  1. Hello, This is something I'm losing my sleep over. I've struggling for the last six months with the HMRC to obtain a full and detailed employment history going back to 16 years ago. I need this, because I need to send a request for permanent residency and I've lost some documentation. I first wrote to the HMRC last November and they replied almost immediately but only sending my national insurance contributions record. Then I wrote again in December, pointing out that I needed a breakdown of my employers instead. They replied in February, again sending the same ni record. So I called the hmrc helpline and the operator suggested that I wrote a request under the Data Protection Act, which I did immediately. I called the HMRC again in April and they told me that, due to the length of the period, it might take up to 375 days. However on their website they state: Now it's more than 3 months and yet no answer has come. Incidentally, re-reading the letter I sent, I have realised I had omitted my national insurance number. Terrible mistake, however I had included so much data that they could identify me without delays. What do do now? I'll call the HMRC tomorrow and if it goes nowhere, I'll write a second letter. Is there anything else I can do? This thing has been eating me for the last six months. Thank you
  2. Hi there I wonder if any one can give me aliitle advise, because the IR scare me a little. My husband is self employed and I do his accounts & tax return. I always submit his tax return at the very start of the tax year and with him being part of the CIS scheme he always pays to much tax and always get his refund within 4 weeks. Back in January we received a letter from the IR with regards to his 14/15 tax return, they stated there was a CIS mis-match, which is the case every year as our accounts are on cash accounting and our year year is the 31st March. So becasue of this they wanted an explanation and paper work and also detailed breakdowns and copies of all figures declared on the tax return. What a nightmare, as he is a small sole trader he still has an awful lot of paperowkr for the year. Anyway I sent them through the explanation of why the mis-match occured and copy remits. I also sent them an itemised breakdown of all the figures (expenses) on the tax return. A few weeks later another letter came, obviously what I sent expenses wise what not good enough and wanted copies of absolutely everything, full years bank statement, fuel invoices, purchase invoices and so on. This was basically a full lever arch file, so with not having the time or resources to copy this I ended up sending all original through to them with the additional information they required (which cost me nearly £16). So going forward I submitted 15/16 return on 6th April which the calculation stated my husband had made an over payment of over £10,000. It states an overpayment is normally made within 2 weeks but not to contact them until 4 weeks. Well 4 weeks is here and my husband has rang them and the payment is getting with held because of the previous years equiry. I feel I have been very helpful in the aid of their enquiry but just dont trust them. I feel they are goind to look for errors which I only declare actual figures used for the business but some questions they were asking me were ridiculous, ie mobile phone contract? mileage (which we dont keep as the vehicles used for the business are just for the business) MOTS. Hope you can make head & tails of this, I would appreciate anyone help & guidance. Thanks Hoody x

Hi I'm self employed, I have filed my return on line and after checking they had received it on my account it is saying pending bank repayment of................................. does this mean they will pay my refund directly into my bank account, its been like this since last Friday. I didn't request a repayment it has automatically done this Thank you sunnydee x
  4. I had a DRO last year which after closing my business down wiped out about £9,000 of business rates and other things such as unpaid tax and electricity etc. All well. We live, we try and if we fail we hope that we can pick ourselves back up and have another go. Now, today I had a letter from Rossendales they said I owe £1000+ for over payment of tax credit. There's no way I was overpaid. To my knowledge it was all signed off and all acccounted for in the DRO. I am trying to move on, not be dragged down by this crap and I will not let them affect me. What to do? I actually called Rossendale and told them this and half way thorugh realised people say do it in writing. They only told me what I know, that they are acting on behalf of HMRC. Really not sure what to do at this stage. Please advise. I am through with these people trying to mess me up.

    Is this a scam? HMRC e mail.....

    Today I received an emails from supposed HMRC This is part of what it contained..... Dear Taxpayer - We are sending this email to announce that after the last annual calculation of your fiscal activity we have determinated that you are eligible to receive a tax return of £148.32. In order to receive your refund online you need to create a Government Gateway account. Has anyone else received anything like this? Is it a [problem], and how did they get my email? Thanks in advance. Miss A. PS Note that the spelling of "determinated"....I don't even think that is a word!!
