  1. I am considering the purchase of a flat in the centre of Bath. I have been advised that the property does not come with the right to a residents parking permit, although all of the neighbouring properties do have this right. This seems to be a fundamentally inequitable situation. Can the council arbitrarily decide which residents of an area are entitled to parking permits? Is there any mechanism to challenge this? In desperate need of advice last friday a bailiff turned up at my previuos address threatening to seize goods from current occupants for a ticket issued to my car while at an address before moving to our previous address. The current occupants called me and I talked to the bailiff who declined to come to our current address but agreed to meet me at the local sainsbury carpark. When I met him all he wanted was monet amoounting to £430 which ofcourse i wasnt willing to pay since it was my first time to hear about the ticket. He wouldnt have none of my pleadings and we departed. I dont even have the PCN number because there was no paperwork provided, he said I could it from his headoffice. When I called headoffice number they told me i can only deal with the bailiff! I tried their automated payment system only to crosscheck the amount which also declined to process my payment and referred me to bailiff. What can I do?
  3. Sunday afternoon, the weathers lovely, lets spend the afternoon by the river at Eton. Found a little lane that I was vaguely aware of before. Several areas for parking but all full. Then a godsend, a junction with a footpath where the lane turns sharp left and wide verges. 2 spaces next to a gate into a field, 1 just further up the road, one across from it. 1 car already in situ in the space next to the gate. Double yellow lines but these spaces were well off the road had obviously been used before and crucially apart from a sign to not park in front of the gate, no signs indicating that parking anywhere in this area is an offence.No blockages were made by parking in these spots. Of course subsequently I and 3 other motorists get issued with PCNs. I was inscensed and left my mobile number on the other cars. I have since been contacted by 2 of them who both feel the same way. I was not previously aware that yellow lines apply to a verge (Only by reading previous posts on this site has that become clear and i've been driving 40 yrs) and clearly it is not a commonly known fact, as both other drivers thought the same as me. The geography at this point clearly entices drivers to park here and I suspect Windsor & Maidenhead council make a tidy little sum out of this honey pot. Should there not be an onus on councils to erect signs at these spots to make it clear parking is not allowed. Had there been, I and the others would not have parked here. Is there any point in appealing on these grounds? Your considered opinion would be appreciated.
  4. Hi, have seen a few posts but not sure which path to follow. I have a parking ticket in my husbands name ( car registered to him) which I have not dealt with and now the Bailiffs are sending letters. It looks like it has gone to County Court - they have a warrant for removal of goods and have advised that they will return within 7 days ( date unspecified) and would prefer if he were at home ( how when we do not know they are coming I do not know). There is no amount specified They are threatening to 'return' to remove goods. The letter is signed with a name rather than 'Bailiff in Charge' etc What is my best course of action? Obviously the debt must be paid but I know any plan I put forward would be laughed at and also at the moment we have no spare cash. Recently paid one from around about the same time which had escalated to £450 - they caught me as the door was open - (it was a hot day) luckily I had some friends who helped me out. I was thinking to re-register the car in my name to buy time and to offer a payment plan but I do not know if it has gone too fa. Unfortunately I should have dealt with this a long time ago but due to personal issues let t slide and I have a feeling there may be another one lurking. Current financial situation is that my husband works full time, I am 'self employed' although not making any money as such. His wages cover all our outgoings ( JUST) we are also in an IVA which has run for 1 year to date. I have read about denial of access.... Does this actually work? Should I try this? Can anyone help?   5. Thank you for all your advise and reassurance you have all given me up to now, whilst this is my first post I have been coming to you for advise for some time! I have been issued a Parking Charge Notice by Parking Total Solutions for leaving the area whilst parked in the shopping retail park. I did do this but only to get some cash prior to shopping in the retail