. Some of the notices from Equita state that they have identified goods but they have never even been into my home or left a card if they have made a visit. Could somebody please advise what to do next?