  6. Hi everyone Got a letter from Advantis yesterday telling me that I owe HMRC £688.09. Well this was news to me as HMRC have never been in touch. What is the best way to deal with this people? I have however been chased by HMRC for the last 10 months wherein they were chasing me for a debt of £1300 because I had failed to submit a self assessment form. Having never been self employed I had no reason to submit one. The HMRC refused to accept all evidence of P60s and wage slips from my employer. They did however send me a self assessment statement on the 7th January, received 18th January! cancelled all the alleged debts. And lo and behold now I get a lovely letter from some numpty debt collectors for a totally different amount. I'm just going to put together a "prove it" letter so any help would be most gratefully received. Thank you
  7. Hi, I was wondering if anyone may be able to offer some advice or point me in the right direction. My friends younger brother started working for himself around 2 years ago, he didnt set things up and didnt really know what he was doing and the business never actually took off. He ignored a self certification form sent from HMRC several months later because in his mind he was no longer self employed, never properly had been and hadnt made a profit to be in a position to pay tax/vat. He had a further reminder with fees / charges added on, he then wrote to hmrc explaining the above, they refused to accept his explanation and added further charges. He continued to ignore the situation as he didnt know what to do, the debt has been passed to Moorcroft and now stands around £3000, they want him to pay £100 per month. He is unemployed has no fixed abode and is not in receipt of any benefits {he refuses to claim} his girlfriend and family look after him and in he return he does odd jobs, he has no savings or assets to be able to settle this debt. His family are looking at how they can help him but they cannot afford £100 a month either - I understand that this is an important debt, what course of action is best for him to take? Any help /advice would be appreciated - Thank you

With over 3.5 million Liability Orders being issued each year for arrears of council tax, this new thread is of huge importance as the following proposal from the government will affect many thousands of council tax payers. For this reason I would hope that the moderators will allow this thread to remain on the main section of the forum for a few days before transferring it to the new 'bailiff discussion' section. Today the Department for Communities and Local Government (DCLG) announced that they have issued a Consultation paper regarding proposals to extend the data sharing facility with HMRC to enable them to share data pertaining to higher income debtors. The purpose of which is to enable the local authority to make an attachment of earnings order against the debtors employer.

  10. Hello All Advantis are chasing me and my wife for £3433.13 for an overpayment of tax credits. I was made bankrupt three years ago and I'm pretty sure the overpayment to which they are referring was from before that time. If the debt was before the bankruptcy (which was initiated by the HMRC on a separate matter) shouldn't it have been included in the bankruptcy petition? My wife is named separately on the account so I would figure that even before we disputed the amount it should only be for her share and not mine if mine was cleared with the bankruptcy. Also, what is Advantis' role in this? They claim to have been sent the account by HMRC but will not confirm whether or not they purchased the debt. They are also claiming that they can only send me any paperwork they have on me if I request it in writing and pay them £10.00 for it. Any views would be very welcome. Cheers Mike
  11. I am calling for justice, not just for HMRC, but for a system that requires no accountability. HMRC and other gov support are working from narrow guidelines without thought or often, much intelligence, and make cuts that they never have to take responsibility for. I know people well who have suffered from these cuts, living in poverty with great stress. Complaints take months, even years, and tribunals find against the complainant without having all the papers even. You can complain only about handling, not the outcome, and senior staff and even independent officers won't find fault. I have found this issue with ombudsman - even the highest point, their independent assessor/adjudicator - in all areas, not just HMRC. I have even seen evidence for corruption in the legal system, conveniently closing and losing cases that challenge them. We need a system where complaints are heard, not that we're put off for the stress and poor outcome. We need to work together for a fair, accountable system which has right of redress, which has people using their heads and hearts, not following flow chart rules under the pressure of targets for political and fiscal gain. We need to support those who need it, not rule that (this is a quote) "insufficient suffering" has occurred to warrant investigation and compensation, not to say that "need is not entitlement" (another true quote). I look to CAG to take steps to make this money and outcomes obsessed system into one that works for the people, not against us, that isn't about the agenda of those who rule.
  12. Hi My company ceased to trade in September 2014. In February 2015 all accounts were closed. Due to the nature of the business there are no assets and the registered address is my home address. In June 2015 an application was made to strike off the company and in September 2015 this action was objected to by HMRC due to outstanding corporation tax. Since then I have had numerous letters from HMRC (I replied stating all the information above in October 2015 but no reply) and then from a debt collection agency. I called the agency and explained the situation and they told me that because the status on the Companies House website was 'Active- Proposal to strike off' and there were no assets the case would be returned to HMRC. I didn't hear anything for another month and then today I recived another letter from the debt collection agency, again I called and this time I was told that HMRC had informed the agency that the company was still 'Active' and the debt should be persued. I really don't know what to do next, I haven't heard from HMRC following my letter of October 2015 or since Companies House since September 2015. The debt outstanding is £8700. The agency said I should write to them with proof of what I have been saying, but I don't even know what to send them. Please help. Thank you.
