  1. Hi all, I've been off work due to illness for a year now and have finally admitted to myself that I won't ever be going back. I've therefore about to write to my employers with my resignation. Before I do though, I just want to make sure I know what I'm entitled to and that I don't get ripped off in any way. I've googled and googled but haven't been able to find definitive answers to the questions below. I'm hoping someone on here has been in a similar situation and can provide some info. I gather that any holiday pay I've accrued is still owing to me, but what happens where there is a 'use it or lose' clause in your employment contract? I had 3 weeks holiday pay owing to me in January this year, but any holiday owing has, by contract, to be taken by the end of January or be lost. However, as I'm ill I wasn't in a position to take all my holiday. Have I lost that 3 weeks pay or am I still entitled to it? (I have asked my employers, but they've been vague in their replies... ) My SSP stopped in March and I've been on ESA ever since. If I resign will I still be owed month's wages in lieu of notice or will I get nothing at all as I'm not currently receiving any pay from my employers? Is it correct that neither holiday pay or money paid in lieu of notice will affect my ESA? Hoping someone can help...
  2. Hi there I am just looking for some advice about work and what I should do. I have been in this job for just under a year. To start with I had problems with my pay, as the woman that does the pay didn't put me on emergancy tax for 2 months and therefore I did not get paid at all. Anyway, it seems that the company I am working for is in a bit of money trouble and for the last few months we either haven't been paid on time, only half has gone in on the day it said it would be and rest followed, or some people have been paid, others haven't(on time). Recently my boss has decided to go travelling for 8 months and the day he left work (1 1/2 weeks ago) was the day that magically, a contract appeared. As of today I have signed it but I haven't handed it in. There are 5 people that work in the company I work for and we have all been given jobs to do whilst the boss is away and this is where the problems have started from. I haven't been well and have been under the doctors. I was on incredibly strong painkillers and antibiotics and was advised by the doctor not too come into work. There were 2 days were I didn't go into work at all and I managed to work from home. The other days I went in (even though I was not meant too). When I phoned in to tell them that I wasn't going to be in, the woman who is "in charge" at the moment sighed and said "Well I suppose you have to do what you have to do". This is the same woman that would not pay me to start with as she didn't want/couldn't be bothered to put me on emergancy tax. On Thursday, one of the guys that I work with came in with the worst hangover I have ever seen, head on the desk all day, asleep on his lunch etc. On the friday he phones in to tell us he had been out again the previous night and had another hangover and wasn't going to be in. Nothing was said. This wound me up so much. The same woman then called me into the office for a "meeting" and basically took all my work away from me to give to another guy, even though my Boss had given it too me to do. This means I have been left with basically very little to do. It will last me, at most, a month and then there is nothing else for me to do other than twiddle my thumbs. Friday that has just gone (14th September) became a joke. Basically some of the work that I had spent a long time doing hadn't gone on a website properly, because the people that do the website had changed it. As soon as the other woman in my office found out she wouldn't listen too a word I was saying and wouldn't look at what I had done (even though the work is all there). I am now not allowed to have any contact with the people that have done the website, and yet again, another thing has been taken off of me. This means that I now have even less work to do. The two women in my office have now started to be quite bitchy and nasty about me behind my back. I have over heard them whilst they didn't think I was there. On friday I managed to do 3 peoples work and no thank you or anything was given to me other than bitching and moaning about the other stuff. I even stayed late and waited for the courier to turn up as he was late. At this point all the parcels were outside the office and the doors were locked. If he hadn't have turned up, I would have been screwed! As you can now imgaine I am looking for a new job asap. My plan is too hopefully hand my notice in within a months time so I can be as far away from that place as possible. I want a job that I am not made to feel as small as an ant. I want to work somewhere, where I am not up half the night worrying about it and most importantly I too know I a have bit more job secuirty than I do now. The questions that I have to ask is, even though my boss is away for 8 months, am I still able to hand my notice in? Nothing has been said about me staying for the next 8 months but recently things have got so bad I do not want to be there anymore. Am I in a bad postition if I do leave? Does it look bad on me even though essentially, I am being made to leave by the people I work with? Any help on this would be brilliant. My health is really suffering because of it now and I can only be pushed so far before I crack!   