park so was gone for a very short time. When I returned to my car after shopping I had a notice on my car. Following your advise and after watching the Watchdog clip I have ignored all previous letters, despite my husbands protests! Today I have received a letter from Roxburghe Debt Collectors, requesting £198! It states; "If we do not hear from you within 10 days, we will pass the matter to our solicitors, Graham White, who will review your case for potential legal action" and "We are fully aware of anecdotal information being presented via the internet and on various websites and you may feel this guidance is worth following. We strongly urge you to seek independent legal advise rather than rely on these opinions, and we would respectively suggest that you refer to the Civil Procedure Rules part 31*, and more specifically parts 31.16 and 31.17. *For information on how this may affect you please visit etc. I will try to look up these parts they reference, but in case it is all over my head I thought I would approach you guys! Can you reassure me? Thanks once again
  6. Hi, I have been fined for parking with reason "PARKED IN A RESTRICTED STREET DURING PRESCRIBED HOURS". I genuinely believed I was ok to park there. This is how the road looks: Picture 1 - As we enter the street. There is a sign that it is a controlled zone, but there is another one, please see 2nd and 3rd pictures. Picture 2 and 3 - There is a yellow sign on the right side. Now I believed that this meant I could park on the left side of the road (from the point of view of the camera), which I did. I believed the yellow sign meant that in that particular direction the restriction applies only between 1 and 2 pm, and it was outside of this time frame when I parked. It may be just the lack of my knowledge regarding parking signs, and I would appreciate some help. Thanks in advance.
  7. I see another viewpoint has been put about the recent VCS case, makes interesting reading. combinedparkingsolutions.com/vcs.html It does make sense though, if the landowner explicity gives them approval to enforce charges that they issue then that would allow them to enforce the charge.
  8. On the 17th August i parked at the service station just outside of Oxford that has Parking Eye .... though i didnt notice until after leaving about 4 hours later. It was about 3am when i parked as i was shattered and had a sleep. Now the car is registered in my mothers name, so these people sent a billl for 60GBP to her house which she stupidly paid. Now i am utterly livid that she would go behind my back on what is a civil case and we've had a huge fallout. So i am wondering as this company have billed the wrong person is there anything i can do for them to come after me and get the money my mother has paid back. I am willing to cut my nose off to spite my face as i hate what England has become where everyone is willing to ... everyone over at the drop of a hat. Maybe next time i will carry on driving whilst tired and run some one over im sure that'd be of benefit to them . .. i can honestly say at 3am i did not see a sign about this Parking Eye.
  9. The company I work for has received a "Notice of Trespass" in relation to one of our wagons being stopped on the roadside on a private industrial estate in Felixstowe. Note that this was not parking in a bay or layby but simply pulled up on a roadway (on yellow lines). This was recorded on CCTV. The agents, Proserve Enforecment Solutions issued a Notice for Trespass on 10th May for £100 (plus VAT) which we ignored in the same way as we would for a private company issuing a parking PCN. We have now received a second letter with a 50% additional charge suggesting that if payment is not received by Friday 1st June they "will" register the charge with the County Court. Usually the parking PCN's use the word "may" rather than "will". Are we in a different situation because they are using Trespass rather than just an ordinary parking notice? I would appreciate anyone's experience or advice with Proserve Enforcement or this type of notice.
  10. Today, I forgot to display my disabled badge while parked in Terminal 5 at Heathrow. I got hold of the parking attrentant five minutes after he issued the PEN, showed him my valid badge plus my driving licence for id purposes. He said he couldn't revoke the penalty himself only APCOA Parking in Uxbridge could do it, wrote 'Verified' with a short scribbled signature on the car park exit ticket. He further suggested I write to APCOA sending copies of my badge, driving licence , exit car park ticket bearing his. .scribbling reassuring me that they will cancel the charge. What shall I do, do as he suggested or wait for them to contact me and then what ? Can someone put me at ease ? P.S This PEN comes as my...two days ago 70th birthday, present !!!!!
