  1. update Received letter usual bog standard stuff, they don't agree with anything but they are going to pay me what i'm asking. this will pay off what i owe and leave me with £168. cheque to be sent within 14 working days. i won won won:D :D . many thanks to every single member, mod and site helper. by the way i had my woolwich claim settled on friday so its all good.(just waiting for the funds to be credited to my account). Must be my lucky week!!!
  2. I am waiting till i received money as i have read somewhere that they have not paid after the claim was cancelled:eek:
  3. Excellent news hughes. :D well done. :D just out of interest was it kate ashton who sorted it out? my advise on the second claim would be to start with the prelim then lba then file court claim but you may only have to submit a court claim. (not very helpful...sorry) however i'm no expert. i'm sure someone will be along to clarify things.
  4. Perfect as usual:) Thanks
  5. If I were you I would email the woman above with your name and case number and maybe when your court date is, attach a copy of your schedule. Just add a cover note asking if they would like to settle. it seems from the many many posts I have read she replys to emails more so than the phone!!!!! and your first line should have been GOOD ON YA WOMAN! I'm pretty sure you wont hear anything till after the bank holiday but you never know they maybe doing some overtime tomorrow:D
  6. sorry thought i'd better give you her contact details!!! tel 02071164664 fax 01452638430 email katherine.ashton@barclays.com when i spoke to her yeaterday she saw i had a court date and asked me to email a copy of my schedule. then she made me an offer today via email which wasn't the right amount so i email all my details again ie amount in charges amount in interest and court fees about 2 mins later she emailed me an offer of the full amount with a form to sign and email back. hope this helps
  7. Many thanks MB. still full of questions;) is there a template letter to sent court or shall i just make something up along the lines of bank have settled sorry for wasting your time etc etc. also should i send one to the bank as well or just let them know i have discontinued court action. i wont be doing anything until i have the money as i have heard some bad stories:mad: will complete survey and a donation is certainly on its way very soon. what details do i need to send a mod? sorry for still being dumb;)
  8. hi hughes, i phone them yesterday and received offer today of the full amount. i spoke to kate ashton she is very good. good luck
  9. update from yesterday:D :D ..........................had an email from kate this morning offering me about £400 less of my claim. i emailed her back saying her figures seem wrong compared to mine and attached another copy of schedule. about 2 minutes later received revised letter with the full amount!!!!!!!!!! signed and email back the offer crossed out confidentiality part. so i will wait for funds to clear in my account before i start posting that i've won. :D i'm still shocked that she was so quick as my court date isn't until 20th july. massive thanks to all who have helped me specially BIGAL and MB.
  10. HI CASSIE I phoned barclays yesterday on 02071164664. (this was the telephone number on the defence they filed) i spoke to Katherine Ashton and she was very helpful. she asked for my name saw that there was a court date and said are you wanting to settle? i said yes. she asked me to email a copy of schedule she aims to look at it next week. my court date is in july. my advise would be to phone them and ask if they want to settle. as i said they are pretty helpful and it seems as soon as you have a court date they will put the wheels in motion to sort your claim out. good luck
  11. update i phoned barclays litigation dept to see if they were ready to settle and got an anwser machine so down went the phone (i hate speaking on those things!!!) about an hour later i finally plucked up the courage to phone again with a note of what message i was going to leave and a katherine ashton anwsers the phone. so i gave her my name and she says i see you have a court date. would you be able to email a schedule of your charges....yes i say. she says she wont be able to do anything this week as she has lots of settlements to sort out but aims to get back to me sometime next week. she said she will email with an update of my claim. so looking good. (i hope)
  12. hi i received an offer about a week after i started court action. so don't feel left out!

  15. hello one and all i'm in the process of taking woolwich to court and was chatting to a work friend. i have told her all about this website and i said i would sort out the DPA for her to send off to barclays as she doesn't have internet at the moment. just one question she has a joint account so should they both be signing all the letters or could one of them complete the claim? jster
  16. Hi fruitbat i see this thread is very old. but i was hoping you would be able to tell me how these were to deal with? and if you won against them? thanks
  17. update I received acknowledgment of service today. they intend to defend all the claim and its signed by wendy starr. so now i wait for defence.
  18. I am thinking of sending the following letter to barclays. Legal and Compliance Level 29 One Churchill Place London E14 5HP Re: Jster - v – Barclays Bank t/a The Woolwich account no, xxxxxxxx claim no 7QZ25540 and filing date 28/02/07 With regards to my claim against Barclays Bank t/a The Woolwich you should be aware that we now have a court date for the 20th July 2007. I am mindful of the vast number of claims with which you are currently dealing with. Should you wish to review your position with regard to the charges made on my account then I would be more than happy to enter into further discussion with you in the hope that you might avoid wasting anymore of the court’s valuable time. I can be contacted on xxxxxxxx or xxxxxxxxxx or you can email me xxxx@xxxx Yours sincerely does this sound ok? I'm sure they wont respond but thought it would go for me as it shows i'm still trying to sort it out before going to court!!!! i will still phone them nearer the court date. any advice welcome
  19. if its the £3 per day then yes
  20. brilliant news poppy. well done now go for wasted time costs:D :D
  21. update i filed mcol on 04/05/07 they have acknowledged today. (well well they are on the ball!!!) they have until the 06/06/07 to do what ever they are going to do;) . if they do pay out it will clear my debt and give me a few quid. my debt was passed to debitas however i never said anything to them about my claim and just carried on with the monthly payments. i have just sent everything to capital one regarding my claim and i have received nothing from debitas. i thought i would start receiving letters and phone call from the horrid debitas demanding full payment but much to my relief i have heard nothing..........thankfully. the point of that was IMO the DCA doesn't need to know as they weren't the ones who charged you. just take everything to the original company that charged you. I hope this makes sense:) :)
  22. Hi I had to wait for a court date. mine is in july. i have been advised that they wont do anything until a couple of weeks before then. hope this helps
  23. Thanks AL. you've been a star:cool: . I'm going to draft a letter will post it here when i'm done, if you wouldn't mind having a scan through it and let me know your thoughts:D Jster
  24. Has anyone seen any good letters that i could send to barclays. now i have a preliminary court date i wanted to let them know and ask if they would like to settle now. I know there is very little chance they will settle but still nothing ventured and all that:) . also when they do come to settle i have more charges which i incurred after filing MCOL so i never added to schedule as it would have meant waiting even longer is there any good para phrasing i could use so i wouldn't have to do a 2nd claim. although i would defo do 2nd claim if i had to. has anyone had any extra charges given back at settlement time? would be interested to find out. Jster