3. I've posted this elsewhere but I know some people who work for the job & benefits department post on here so am after some advice. I was made redundant in January and after a few months umemployed I found a suitable job through an agency and applied, I got called for an interview by the company the same day, I got told the original job advertised had gone (Since come to learn it never existed) and that another vacancy was available, minimum wage rather than £8.50, 43hrs PW rather than 39 and doing a job I'd never done before and wouldn't off applied for had I know all this, but I got offered the job on the spot and had to accept or I'd get a sanction. The day I started I got the contract to sign and also found it had an overtime clause that it had to be done when required and it has worked out 4-6 hrs per week, again I couldn't decline the job or I'd of got a sanction so the 39 hrs per week advertised has turned into 48hrs on average. But the problems don't end there. I am being bullied on a daily basis by a supervisor, My supervisor finds fault with everything I do and makes smart remarks daily trying to get a response, I asked him a few weeks ago what his problem was, He squared up to me like he was going to fight, I backed down and he walked away and called me a "F**king B**tard" I was in shock to be honest as I've never been spoken to like that. But the smart remarks continue daily. I recently got marched into the office and got a verbal warning for leaving my machine on at lunch time, It was the first time I ever did it so someone has obviously reported me for doing it, the boss said "Do it again and you wont be here" in an aggressive tone. I am just totally fed up with this, I am at the stage now where each and every morning I have diarrhoea with the thought of going in there, and each and every day brings its own drama, I can't get over to sleep at night, I wake at the crack of dawn, at nights and weekends it is all I can think about, Since I started working in there 3 months ago I have lost a stone and a half, I can't stick this much more but don't know what to do or where to turn. I decided enough was enough and went to my doctor with the intention of getting signed of sick for a couple of weeks, My doctor diagnosed anxiety and depression but said the root cause of this was work, so meds or time off would not work, the only cure was to confront HR. So I did, I went into the HR department and explained all, the guy was very sympathetic and said he would run all past the boss and get back to me with an outcome. The following day he got back to me and I got told how valuable a worker this supervisor is, how experienced he is, how long he has been there, and working in a factory environment is stressful etc etc, So basically told to get over myself and damn all was done about it. So you can see why I don't want to do over time and to be honest I don't want to be there at all, it is effecting my health and I want out. I have a wife and 3 kids to support, I have been looking for another job since I started but as yet I haven't even got an interview so getting another job isn't a way out, I want to leave, but would I get a sanction on these circumstances? Its not even about the bullying, its the work in general, the environment, I hate it all and had it been advertised the though of applying would never of crossed my mind. What do I do?
  4. Hi, I wonder if someone could possibly help me with a couple of queries I have. Hi, My husband and I currently have a DMP with CCCS which we have had since May 2010. When we first started the DMP, I also had a Littlewoods account but I didn't include it with the rest of my creditors as it didn't have much on it and I thought I would pay if off before the DMP started. Unfortunately we needed to use it for some household appliances which broke and we hoped to pay if off with my husband's commission, however, he hasn't received as much as we expected. The account has now increased to the point now where I can no longer afford the monthly payments. I have been burying my head in the sand a bit about it but I now need to do something about it. I have emailed CCCS to see if they are going to cancel my DMP or if they are willing to help me but in the meantime, I wanted to find out how I can go about managing my own DMP if they cancel. - All my creditors have accepted my DMP so I don't think it would be difficult now to manage it on my own. I'm not sure, however, how I would add the Littlewoods debt to it? Do I send them a letter saying I can't afford the monthly payment and offer them a reduced amount? Do I have to tell Littlewoods that I have been in a DMP for the last few years? Do I have to tell the other creditors about it? Any advice would be much appreciated.
  5. UKCPS parking notice charge Yesterday I parked in a retail park in Leeds and left the car park on foot to return later with some friends. When I returned I had a parking notice charge stuck on my windscreen. The reason was 'leaving site'. I understand this is because parking spaces are in high demand and it's to stop non users of the site..I was given the ticket within 10 minutes of leaving but returned to use the facilities later. From reading the blogs, it's obvious that I should not pay as it's private land and unenforceable but I am annoyed that the signage was so poor. There were none in the parking bays, only on the entry and exits. When I looked at the sign later it said you were not allowed to leave the site,but it doesn't say how,i.e. on foot, or by car and for how!.Also, the sign reads WARNING PRIVATE PROPERTY CONTRACTUAL AGREEMENT. IF YOU VISIT ELSEWHERE, BEFORE OR AFTER USING THE FACILITIES YOU ARE CONTRACTUALLY AGREEING TO PAY A FEE OF £100 DISCOUNTED TO £60 IF PAID WITHIN 14 DAYS. It's a farce! Also, when such a condition is blatently unreasonable, why are the DVLA allowed to sell them my data, which, in itself, is outrageous. This sign is very menacing and uncompromising and some reassurance re my position will be gratefully received. Many thanks