  11. Hi, first post so please bear with me... Attended an appointment at the QE hospital in King's Lynn, parking is a joke usual drive round.... Not wishing to miss my appoinment parked vehicle on grass, along with approx 30-40 others. Did not obstruct or block pathway, cause harm or injury to anyone. Only notice I saw showed not to park on path. Upon returning found a new yellow "windscreen accessory" from CP asking for £80 which would be reduced to £40 if I were to pay within 14 days . I checked three other vehicles parked by and found none to have a P&D ticket or new yellow "windscreen accessory". Details are: Parking Charge for "A - parked in a private car park without clearly displaying a valid permit". Costs seems a bit steep, for what would have cost £5 max to park in the car park but I didn't consider this to be in the car park. General advice seems to be ignore, any further advise would be welcome.

Well before i left to go out today the postman put my letters through the letter box, and then i saw it, its everything i've wanted and more, it gleamed as it sat on my floor just looking up at me. I new it was going to be a good day then, opened it up, and "yay", i have one at last. Its taken months and months of parking in my local Morrison but i finally have it in black and white, my very own photo of my car lol.... Yes i no the rule, ignore, use letters as toilet paper, laugh every time they send out a letter cos its costing them money. I'm hitting this from the other side, i'm going for morrisons. I shop there every week at least twice a week, i use the cafe in the shop before i do my shopping so i always take a while as i'm using there facilities that they provide before i do my shopping which on a busy day can take an hour or 2 if i'm doing my big shop (last big shop was on the day i over stayed my welcome and i'd spent just short of £400). Now, my question is, whats the best email address to use to send a very strongly worded complaint to someone with half a brain cell at morrisions main office??

I live in Dubai UAE and was recently onHoliday in the UK, I picked up a rental car and we stayed at the Marriott Heathrow,which has recently started using Parking Eye I parked the car and unloadedit in time of 35 mins I have incurred a 120 GBP fine I missed the discount time asthey sent it to me by post. I have been charged 30 GBP by the rental companyfor admin and they have passed on my private contact details to Parking Eye whohave sent me the notice for payment, Are rental company’s allowed to pass on mydetails to a third party these are not Traffic Violations The charge is ridiculous what is the bestcourse of action if I refuse to pay are there any issue I need to be aware of

Hello everyone My husband took his elderly father to look round a local market recently, and today has received a parking charge letter from Parking Eye which states he either did not pay the parking fee on the car park where he parked, or overstayed his welcome My husband remembers paying for a ticket and displaying it, so they are literally trying to charge him (£60 if he pays straight away or £90 if he doesn't etc.), for overstaying by a few minutes according to the times on the letter that he arrived and departed!! Bearing in mind the fact that my father in law is in his 80s and doesn't exactly run like a gazelle - I think its unfair that my husband should be expected to pay this fine! However I've also read its best not to appeal but just to ignore their letters and only respond to any court papers. I've been reading up on other threads on here about Parking Eye, and we fully intend to ignore the letter, but I wanted to come on here and share our experience for a bit of moral support and to ask for help if I may, if Parking Eye start to get nasty?   15. A ticket was placed on my car when parked in Malvern. Although it looks like a Parking Charge Notice which I'd ignore, it does talk about contravention of Byelaw 9 of the Malvern Hills Conservators. Shall I be safe to ignore this? I received a further letter requesting payment in 14 days, together with an invoice attached to it - which i have attached here. So am I safe to continue ignoring this one?
