  1. OK where I live we have limited parking free public parking, but it is just about enough for all of us (south Warrington area) now all of a sudden 3 to 4 vans (transits and pick-ups) all from the exact same company have started parking over night in the spaces. meaning some of us have been forced to park in the next street, and getting the evil eye from the people who's houses we have been forced to park in front of. the companies address is in Runcorn I find it highly unlikely that 4 people from the same company have all just moved into our street complete with their works vans in the same week. suggestions?
  2. Hi all, Need help, I lived in a flat owned by Derwent Living who employed VCS parking to patrol the residential parking. I had recieved numerous parking tickets in the past whilst driving my mums car (often lose the permit), but ignored the tickets as I wasn't tresspassing and was parked in may own parking bay. Later on someone started parking in my space so I parked in an unofficial communial parking area well out the way of everyone else and causing no nusance. Then VCS came along and slapped a a wheel clamp on the car and then asked for £1600 wanting money for previous tickets, didn't have the money so searched the flat and put in parking permit hoping that this would prove I was resident. The buggers towed it anyway complete with parking permit on full display then asked for £1860. Derwent Living's stance on the matter is its beween me and VCS parking. The only thing stated in the contract between me and Derwent was: Residents must show their parking permit at all times or be liable for any penalties or costs incured. Thats it. Managed to raise the money through family to get the car back. Would like to claim the money back but have been unable to get a solicitor (no one has replied to my emails). If I am going to represent myself in court what is my best legal argument. Probably best to keep it simple. I would prefair to go after VCS parking as l moved out a month later and never gave any notice, Derwent may also put in a counter claim for (made up) dilapidations, I dont trust them. This all happend late October last year if this makes a difference. Had to move house get new job etc so had my head up my arse whilst I sorted things out. Does anybody know which address I should write to for VCS parking to make the claim. What happens if I win, how do I then get the money back? Oh and I lost my contract with Derwent so do I need to obtain a copy. Does Derwent have any legal obligation to send proof of me being resident? I get the impression they want to stay well out of this. All in all one fine mess. Plz Help Thanks DB
  3. Hi All, I was hoping someone could give me some advice please. I have got a chequered credit history due to illness 5 years ago - including 2 defaults (2007 & 2009). Over the past 3-4 years I have no missed payments and 12 months ago managed to get a vanquis card and a capital one card to try and re-build my rating. Anyway to my question..... when I apply for finance - I put my address in and then it asks for residential status. I privately rent the house I live in with my wife however I do own another house (with mortgage - which my ex-wife lives in and I can't come off the mortgage.) As I don't own the house I live in I select 'private rent' - is this correct? Thanks for your help! Cheers Steve
  4. Can anyone advise please? Have a normal mortgage, no problems, left a few years ago due to a previous partner and I was scared so I rented the property out privately, thinking I would go back eventually and it would only be a temporary situation, I should have changed the mortgage over at the time to landlords mortgage but I know this sounds daft but the time just went on and now I believe I never will return there to live, but my problem is although I do want to change the mortgage, will the mortgage company want all the back payments of the 1% extra interest which would have been the extra I would have been charged? I feel in a no win situation and even though I want to do it right I'm worried what the mortgage company will do if I tell them. Any constructive advice would be appreciated.
  5. I wonder if anyone could answer the following question. We have found a property we wish to rent via an agency we have paid their administration fee and credit check fee of £285.00. Initially we did not want to start the tenancy until the end of August this was rejected and we agreed to start from 6th July 2012, however since then we have found the agency very slow in their communication and doing their searches. On the 10th July they stated they had now received all the information they required and would send the tenancy agreement to us once the 1st months rent and deposit was paid into there account £1487.50. This was done today 11th July we hope to receive the Tenancy Agreement to sign, the agents have stated that the 6th July is still our tenancy start date which we feel is unfair. It was not our fault the delays occurred and we therefore should not have to start our tenancy before we have the right to move in. We argued this and they came back and agreed a new tenancy start date of Monday 9th July, we are still unhappy with this but do not want to loose the flat because of it, I have said that we will proceed but reserve the right to take this matter up with them at a later date. Are the agents acting within the Law, it does not seem right to ask for rent when the property is not available for use. Steve
  6. Regrettably both in-laws ended up in a residential home together and Father-in-law died last year. In his will, he left half his estate to his daughter, my wife. The other half is still being used to fund Mother-in-law. However, today we received a letter from the local council who are part funding her care that says the following : "When opening a joint bank account an agreement will be signed with the bank which will address the terms of the account and the rule of survivorship. In order to determine if the capital moved from Mrs xxx joint account with her late husband can be disregarded, we require evidence of the terms of agreement with the bank." Surely a will overides any prior agreement? What exactly are they getting at here? Can anyone shed any light on this please. Thanks in advance Bugsley
  7. Hi all, I was wondering if anyone has any advice. Basically I live in an area where its residential parking 24/7 365 days a year. Normally the council send me reminder a month or so before it expires and I cough up £50 and get to park anywhere within 1/4 a mile of my house (but never in front ). On Friday morning I went to get in my car and found I'd been given a PCN for being "parked in a residents or shared use parking place or zone displaying an invalid permit, an invalid voucher or an invalid pay and display ticket". I double checked my permit and it had run out at the end of Feb and I hadn’t realised, to be honest I can’t believe I've not been given a ticket in the last 17 days as the wardens are around every day. So I've now got a £50 (reduced to £25 if paid in 14 days) fine. Now here comes the interesting bit, I'm actually moving out at the end of March, to a house with a drive way . So I can either:- pay £25 for the fine and park in a free bay for 2 weeks, pay £50 for a permit, appeal and hope they left me off and then claim back £46 for the unused 11 months, or is there an alternative? Is it worth appealing on compassionate grounds stating I'd not received the reminder (which I haven’t yet?) I look forward to your replies. Thanks ale
  8. Hi - I bought a flat - one in a block of around forty fairly average ones - in Leeds. I and many other residents feel that our Property Management agency are ripping us off on a number of counts and we are researching this matter. Whilst researching we found that we are paying six and a half grand a year for Management Fees (to people who really aren't doing anything) and 4 grand a year as a Head Landlord Service Charge. Considering both amounts are going to the same company we feel a little resentful. Can anyone shed light on why two payments are necessary and if they seem reasonable? Thanks!
