  1. Hi, Found this forum recently and this is my first post. I have an Egg loan which dates back to 2003, it was defaulted in 2003 and has since dropped of my CR. I have various other debts but egg is the largest. For reasons which I wont go into I have buried my head in the sand when it has come to my finances and have just started to try and deal with them. I'm looking at all the different options on how to address the debt. The first thing i noticed is that it had dropped of my file, i then checked to see when last written acknowledgement/payment was made to find out when it became SB (in 2yrs). I have not heard from egg (other than standard annual loan statement) or DCA regarding this debt for nearly 18 months. I am thinking that I do nothing and wait for it to become SB. My worry is that egg will decide to proceed with court action and try to obtain a CCJ, therefore resetting the clock for SB. Does anybody have any experience of Egg not chasing the a loan for this long and then either selling it on or going to court? Any advice would be gratefully received

Hi all, Its only a very small victory, I know, but I got a lovely letter from The Apex Credit Management & Bulls*!t Production Company today telling me that Egg could not provide them with the signed credit agreement, or the default notice that was allegedly sent before assignment and therefore have returned the account to Egg and removed all CRA activity they have put on! Is there anything that I can claim from Apex (like all the payments I have made to them) to donate to CAG? I couldn't have got this far without reading the excellent advice from this site and would love to give back somehow... I still have my MBNA struggle and realise that I will soon be dealing with Egg again, but I SAR'd them yesterday and am not expecting anything new. It is just so lovely to get rid of the DCA, I find the original lenders much easier to deal with. Didn't think a bit of happy news would go amiss here! Feel free to comment RobboM
  3. Hi, I was looking for some advice on what to do with my Egg card. The agreement can be found by clicking the link below. Due to my lack of income my current status with this card is that Ive been on a payment plan for 6 months with them. This ended 2 months ago and since then Ive paid token payments totalling £26. They are hounding me now wanting payment, which I just havent got so what do I do? I know there's a case going through regarding Egg and this 'approved limit' statement but is there anything I can send them in the meantime? All advice would be greatly received.   4. Just wondered if anyone can advise me on what line I should pursue. I am currently in the early stages of court proceedings on another thread for an Egg loan - which led to me reading other things on this site, particularly lots of stuff about Egg cards. Can anyone advise me on whether or not I have anything worth pursuing. Will summarise; In 99 or 2000 took out an Egg card online which ran ok for many years. I know I had PPI and account ran up and down to around £11k. A few years into the account i questioned the need for the PPI and they stopped it. (not sure of exact dates) Account balance eventually dropped to about £4k and last year i asked them questions about the PPI but was told I was wasting my time as the application was done online and i'd ticked the box! I got into financial difficulties early this year, did an 'income and expenditure exercise and offered each of my creditors a monthly payment pro rata. Egg ignored my letters for 3 months (but managed hundreds of phone calls, 3 further letters of their own, texts etc) and then issued a Default Notice! 6 weeks later they sent a further letter terminating my account and handed it to a DCA called DLC. They agreed to the monthly amount that i'd offered Egg within a matter of days!! I'm assuming that the debt was probably sold on. My question is this - Does anybody have an opinion on what I should be doing now/next? Should I be issuing anything to Egg or DLC at this stage or should I let sleeping dogs lie? Any advice gratefully received.
  5. Hi All I've recently received a Default Notice from Egg, it's attached. For information it is on 3 seperate sheets of paper and in the top right of the first page it says the letter is about my "Egg Card" - this is incorrect, it's about my Egg Money Card.     I have paid £495 to one company - since been served with a default notice by Egg - now past the due date - was told no problem if this happened - have emailed them but no reply !
  7. as above, CCA'd egg on 16/07/08. They responded with an unsigned agreement and nothing else, no terms, no other info. Wrote back to them to tell them account in dispute as they have failed to provide etc. put in the dispute letter the usual about "you may not pass this account on" etc but they've completely ignored it and sent a letter back saying the account is now closed and will be passed to a DCA for collection what do I do now?
  8. Hi, i have received a letter from capquest to which i promptly sent back a CCA letter. Here is there response: http://x-centric.net/capquest1.jpg capquest letter http://x-centric.net/capquest2.jpg egg card agreement front back of egg card agreement shows my signature and date correct ( forgot to scan back ) what would be my next step? should i now send a Subject Access Request along with £10?   9. Hi, I'm currently in default to egg for a loan after falling behind with payments after losing my job. they passed it onto capquest debt recovery who are useless. I set up a payment plan for £75 monthly, after making 6 payments by SO from bank capquest wrote and said they were taking further action due to non-payment. I was advised to cancel the payments and send off a copy of my bank statements showing the payments, which I did. They wrote acknowledging these and set up a new SO for £75 again. A payment left my account on 4 May but last week they sent me a letter saying they were now going to send a collector to my door due to me ignoring repeated requests for payments or a payment plan. I've tried speaking to them on the phone but they are bloody useless. Can anyone tell me what to do next, I'm not that great on the phone and if anyone comes to my door I'd panic and probably agree to whatever they asked for whether I could afford it or not. Any advice would be very much appreciated. Thanks