  16. A while back, I received a ticket for parking in a council car park without a ticket. Soon afterwards, I offered to pay the £25 payment in installments, saying I couldn't afford to pay it all at once. By the time the council got back to me, the charge due had increased to £50. Today, the council sent me the following letter (via email): Parking Contravention: 83 Parked in a car park without clearly displaying a valid pay and display ticket or voucher or parking clock. Dear Mr W, Firstly I must advise you that the process for appealing a penalty charge notice does not allow for it to be kept at the reduced rate indefinitely whilst you continue to appeal. Once the initial 14 days has passed the penalty reverts to the original charge of either £50.00 or £70.00 depending on the contravention, in this case £50.00. You initially challenged the PCN and were re-offered the discount which was again offered with the rejection of representations on 18/5/2012. As you chose to continue to email and contest the charge the penalty reverted to the full amount as is the correct procedure laid down by the Department for Transport.. I am not prepared to offer the discounted charge again as this case has been ongoing since the 1/4/2012. The Charge Certificate was issued to you on the 2/8/2012 which increased the amount owing by a further 50% to £75.00 as you were advised would happen in the rejection of representations. The procedure that has been followed is the correct one and as such no further lines of appeal are open. I must also advise you that the case does not go to court, the appeals process that was provided to you in our previous letters have now been exhausted. I note that you have once again requested a payment plan, however as per my previous email, this is not possible due to the default on your case. If payment is not made in full by the 31/8/2012 the debt will registered at the Traffic Enforcement Centre and a further £7.00 costs will be added, if payment is not made after this the debt will be passed to the bailiff for collection who are at liberty to add their own costs. Is the council correct in their assessment of my situation? Surely they cannot act as judge, jury and executioner, rather than the case being looked at by an independent third party. Also, the council have been corresponding with me by email, but didn't make any checks to ensure that I wasn't an imposter, such as asking me my DOB. Is that legal? Thanks in advance. Jeff
  17. Hi guys, I'm looking for a bit of advice. I received a parking ticket from a private company called Vehicle Control Services Ltd. The car park is in a gated community where I live. There are signs around the place stating that it is private property. It is permit operated, I do have a permit for my car but on this occassion I had a work vehicle parked in a neighbours space for which they gave me permission to park in. The ticket had a time on of 0422hrs which I find strange in the first place. The want £80 which I find a bit steep to be honest. I've been reading articles and most state that I should just ignore them. My only concern is that its a work vehicle and I don't want to cause any grief with work... Should I just ignore it and wait for something to come to work and then say I didnt get a ticket and take it from there? Any advice is more than welcome. Many thanks in advance
  18. Greetings all: I've received an email - as have others I presume - asking for evidence of unclear wordings on private parking signs. I do not disagree that signs need to be clear, visible & fair. However, the law provides a remedy where this is not the case & I must deprecate the emotive language used in the email. I'm not in any way connected with the BPA but I don't find the inherent anti-BPA stance helpful or justified. I agree that the words fine & offence are unacceptable; these are not criminal matters but it is not unreasonable to refer to penalties & contraventions as well as quoting regulations & authority. You go on to ask for copies of subsequent documents related to enforcement of the penalties. This is again a separate matter which is likewise monitorable by the civil courts. To me this is more evidence of bias. You seem to have reached your verdict in advance & are retrospectively seeking evidence to support it. I was some years ago a consultant to local authorities & others on parking matters, including enforcement. I'm no longer active due to age & health but I continue to maintain that parking regulation on & off street is in the public interest. I agree it has to be fair but that is a two way street & it is encumbent on those seeking to criticise the enforcers to be fair & unbiased themselves.
  19. Hi I'm new on here, but would like some help. I received a NCP Parking Contravention Charge Notice last Saturday for my ticket expiring. I had parked in a car park which you could either pay for 1 hour or all day for £3. I paid £3 and the machine displayed that I'd reached the maximum amount payable, so I pressed for my ticket and displayed it without checking it. When I got back to my car I'd received a Charge notice. I was surprised as I'd paid for an all day ticket. When i looked at my ticket it only recorded that I'd paid £2 and only given me 1 hours parking. I appealed to NCP and asked them to check their takings against their tickets for that day, they have refused my appeal saying its my responsibility to check the ticket etc and I have pay the fine of either £50 or £100 if i don't pay within 14 days. I don't think i should to pay the fine, but it looks like I'll have no choice as i don't want to end up in court etc, but i have no evidence to say that i paid the correct amount.....can anyone offer some advice please?