  13. I arrived home yesterday to find an unexpected letter from HMRC requesting I pay them over £500 for an over payment from April 2009. My issue is that I wasnt aware that this over payment occurred as it would have been paid into my ex-gfs account I have no idea how to proceed I have no evidence which explains why there was an overpayment or even if what they are telling me is correct. I split up with my gf in early 2010, I have since moved house multiple times, have changed bank accounts etc and do not have (or have ever had) any documents relating to this. I gave them a call and they told me it was for a debt in April 2009 and that my ex had paid the other half (so she must have admitted that it was a mistake??). the adviser i spoke to on the phone accused me of lying and said there was no way I wouldn't know about this and they they have sent me letters in the past which is simply not true. I have said I will dispute the claim but I have no evidence to the contrary and I am unsure what I can do, it looks as if I may have to pay this? please help!
  14. Hi all. First of all apologies for the long post. I will try to explain this as best I can. As some of you know I am back in employment from 26th October. I don’t mind giving figures as they will help with some of the answers. OK, here goes. · I signed off JSA 23/10 (last payment date 25/10) being paid around 28/10 · I start work on 26/10 with a £17,031 salary (salary date is 23 of each month) · I applied for Working Tax Credits (WTC) as I thought I was entitled · This morning I get a letter from JSA saying my JSA 16/10/15 to 31/03/2016 will be £20.04pw as I have £53.06 coming in. This is irrelevant as my last payment is being processed now. Have JSA (DWP) been liaising with HMRC (WTC) already? · I call HMRC (WTC) this morning and ask for an update – they say I have a payment of £214.60 to me on 11/11 – I think all is well. · HMRC then say we have no salary for you down only my income from JSA which was £3774.00. They then base that until the end of the financial year my income is around £7205 so WTC would only be paid on this if anything at all but he could not say what it would be at this stage. · HMRC then tell me WTC for a single person with no children is only paid if you are on £13,000 or less, however, when I done an on line calculation it says I am entitled to £1384pa Can anyone shed any light on my entitlement, if any? I can manage on my new salary, quite frankly it is double what I had on benefits but the way I think is if I do have entitlement why should I not claim it to help with fares etc. I am very confused as they did not actually have my claim form in front of them but on their system they had my details but only a figure for JSA income not my salary.   15. Hello, is it true that the HMRC can give a statement of employment record if requested? I have found the address of the Record Retrieval Service, but it looks like this is only for compensation claims? Would they give me a record for any other purpose? And would that cover also periods on benefits? The reason I need this record for previous years is because I've lost some of my p45s and now I need to claim permanent residence status for EU citizens.
  16. Hi, After some advice if anyone can help. It's very complicated - well, at least it is to me as I'm totally out of my depth! I'll try to be brief... Back in 2013 I was on JSA and totally, brutally, skint. I had a small pension with Standard Life, the current value at the time was 10k. I received a cold-call from a company offering me a way to transfer my pension and release 20% of the value immediately. I was 38 at the time and even I knew that this was probably a bit dodgy as 55 seemed to be the only age this was allowed. But because I was so poor I figured that £2k now and worry about the 18k in 17 years time! The fees they charged me were horrendous, but I got £1780 and to be honest it saved my life. Fast forward two years and I had a phone call from a genuinely nice guy at HMRC asking me why I hadn't filed tax returns for my "company"! Long story short, this pension release firm had set up a holding company for me and transferred my pension funds to it, they then bought £8k worth of shares in some crazy business - I had no knowledge about any of this. The guy at HMRC basically said, "don't worry, we come across mug-punters like you all the time, your only crime is being a thick idiot, but we will come after you for 40% tax on the full 10k unless you transfer the funds into a proper SSCP" ? I've got in contact with the original firm which handled the paperwork (interestingly it's not the same company which cold-called me - they were just acting as an introducer for their commission). Again, to be fair, this firm who handled the paperwork have got back to me and said there's still about £900 my "fictitious" (to me) holding company, and the 8k shares are real. So, I've got the original share certificate coming from the business I "bought" 8k shares in, and the firm have promised to send me a check for the £900 once "they have concluded business with HMRC as they've deregulated your small stakeholder pension fund". I hope the above makes sense, as it barely does to me. I guess my question is, IF I get sent a cheque for £900, and IF these shares turn out to be worth more than the paper they're written on and I sell them, then do I need to tell HMRC and pay 40% tax, or do I wait for them to ask for it in the fullness of time. I'm still on JSA. Thanks if anyone takes the time to make sense of the above. And please feel free to ask me more questions - I'll answer to the best of my ability.
