  1. Hi Good People, I've been a lurker for some time, but thought I would ask for assistance if you would be so kind. A few years ago I signed a personal guarantee to the sum of £30K for an overdraft with the RBS. Last year through the difficult economic times, sadly we had a winding up petition served & the company was placed into liquidation. The Ltd. Co. at that time had a positive balance, but because the bank didn't act quickly after the petition was published in the Gazette, many standing orders, & direct debits, wages etc came out of the account. After this, despite me phoning them & informing them that a petiton had been served (& by this time granted) it still took at least 3 weeks before they froze the account, by which time the account was left minus £20K, which the RBS Solicitors are now looking to recover via the PG. I have wrote to them explaining the above & await their reply. Some other info, I was the largest creditor (c £150K, followed by HMRC c £50K) I look forward to the replies. Many thanks MGA
  2. Is it possible to bring a personal injury claim in a whistleblowing case? My health has deteriorated due to the treatment i received following whistleblowing and the subsequent stresses of my ongoing case. Would claim be through the courts and would it be a lengthy process following ET case? Many thanks!
  3. I have secured loan with EPF and i have just lost my job. There are only about 5 more payments to make, but it is going to be a struggle to pay them.I know that i will have to talk to them about it. My problem is what would be the best way to approach it?
  4. Hi All, looking to a bit of advise. My Limited company is now insolvent. I am being per sued personally from a couple of trade creditors. THEY SAY I SIGNED A PERSONAL GUARANTEE WHEN I OPENED A TRADING ACOUNT. I was the managing director and signed the account forms in that capacity. They are pursuing me personally. What do i do and are they right to pursue me ?
  5. Hello all. Been a while. Had the letter from Apex to say they have "purchased (my) account with all rights ...". Included in the envelope was a bw letter supposed to be from Egg saying it was "notice of the assignment of the debt due to us ..." First thing should I start this thread here as I live in Scotland - or start one on another of the more general debt or DCA forums? Other thing is just to start by saying I'd an Egg Loan and an Egg credit card. CCAs sent for both well over a year ago. Got nothing for ages then two copies of a muliple page computer printout relating to the loan. There's a signature but everying is on separate pages. It also arrived well after the deadline. I have pointed out that the accounts are IN DISPUTE in all communication since. I have been making small monthly voluntary payments via standing order (in the interests of goodwill). Settled with all other creditors apart from Egg and one other for amounts between 40% and 70%. That money is now all gone - I warned Egg that would be the case. My goodwill is now gone with this Apex nonsense. (1) Thread in the Scotland forum or...? (2) Account passed to Apex (so they claim) but was IN DISPUTE. Should I aim to get it back to Egg but pointing out it can't be sold while IN DISPUTE - or get Egg to confirm that's what they've done then stop all apayments (both Egg accounts card and loan) and CCA Apex and see what happens? Many thanks in advice for any help/advice. This place is great, really great.
  6. Hi, I currently have a Barclays Personal Reserve which is costing me £22 every 5 days in charges. I can't afford to pay it off to get back in the black for another couple of weeks, but according to Barclays website, one can cancel it at any time. Does anyone know if I call and cancel it, will I still be charged £22 a week because I'm over the limit? or will cancelling it stop me from being charged any more? (I appreciate I will have to pay it back eventually, and will presumably be charged interest on the overlimit amount, but I'm trying to minimise the cost until I can afford to do so) Thanks Andy
  7. I had a fall in a supermarket around 2 weeks ago, this was due to slipping on a gel filled absorbent strip used to absorb spills. The strip are used to absorb small spills but this had been used to direct water out of the store following a burst pipe. The strip was across the doorway of the store and was being used to direct water out of the store in to the street. When I slipped the arm I was carrying shopping in felt jarred, but because of my embarrassment I went home. I then called the store to complain when I got home. I went to the doctors who told me I could have damaged my rotary cuff and to give it gentle exercise and to see a chiropractor if it continued. I followed this advice and as it had not cleared up I have been to see the chiropractor today. I have just returned from a chiropractor who has advised me that I have jarred my rib and require approx 4 session on it to put it right. This will cost me with today's appointment £150 in total, which through no fault of my own I will be out of pocket for. What should I do to recover this money from the supermarket?

Hi, I'd really appreciate some guidance on the following: I've requested an SAR from Lloyds TSB a couple of weeks ago and yesterday, I received a letter from LTSB requesting a signature and completion of a Data Subject Access Request Form (4 pages of pointless questions as far as I can see). Tackling the form first, can I politely tell them to stick their form as I have already given them ample information in my original SAR letter with the £10 postal order and remind them that the clock is still ticking? Regarding the signature, I can go one of three ways: Continue as before, with a printed name only and enclose the template signature letter. Use the CAG Anti-Tamper signature. Get a mate to sign my name for me. Any advice on the above would be much appreciated. Ta, Krysp
  9. Just had a letter from Lloyds regarding my loan. Now bear in mind I have been in touch regarding this and they refused token payment/syop interest and charges etc. Anyway this letter arrived this morning By the way the account no. on the letter is my current account. Now a couple of questions that someone may be able to answer. As there is no Direct Debit set up (I cancelled it) for my loan on this account why are they adding charges to it ? I downgraded the account and cancelled all overdraught facilities on yhe account, so will they just take it into the red ? Finally, as I don't use this account for anything at all should I close it, or will they refuse due to me having a loan outstanding ? Any other advice welcomed. Pete.
