  1. Can someone help please. Last summer (July 2008) I was on holiday in London and had a fall, I tripped on uneven pavement on Whitehall. It resulted in me visiting hospital when I got back home. I contacted Westminster Council, they send me relevant form to fill in, they then sent this to their insurers Gallagher Bassett Int ltd. They sent me forms to fill in, which I duly filled in and returned together with a photo of my injury. I have been contacting them by email since, to ask to the state at which the investigation was. On the 12th November last year, I received a response to an email saying they were currently completing there investigations and would return to me shortly with a difinative answer regarding liability. On Monday I contacted Westminster Council again to complain as to the way and lack of information my claim was being dealt with. I also sent Gallagher Bassett another email asking what stage the claim was at. I had a reply from Westminster Council saying it had been sent to the complaints dept, and to allow 10 working days for a response. I also had one from Gallagher Bassett and reads as follows :- Dear XX XXXXXXX I can now confirm that we have completed our investigations into this matter. It seems that the defect you unfortunately tripped upon was a failed reinstatement by EDF Energy. When a company such as EDF performs a reinstatement they provide a 2 year guarantee period within which no defects should arise. Unfortunately, in this case the defect upon which you tripped has arisen as a direct result of EDF's negligence. As such, you will need to redirect your claim to them. Their contact details are as follows:- EDF Energy Barton Road Bury St Edmunds Suffolk IP32 7BG 08701 961070 Lastly, our apologies for the delay in this decision being reached. Yours sincerely, xxxx xxxxxxxx I would like to know what to do next? Should I have to contact EDF Energy? Westminster Council should do this shouldn't they. I would appreciate some help in wording letters emails etc on this matter or should I contact an accident claims company? Thanks
  2. Hi, I claimed £900+ bank charges from HSBC, they offered me £600, I accepted but they said that the money would be paid to Metropolitan who were dealing with a defaulted £2100 loan I had from HSBC. I then got a letter saying they had sold the debt to CL Finance, I told them that it was improper to sell a debt whilst there was a dispute on the account. I received another letter saying that they would put the debt back to Metropolitan. This was over 12 months ago and I am afraid I have sat back, as said debt is being paid back through CCCS, along with my other debts. I received a letter from CL Finance 2 weeks ago to notify my bank etc to stop direct debit payments as debt has now been discharged. I have sent 3 emails to HSBC customer services but had no response at all. Can someone tell me an address to write a registered letter to please, so I can find out what the hell is going on. Thanks
  3. As for living comfortably he has had to move back in with my 79 year old Dad who has been on his own for the last 13 years, so it is difficult all round.
  4. Thanks for all your imput and points and I can see it from both my Brothers and ex partners points of view. What he dosn't want is to keep her in the life she has been used to, ie look at this, thats cheap etc. Last summer it was lets get a dog, so they went out and paid £300 for a bloody dog that she mythered for now she cant keep it. She has kicked him out because she has been seeing someone behind his back. I helped him move his stuff out of the house last weekend (her request) and she greeted him with a bill for £99 for photos that she had done of there daughter that he knew nothing about. He told her he was not paying it. He has been far too soft over the 8 years he has been with her and its time he got his bal*s back. He dotes on his daughter and will not see her short of anything but at the moment its money money money from her.
  5. Hi Thanks for your answers, No 1, reading between the lines she has been claiming as a oneparent family since child was born (wrong and now possibly very messy, but he who has not sinned etc) No 2 There is more to a childs upkeep than clothes! which is what I am trying to instill in my Brother. He just wants to do best by his child as things could get really messy via childs Mother. He has 2 children from his earlier Marriage, those 2 children are now Adults and he used to pay £75 week for each of those children pre CSA, but went through the route of their Mother signing for money as proof and he doesnt want to go this route with this child, (hope you can understand this). Just thought that if he got her and himself to sign a letter stating that he pays £50 per week when in work and a token payment of £5 week when out of work then set up a direct debit to that effect, I just wanted the wording for said letter
  6. Hi, my Brothers partner deemed fit to tell him 4 days before Christmas to leave the home as she no longer had any feelings for him ( I think she is seeing someonelse) as you can imagine after 8 years together his head is up his a**e. They have a 3 year old daughter together and he has said he will give her £50 per week for his daughter and put £12 week aside should she want shoes, clothes etc. My Brother is self employed and mainly holidays Christmas, Easter etc he dosnt get paid. Can a letter be drafted offering her this payment and stating that when he has no work then he cant pay. I f so can any of you nice people draft one please so she and he can sign it, as all his trust in her has now gone and all she does now is peck his head for money. I have been on CSA site and for his earnings the above is what he should pay, however his g/f is claiming benefits and he doesnt want to go through CSA as they will take money off her. Hope you can help.
  7. Hi, can you give me the wording in the banking charter that says they are not allowed to sell this debt whilst in dispute, or a link to it please. Thanks for your advice
  8. The state of play now is that I accepted the offer of £605.00, signed the acceptance form and lo and behold they sent me another acceptance form but added on another account (credit card). I have sent them a letter today giving them 10 days to send the money or I am carrying on with the courts BUT I have just received todays post, a letter from HSBC saying the account has been sold to CL Finance on 28th September (1st I've heard), they can confirm the balance sold to CL F inance was based on outstanding balance as at 8th August. I have a debt management plan with CCCS and wanted the £605.00 to go to them to share out equally amongst my creditors but HSBC insited it went straight to Metropolitan which I eventually agreed to BUT WHAT NOW!!! Can they do this to me, they know damn well I have no money and am struggling, even stamps at the moment are a somewhat struggle to fund. What do I do now? I think they are taking the p**s
  9. I had received an offer of £605, the original offer was for nearly £900 from HSBC for charges added to my bank account, it will not be paid to me but paid to their debt collection for an outstanding amount owed on a loan I had with them, on the advice of this forum I signed the acceptance letter. I have now received another letter from them, with an acceptance letter for me to sign but they have added to it 2 more accounts, a credit card and the loan. My question is I have only claimed charges on my bank account, I havent got as far as claiming charges on the credit card and the loan ( that HSBC offered me to clear the debt on my credit card) so do I delete these 2 accounts from my acceptance letter or what? Advice please. Please bare in mind I am on benefits, have a DMP and am sick to death of playing tennis with HSBC with registered letters at my expense. Thanks
  10. Yes I know it was for my SAR, but my point was if HSBC will only pay the money they owe me direct to Metropoliton then why did they not pay this postal order also to reduce my debt?
  11. Heres one for you all, if the HSBC want to pay the money they owe me direct to their debt collectors, then why have they sent me the £10 postal order, made payable and crossed to HSBC Bank, back? Why haven't they took that off the debt? I have a postal order sat here thats useless and £10 I can ill afford to loose. Any thoughts anyone
  12. Oh well, I will give another letter a go, it seems to me if the banks owe you thousands and you have the means to fight them financialy all the way then they pay up but for us poor people on benefits and rely solely on benefit, even sending a letter registered post is a purchase that something else has to be sacrificed, we struggle to get any payment other than as directed by them. Not fair!!!!
  13. ALSO Thanks Cookiemonsterblue lol