  17. I'm not sure if I should be posting this here or in the debt forum, if I'm in the wrong place then please accept my apologies. I have a debt of £1500 to HMRC (my own fault I have the debt but I'm working hard to settle it). I was paying £10 a week to HMRC through my online banking, it's all I can afford. I'm self employed at the moment but my business is dying away, I have no way of recovering my business. I have been looking for full time work and there's no work available, I have however had an offer of full time permanent work from a company I used to work for but the job start date isn't until January. About 2 weeks ago HMRC passed the debt to a debt collection agency called Apex Credit Management who have since demanded the debt to be settled in full, I have no savings and my only asset is a car (which I need), I don't know the exact value of my car but it's not a lot, I bought it 4 year ago for a £1000. I wrote to Apex with an offer of £10 per week token payment but they refused as it's not a high enough offer, the letter said something about HMRC policy to have the account settled within 12 months. If I couldn't raise the token payment then they would hand the account back to HMRC for further enforcement. £10 a week is all I can genuinely afford, if I start this job in January I could have the remaining balance settled by about March. If I was to continue with the token payments, is it likely that HMRC would take further action while payments are being paid? What is the chance that they would automatically bankrupt me? I have a couple of other debts (1 priority and 1 non priority - both larger amounts than HMRC) who have all accepted the same token payment without any problems.
  18. Hi everyone, My wife received a letter on July 9th from Pastdue Credit Solutions, apparently acting on behalf of, and claiming a debt of £700 owed to HMRC for Single Tax Credits. The letter doesn't give any info about the debt, but just threatens further action if not paid, giving a payment date of yesterday. We have not claimed tax credit for around 7 or 8 years, and even then it was as a couple. The last time my wife claimed as a single person was 10, maybe 12 years ago. We have never been told about this debt, and even if she did have a debt a decade ago, we had many years of claiming where they would have taken monies owed back again I think? Does anyone have any advice on how to handle this company, or deal with this situation? Thanks
  19. I first received a letter, I think it was in 2011 stating that I owed money for Tax Credits overpayment. I then received 1 or 2 letters in 2012 and 2013 and I asked for a breakdown of the money I owed but was told it was too late to request this information. I heard from them once last year and I received a letter recently. However, today I have received a letter from a debt collection agency stating that I owe HMRC over £1,100 and I am not sure what to do, this is the first time that I have received a letter from a collection agency. Even if I did owe the money I cannot afford to repay it so I'm not sure what to do now? Any advice is much appreciated, thanks.

  21. My nephew was self-employed for a part of last year. He therefore submitted is self assessment forms, which they received 24 april 2014. He confirmed this by phone and at the same time they informed him there was a huge delay, particularly with paper applications, and to expect to wait at least six weeks. He rang last Saturday to see how it was all going. A very helpful chap confirmed that it had been approved on 25 June and he should therefore expect payment into his bank this Friday, today. He was told the amount. There is no rebate this morning. He rang them at lunchtime, and they didn´t know what he was talking about, except that they agreed they had received his application had been received. It would not be looked at until 7 August at the earliest. They were as confused as my nephew. It transpires that the person he spoke to on Saturday incorrectly gave him the details from the year before. It took about half an hour for them to realise this. The chap he spoke to apologised and said he had never known that to happen in the seven years he had been working there. This has caused my nephew a few finanical problems, I mean after all, if the tax man says he is going to pay you a set amount on a set date then we believe them don´t we?! Anyway, I feel after such an error (and they have the call recorded apparently) they should now pull his application out of the system and deal with it swiftly and manually. After all, if it only happens once in seven years, it won´t be that difficult will it? And we will make a complaint of course, we have the address, to ensure that it doesn´t happen again in the next seven years, hopefully. Other than them being stupid, is anyone aware of anything we can throw at them letterwise, do we have any rights when this happens etc? Many thanks for reading.
