  2. Hi I hope you don’t mind me adding on to this thread but unfortunately I have to become a victim of their dodgy antics. I bought a car on the 18th of September 2019 with 3 months warranty 10 days later the clutch went. liaising with their complaints team they informed me to get the vehicle recovered to them and they will diagnose the vehicle. They then advised that after owning the car for 10 days I had prematurely missed use the clutch causing the fault. They offered to repair the vehicle if I got it recovered to their garage in bagshot and would reimburse me recovery cost and charge me £295 for the repair. I did the above and was in contact with the Irish man called Noel who kept fobbing me off saying they would repair it but needed more time. When I went down there 3 weeks later I discovered all the cars have been removed from the site and the premises locked up and my car was nowhere to be seen. I contacted the complaints department who then advised me my car was at another garage and gave me location and someone would meet me with the key. The car was actually just dumped in a street around the corner. Luckily I had a spare key and arranged for the vehicle to be recovered as soon as possible and taken to another garage. The new garage repaired my car and said that it was in such a state parts had snapped and said the garage would’ve been aware of this and I had not prematurely cause this fault. The complaints team had advised me to Collect my vehicle and get it repaired at another garage as EMC could no longer do it due to losing their premises. Once repaired by a different garage I contacted the complaints department as wanted to be refunded recovery costs as they previously agreed and the difference in repair costs as I had to pay the new garage £200 more than EMC had quoted. I then got an email back today saying that EMC car sales have ceased trading and all future arrangements have been cancelled and they may not be able to help me. Is there anything I can do to claim my money back? I saw in the previous posts that they are still trading under a limited company and have the same companies house number. Any advice would be greatly appreciated or anything I can do against them to stop them doing this in the future. They shouldn’t be able to keep getting away with ripping customers off under different trading names the owners should be barred and sentenced.
  3. Same thing has just happened to us. We have been sold a car deemed dangerous. Turns out that the car had an outstanding recall which was serious and according to local garage the person responsible for the Mot should lose their licence. There was multiple failures. I am sending our story to watchdog on BBC. I can't believe I didn't see all of this prior to purchasing the car in August. They had so many good reviews on Auto Trader... Pretty sure most are fake now.
  4. Thanks for the reply ....I am currently going thru the motor ombudsman with a case against EMC car sales but it is a long drawn out process , been going approx 5 months and nothing yet.
  5. Hmmm it seems like EMC sales really do stretch the envelops when it comes to dodgy trading. I seem to be in the same boat as everyone else that has bought a car from them. Fortunately for me if the motor ombudsman doesn't come through quick enough I can take them straight to court as I exercised my right to reject before the time period expired _ they're now disputing my consumer rights. In any case, I'm planning on taking the dodgy dealings of this garage to the local papers. They've already been reported by me to trading standards as the car they sold me was classed as dangerous to drive! I'd be very interested to compile all of this evidence together if anyone would like to send me more details or their cases? Without prejudicing court cases of course.
  6. Hi everyone. I have a judgement against EMC car sales last month they applied to set it aside. At the moment I'm still waiting for the date of hearing. I've also realized that they ceased trading at the end of October. Does anyone know what options I have in this situation? Thanks for any help. Bench
  7. Hi All, I am another victim. I have been trying to sort things out with them for a few months now. Them sending me to get official reports from BMW (which I stupid paid for upfront as it seemed they were being helpful). As of today the sent me a letter saying they have ceased trading so can't help... That is that... Website gone also...
  8. Hi all, I wonder if anyone can help with my question. After having purchased a vehicle last Sunday, it is found that the automatic gearbox will not change gear properly. Long story short.. 03/03: Collected car from dealer. On 2 hour drive home, the car started lurching and jolting between gearchanges. Occasionally changes we're so severe the excessive revs caused wheelspin at highway speeds. 04/03: Took car to local garage. Advised to change gearbox oil as first possible remedy. 05 -06/03: Autobox oil changed. No difference. Also found several severe engine oil leaks. Garage supplied an engineers report advising against driving the car. Wrote formal Right to Reject email to supplier stating displeasure with the vehicle. 07/03: Supplier esponds asking for casualty report from gearbox specialist. I supply the one from my local garage. 08/03: Supplier now demanding a report from gearbox specialist. Standard garage report is not good enough for them. My question: Does the supplier have a right to demand a casualty report from a gearbox specialist ? I can't drive the car due to safety reasons along with the fact I've rejected the car already.   9. Has anyone got any names of the people who worked there? Seems to me they all used either nicknames or fake names. I have found the boss guy but no one else. I need this for my case against them. I don’t have enough info about them to raise a case as they are not registered anywhere. thanks in advance
  10. So I find this all very interesting, I called the garage to get the car checked diagnostic showed turbo fault. Emailed the complaints team on the invoice with all my evedance and got similar responses to you, in the end they offered me 850 to buy the car back, I paid 2400 for it, I have now submitted a claim of 2950 pounds which covers cost of hire car that i had to get for a pre arranged family weekend away engineer report tax and insurance as they have also not sent off the v5 so I'm currantly unable to sorn the car. They then add on the 105 court fee and 8% interest. So around the 3100 mark to date. Get as much evidence as you can email auto trader the reg and dealers name and they will send you the original add very useful for me as it states excellent condition and recent cambelt, according to service history cambelt is now due again. Check MOT history on my engineering investigation 2 items it failed the mot for in jan are still issues with the car and it passed with no advisorys in Feb, they also found other issues that I wasn't even aware of such as contaminated coolent, coolent leak as well as confirming the dmf and Turbo Failure. O and I also was sold a car with a 4* warrenty and only received a 3* warrenty was offered 20 pounds for human error if I had known that I wouldn't have taken the car 4* plan covers alot more I was also not told that there was a claim limit on the warrenty.
  11. My EMC died in my Oldish 2.5 BMW. 1997 model with low mileage. Gutted, but a buddy of mine who works for BMW had a new one sent down from one of their other workshops. This one works, but the engine runs as rough as rats. We had the new unit back in the workshop and it checks out o.k. The old unit was remapped after I had a decat pipe fitted and a K&N induction kit fitted. Do we think, if I put the Cat back on and replaced the original air filter, it will make any difference ?? I am really fed up as this 'mishap' has cost me a run down to the Oxford meet Of course it has to be over a weekend when this happens !!! Many thanks, Lex.
