  1. and today recieve a letter from barclays themselves stating that as i have not responded to their debt collectors the account has been passed back to them to deal with and giving me 7days to pay. they should get my letter today or tomorrow
  2. eek! thanks for that. i have sent the above letter to cds and also copied it to egg for their information. i dont want to go to court though!!
  3. doing so as we speak, i didnt think to send a copy to barclays as no longer recieve any correspondence from them but will do so just in case the two departments fail to communicate, which i guess is likely!
  4. have received a further letter from collect direct uk, headed NOTICE OF LEGAL PROCEEDINGS (eek - is this serious or just a scare tactic) it says i have 5 days to pay or they will issue county court proceedings. i have sent this in response: WITHOUT PREJUDICE I write concerning the balance outstanding on the above account and would like to re-iterate my offer made on 18th November 2008 to EGG. My grandmother , as I previously stated, has offered me the sum of £190.25 to assist with this debt. However I require that you confirm in writing that this sum will be accepted in full and final settlement of this account. This offer is made on the understanding that if accepted neither you nor any company associated with you will take any further action to enforce or pursue this debt in any way whatsoever and that I will be released from any liability. I require confirmation that the outstanding balance will not be pursued by any other company now or in the future. Please can you also confirm in writing that if any offer is accepted you will mark any entry on any credit reference agency regarding this account as ‘satisfied in full’. Payment can be made within fourteen days of receiving your written agreement to this offer. I would like to add that if we cannot reach agreement on this, and given the length of time I have been negotiating with you, I will have no choice but to distribute the funds amongst my other creditors. I am also enclosing a letter to your company regarding harassment and requesting that all correspondence in future is conducted in writing only. I look forward to hearing from you
  5. following another letter from CDCS on behalf of barclays threatening me with DCA again i have sent the following letter, along with a phone harassment letter/: WITHOUT PREJUDICE I understand that my account with Barclays has been passed to your company to deal with. Please can you confirm that Barclays will mark my credit reference file as ‘satisfied in full’ in respect of the above account and remove the defaults which are currently on it also I require that you confirm in writing that this sum will be accepted in full and final settlement of this account.   6. have recieved a further letter from mbna stating that they will send DC's/CCJ etc so have sent this in response, also sent a letter regarding phone harrasement and that no home visits are allowed . thought i might as well send a CCA request, bombard them with letters as they are doing it to me WITHOUT PREJUDICE Thank you for your letter dated 5th February 2008 regarding the above account and the following offer that you made in it: ‘Call and discuss the possibility of settling your account with a payment of £333.64.   7. my account with them was in a debt management plan with cccs, till i lost my job then i mande the settlement offers.

A chronology of my dealings with Egg Credit Card so far and any help appreciated on how to deal with all this! 7/10/08 - I wrote offering £190 in full and final settlement of a balance of £344, and asked that if accepted no other agency pursue me for the balanc and my credit file be marked as satisfied in full. 18/11/08 - i recieved no response to above so i resent it again. 11/12/08 - they wrote asking that i ring them to discuss ( i never) 5 Feb 09 - Letter from Collect Direct Ltd headed 'personal representative' stating that they are now instructing a personal rep to make attendance at my address and to avoid this happening i must phone them. Does anyone have any experience of making full and final offers to Egg?

Ok, this is the chronology of my dealings with barclays so far, if anyone has any advice on how to take this forward please post! 7/10/08 - i wrote to them offering £69 on a balance of £126 as full and final settlement 29/10/08 - CDCS Ltd wrote back saying they are prepared, without prejudice, to accept £69 in full and final settlement of the debt' with details of how to pay. 18/11/08 - i wrote back requesting that they confirm this offer will be accepted in full and final settlement, that they or nobody else would pursue me for the remainder and that my credit file is marked as satisfied in full. 3 Feb 09 - CDCS Ltd sent me a 24 hour notice letter saying if i do not make a payment they intend to commence a personal visit to my home and a CCJ against me. is this a DCA? i hesitate to ask a silly question but would it be okay to send the cheque without them confirming in writing that i wont be pursued for the remainder and my credit file is marked as satisfied, as i have been waiting for them to confirm this since 18th nov and if they had i would have already sent the cheque! i certainly dont want a CCJ or anybody coming to my house!
  10. Hi all Thought i would start my mbna thread to encourage myself to keep on top of it and to hopefully get a bit of advice on how to deal with these lunatics. Chronology so far goes ( will detail the important letters or this will be long to read!) 7/10/08 - balance £953: I wrote offering £525 in full and final settlement, and asking that i am not pursued by them or anyone else for the balance and that my credit file is marked as satisfied in full. 30/10/08 - they sent me an application for partial settlement form. saying the money would only be accepted as partial settlement but they would not pursue me for the balnce. it would also be registered with credit agencies as partial settlement. 7/10/08 - sent me a letter saying i must make a payment to prevent a Default being registered against me. 18/11/08 - i re-sent my original full and final settlement offer letter 26/11/08 - another arrears letter headed 'notice of sum in arrears'. 12/01/09 - Warning letter recieved stating they may either issue legal proceedings against me , or register a default or collection agents may visit my home. 23/1/09 - another letter saying they may issue a default. 5 feb 09 - another letter advising me of the following options: 1. pay £61 and set up a payment plan. 2. pay £9 per month 3. they will accept a partial settlement of £333. 4. wait for a collection agent to visit my home. options 1.2.3 are available till 20th feb, then a default will be registered and debt sold to a DCA. I have the £333 to pay them, but am very wary of this 'partial settlement' thing, having read that some people say its fine and other say dont do it as a DCA will chase you for the balance. i also do not want another default on my file! any advice? i really want to pay and get rid of them as the mountains of letters and the phone calls 3 times a day are stressing me out!
  11. thanks toto, i did think that full nd final settlement is the only way forward, i think i might send them anoter letter requestig this and at the same time request the CCA. reading from the other threads i may also do something about the phone harassment as my son is getting quite stressed out about it!
  12. hi need some advice on taking my dealings with mbna forward. for the past few months i have been trying to make a full and final settlement, have sent 3 letters now asking them to confirm it will be full and final and my credit file marked as settled etc. they just keep writing back saying they accept my offer in partial settlement but that nobody wil chase me for the remainder, along with various other letters threatening debt collectors, court etc. today they have phoned me every hour and sometimes every half hour, i never pick it up but am getting increasingly nervous about it all especially after reading some of the posts about the importance of pushing for them to put the 'full and final' and not partial in writing, how can i move this forward? how long should i expect it to take? thanks
  13. i also made an offer to MBNA recently, they wrote backaccepting it as 'short settlement' but said they would not pursue the balance. i wrote back stating my offer is in full and final settlement only, and that i wanted my credit file marked as satisfied, and that all other creditors have accepted it as full and final. they rang me and said full and final is illegal or some rubbish like that and have been ringing me twice a day, i ignore them. am still waiting for them to confirm FULL AND FINAL in letter - they are the only ones who are being difficult!
  14. oh gosh it looks so complicated. He sat a test last week at the college open day and is waiting to hear if he has been accepted - he has had to identify his own employer and is also waiting to hear from him to confirm. i am claiming WFTC and CTC but get zero as i got caught up in all that 2004-05 tax credit overpayment fiasco and my appeals were turned down so any credit i qualify for goes straight back towards the overpayment
  15. oh thats a relief to know for when i do get a new job feels like everything is up in the air right now ... might ring gingerbread or CAB in the morning. scrub that have never in my life managed to get through to my local CAB on the phone lol ..might have to queue up instead one morning