  22. Last year, HMRC (quite rightly) sent demands to me stating that I needed to complete tax returns going back to 2008/9 and 2009/10. These were completed (by my accountant). One of these years showed a loss of c£20,000. The returns were submitted to HMRC, along with other more recent tax returns. HMRC then notified me that these specific returns for the years mentioned above, are 'time barred', and cannot be used to calculate tax owing. They consequently hit me with a £26,000 tax bill. All the advice I read at the time, and HMRC's own advice by telephone, suggested that I should make a payment arrangement first, argue the toss second - which is what I did. I subsequently set up a payment arrangement of £500 per month, which I could afford at the time. I subsequently sent to HMRC a SAR, to include transcripts of all telephone conversations, in order that I could determine what they'd told me - with a view to compelling them to take into account the loss on my accounts of £20,000. On 11 May, I received an email from them to confirm receipt of the SAR, pointing out that they had 40 days with which to comply with the SAR. Needless to say, 40 days expired on 20 June 2015, and nothing has been heard from HMRC. So I can't challenge the debt as I evidence upon which I might rely is being withheld. My financial circumstances have now changed to the extent that I can no longer afford £500 per month - on a debt that I can't challenge. SOOOOOO.....What options do I have? 1. How can I hold HMRC responsible for not complying with their legal requirement under the DP ACT to respond to the SAR within 40 days? 2. Can / should I stop the repayment based on 1. above? 3. Regardless of 1 and 2 above, I can no longer afford £500pm..... Any advice and guidance would be much appreciated.
  23. When I was at Ingeus a few years ago my adviser there signed me up for Self Employed agianst my will. She said 'you don't have to do anything until you go self employed'. For some months now I have tried to tell HMRC that I am NOT self employed and that I am signing on at my Job Centre. When I got a letter there was a form on the other side, I filled that in telling them that I am signing on and never was self employed. They never got back to me, they sent out several letters demanding money. My Dad phoned back and they gave him a number, he rang that number and waited 40 minutes and gave up. He tried again today and 40 minutes with no one answering. I am at my wits end as to what to do. What I am going to do is write them a complaint telling them that I am not self employed. I can't find an email address and writing them is my only choice as they refuse to anser our calls.
  24. Hello, I am planning to start several business activities at the same time, or shortly after one another within the same accounting period, as a non-VAT registered sole trader. I am thinking about stuff like window cleaning, oven cleaning, car interior detailing, house window film installation, car window tinting, conservatory window and door tinting, wall dressing, and maybe also some painting and decorating. For the Income Tax and National Insurance purposes, I would prefer to report all those activities to HMRC as only one business. If I was to run more than one business, I am afraid I would have to keep not only one, but two or more sets of business records, which would cost me a lot of extra time as well as extra money in accounting fees. Does anyone know if there is any official guidance or case law on how much similar various business activities should be so that one can still conveniently place them under "still only one business" umbrella for the Income Tax and National Insurance purposes? Would I avoid any potential HMRC penalties for NOT separating multiple businesses (trades), if I described my business for instance as "general handymanship"? Any advice will be most appreciated.
  25. I am absolutely livid. Yesterday out of the blue I received a letter from Concentrix on behalf of HMRC regarding my tax credits. Prior to that letter I had never heard of Concentrix. The letter "requests" that I send in my wage slips and also bank statements from 6 April 2014 - 5 April 2015. I found this alarming as we are constantly being advised not to disclose this kind of information and yet here I am being asked by a company I have never heard of to do just that. My first thought was to contact them and ask what the hell this was about. The tone of the letter borders on accusatory and I found this deeply offensive. Would it not have been an idea for HMRC to have sent out a letter prior to the Concentrix letter advising folk that as Tax Credits are incompetent they have now had to draft in the outside help of Concentrix. Only recently I experienced a further problem with Tax Credits. I advised them of my work start date and because some idiot input the wrong date (a month before I had actually started work), I was faced with an overpayment which I have just finished paying. I have only just realised the scale of the problem by visiting other forums. They are awash with single parents having received letters accusing them of having a partner living with them that they didn't declare so I suppose in that respect I'm lucky as I haven't been accused of that. Talk about heavy handed, it's ridiculous that this is allowed to happen. They claim they are only trying to ensure we are receiving the right amount of tax credits to avoid overpayments, but the way they have handled the situation is more like a witch-hunt.