  20. I visit many residents in a residential home for the elderly folk. The residence is " advertised as Sheltered accomodation and Retirment homes for the elderly" However the residents have now aquired a new person who is 59 and is working full time. He goes out to work at 5 30 am in the morning and is bacjkaround 9 30pm. His works van is parked directly outside some of the residents flat windows and is restricting their views of peacful gardens. Many residents cannot go outside and this is all they have to look at. Also many residents a woken at 5 30 in the morning by the slamming of car doors when he puts his tools in. Some residents have gone to the extrem by drawing their curtains as they do not want to look at the advertising on this van and they cannot see any thing else but this van. Question One ) the works van is being parked on a private entrance to the home. Can he do this? Question 2) Surley as ths is a residential home for the retired he should not have been allowed to live here. (He is not retired and certainly does no need sheltered accomodation) If anyone con help with the legal side of this problem and you are able to help these elderly folk with this promblem you would be advise a s a p as they are in dispare.   21. Hi guys, (again),. My brother was has received a pcn for stopping on double yellow lines at Robin Hood Airport. He suffers from IBS from time to time and this can become very painful. On this occasion he decided to pull over and wait for his symptoms to pass, after taking medication. However, i'm a little unsure regarding Airports and double yellow lines. They state, that, ... .The alleged CONTRAVENTION was detected and recorded by Mobile Traffic Enforcement Cameras and that the reason was. .Parking/Waiting on a roadway where stopping is prohibited. The terms and conditions to which the Driver agrees to be contractually bound upon entering the roadway, are clearly placed at the entrance to the site and in prominent places throughout. Having "Reasonable Cause" that a contravention occured through a breach of the roadway terms and conditions and that a charge is now owed. MOTORISTS HAVE FOURTEEN DAYS FROM THE NOTICE ISSUE DATE TO PAY A DISCOUNTED CHARGE OF £60.00. If the charge is not settled within fourteen days of the Notice Issue Date then the motorist will be liable for the FULL CHARGE OF £100.00 Plus any costs incurred through debt recovery and or court action. Vehicle Control Services Ltd is an Approved Operator and a member of the British Parking Association and operates in accordance with the "Code of Practice for Enforcement on Private Land" Payments to be made to, Central Payments Office, Vehicle Control Services Ltd PO BOX 4777 SHEFFIELD S9 9DJ. Please advise as my brother is getting into quite a state over this and his condition has been made worse by all the worry regarding this. Many thanks David.

Hiya guys...new here and stumbled across this website when i was googling, heres the story..my father in law has just come back from his holiday in Hawskhead always goes to same place with the mrs, and parks up in the same place,, always pays his parking tickets and displays them...hes 1 of those people that makes sure eh deos everything correct an stuff,,, anyway...he parked up in this car park opereated by Parking eye,,,he put his money in....punched in his reg plate,,,paid for 2hours...got his ticket....displayed it and all was fine..(btw he left b4 the 2hrs he paid for was up) he came back from his holiday to find a notice on the mat saying he didnt pay and they had pics of his car coming n going from the car park...i saw the pics....its defo his car.. then he pulled out his parking ticket,,,,he had punched in the wrong reg for sum reason...not a clue why...brain fart maybe? hes 73 but normally very smart lool they want £60 by a set date or it climbs to £90 with a £30 charge added. what should he do? hes mega upset cos hes not 1 of them that doesnt pay his way or do anything wrong. was just an honest mistake...help please so i can reassure him and calm him down hes not 1 for falling for scams either but i said id check this out for him cos he barely knows what a mouse is let alone a forum for help bring peace to my life with an answer pleaseeeeeeee:|
  23. I act as a agent for a landlord, the parking area in complex has become an enforcement area, total time at property 10 mins, I went to pickup the pack which contains parking permit and day parking passes from tenants. Returned to car as warden was writing the ticket. What now? Regards
  24. can some 1 help me plzz i parked in a car park i have parked in there once befor there no tickret machines so 4hought it was ok was only gone for 10 mins got back 2 car seen there were about 10 cars with these tickets on says its PARKING CHARGE NOTICE so i ignoredit now i have aletter from then sayin i have to pay 150 pound now charge was 70 . .i bont have that kind of cash just dont know wot 2do???
