  1. I have received a defence from the court and the allocation questionairre has to be returned by 1st April 2007...hope i'm not made to be an april fool. Here's what the defence says (exactly how its written - including the grammar)... 1. the claimant?s account is governed by the defendant?s personal and/or business banking terms and conditions. 2. Pursuant to the defendant?s terms and conditions the defendant is entitled to make a charge for its services as set out in the defendant?s price list, including an overdraft review fee for considering whether to provide and providing and overdraft. 3. The defendant denies that the charges applied to the claimant?s account amount to penalties at common law and/or unfair contract terms for the purposes of the Unfair Terms inConsumer Contracts Regulations 1999 (UTCCRs). 4. The charges applied to the Claimant?s account are reasonable and are properly and fully disclosed in the defendant?s terms and conditions and published price list. The charges representthe contractually agreed price for the services provided and the UTCCRs. Further, the charges are not default charges and, accordingly cannot amount to a penalty. 5. Save as set out above, each and every allegation made by the Claimant is denied. For the reasons set out above, it is denied that the Claimant is entitled to the relief claimed or any relief. What does this all mean and what should I do regarding the AQ????
  2. I received a phone call from DG today after i left them a message. They told me that they had received the spreadsheets I sent via recorded mail and that theywould write out to me in due course - whatever that means. I was also told by someone working in a bank today that as of April a new law will be introduced preventing people claiming back charges - how true is this?
  3. I have sent very courteous emails to DG explaining to them that i had hoped that this could be resolved without having to waste court time...no reply!!! When do they make offers (if they're going to?)
  4. Hi all, haven't posted for a while as nothing of any significance has happened...however...today at the last minute HSBC filed a defence. I have not received any offer from DG, i'm guessing this is all quite normal? I think i now need to write to the court with 2 copies of my spreadsheet, is this correct? Also how do i ask the court to transfer this to my nearest court here in Hull? Should I send DG anything? I appreciate that these questions have probably been answered several hundred times before but it seems that you don't digest it all until its you...!!

I placed two seperate claims against EGG and the have agreed to refund both without any argument...obviously they gave me the usual 'this is not an admission' & 'you did sign up to our terms and conditions'! 1. £372 - without prejudice 2. £190 - without prejudice Claim 1 has already been refunded (paid for my skiing in Scotland) & claim 2 to be refunded within next 7 days... Just hope HSBC are going to be nice too...I've had to issue via mcol as they seem to want to fight a little...hey ho!!!
  6. I am trying to prepare a letter to send to the court requesting that the case be transferred to my local court, what should it say? Also should i send them a list of charges now?
  7. Have now spoke with Rachel who seemed much more pleasant. She told me that she had recieved my breakdown of charges and that she couldn't tell me how long it will take to investigate further due to them being very busy...wonder why!!! Any answers to my above post??
  8. I have just phoned Deborah D'Aubney of DG to ensure that my list of charges have been received by her and to ask what was the progress of my case...what a rude woman! She seemed most annoyed that I had phoned and transferred me to another dept without answering my questions. Low and behold nobody answered the phone so i left a message on the voicemail for them to phone me back... What should I now send to the court and what should i write to request it be transferred to my local court??
  9. I recently signed up to an 18 month contract via THE LINK ONLINE MOBIOE PHONE COMPANY. I received my free gifts and was initially happy with my DOLPHIN 35 contract. I was told that the contract would be £35 per month and I questioned if this would be inclusive of VAT and was advised that £35 would be the the full payment (vat included) each month providing I did not go over my 500 txt & 500 talk mins per month. Low & behold I have just had my first bill and though I have not gone over my limits VAT has been added to my bill! I have contacted LINK customer services and recieved a generic response completely avoiding what i was asking. How can this happen & what can I do? I bought this product in good faith based on the information I was given and believe me I did question to the hilt the product I was buying so that this kind of incident could be avoided...or so i thought!!!

I have received an acknowledgement of service from the court and HSBC are defending all of the claim... this was signed by a Deborah D'Auney of DG Solicitors I have sent a copy of the breakdownof the charges I am claiming for to DG in anticipation that they are going to request these. What next???
  12. oooeeerrr, the claim has been issued and now HSBC have until 03/03/07 to respond....i get this awful feeling that i'm gonna be a test case and be blown out the water... :o
  13. Hi all, I'm after some advice on how I should proceed against CITI & what their tactics are?? I have just received my statements and the total I am owed including interest is £763.95. I have sent the lba back to them (recorded delivery) along with a breakdown of the charges and interest in spreadsheet format. I have stated in the letter that I would be happy to accept £650 as full settlement on a without prejudice basis. My debt with them has been sold to Metropolitan or Moorcroft Debt recovery (can't remember which off top of my head). Am i right in thinking they have to provide me with some form of agreemement or I could stop making payments? Can i apply to have the default removed? I am of the understanding that CITI are quite good at evading the main issue and are unlikely to use a whole range of tactics to avoid paying back the charges they unlawfully applied to my account. Any help and advice? Feel free to PM me if you think CITI could be monitoring and that I would benefit form the advice...
  14. I received an offer from HSBC of £3500 which i refused as I'm owed almost £5000. They have since written back refusing to take this further and state I should write to the financial ombudsman service as they will not take this matter further. I have therefore just put in a claim via the MCOL website and am now really nervous about whats gonna happen next and if i'll now be made an examplee of and lose out big time. Whats the likely next step and what should i be doing?:idea: :idea: :idea:
  15. Ok, They have now sent me a letter telling me they are looking in to my claim and will contact me in due course...this is most frustrating. How can they keep people dangling like this...??
  16. I initially sent the first letter about my current account and the bank told me that I would need to highlight all the charges. I have sent them now my completed spreadsheet and am awaiting their response. I gave them 14 days to reply. When should I be looking to file against the bank with the courts? Also my HSBC mastercard statements do not show the charges so how do I go about claiming these?? Also NATWEST received letter 1 requesting my statements on 28/11/06, which I sent recorded delivery and they have signed for the item. To date they have not responded can they get away with this??
