  1. Hi Nicole, Just wishing you luck. I haven't heard anything as yet i.e. a response from the claimant to my defence. They have until the 16th Feb (28 days is up) or the claim is stayed.
  2. Hi all, I've had a reply from the court that acknowledges my defence, got that Fri 19th. It also says that the claimant has 28 days to reply or the claim is stayed. Anybody tell me if this is normal? Why no AQ? I'm presuming that the courts require to see the signed agreement/deed of assignment????
  3. How are you doing? Have you heard anything from the courts yet? I sent my defence the same Monday you did, and I got a reply from the court on Friday (19th Jan) that the claimant has 28 days to respond to the defence or the claim is stayed. The claimants 14 days are up for the CCA, that was about the 19th January.
  4. As I had my defence ready, decided to file it today. Although I have asked the court, that should the claimant prove to be the true owner of the debt that they give me time to file my defence. I did read Sherlock's thread, amazingly retracted their claim because of that letter and the advice received on this forum. Where would many people be if it wasn't for the advice available here!!! I, as many others would be, paying for debts that may not have been their own or are frighteningly exorbatant having unlawful charges added. I haven't received any documentation as yet, although if they extended my time limit because of the holidays, it is likely that the CCA time limit is extended too. We'll see how our two cases unfold.
  5. Thankyou for your replies. I had a look at your defence, and learned a few things. Clearing up that a CCA request is law for one. My worry was that once I made my defence with only a CCA request as defence that CL Finance would come up with the original agreement, even though I do not know where this debt has originated from, but from reading your thread I feel better about it now.. I didn't send a copy of the CCA to the court at the same time I sent one to Howard Cohens, that was a wise thing to do. The £1 cheque was cashed on the 5/01, so I am wondering if they have got the agreement. I categorically stated that the £1 should not be used for any payment towards the alleged debt. Will keep you posted, and I am going to ring the court re: when defence is actually due. Once again thankyou for your replies. Good Luck with your defence also.
  6. Just writing my defence. These forums are addictive, but I think I have learnt enough to be able to defend, or at least I hope so!!!!!. Any advice and answer to original questions appeciated.
  7. Hello, This is my first post. I was worried about a CCJ claim, and now I feel a lot better knowing there are people on here that are so knowledgeable. Cut the story short Received a CCJ from CL Finance via Howard Cohen on 19th December. I don't know what it's for, or who CL Finance are. After reading this forum, acknowledged the claim and got an extra 14 days to prepare my defence. Q. Because of the Christmas Holidays when will the 28 days be up. Is it working days, or just 28 days from the 19th Dec. I don't want to get caught out, so I was going to enter my defence on the 16th Jan before 4.00pm. Sent a CCA request with £1 to Howard Cohen on 28th December. Q. Can someone confirm when this will be in default? Working it out it will be the 17th Jan, which will be the day after I enter my defence. Also, is there a format in which I should write my defence, based on the fact that I have requested the original agreement and deed of assignment and I am defending the whole claim?
