  2. Hi there, Just recieved my reconstitued CCA and covering letter back from Barclaycard. Few points they have stated stick out. They agree this CCA is not enforceable then they go onto say their rights still exist under the agreement and i should keep making payments. they are citing Carey vs HSBC and Phillip McGuffick as to why i should keep making payments. Hello Some advice please would be appreciated with regards to Credit Agreements and PPI I have a copy of my Old Egg Card Agreement dated 28/01/2001 - Amazed I kept it but its the only CC I currently have which is now with Barclaycard The first page of the Credit Agreement has a section on PPI ---------------------------------------------------- Limit x Interest and Credit Charges x Repayments x Your Repayment Protection premium is payable to the insurer at 69 pence per £100 of your monthly statement balance for the accident, sickness, unemploymen, life and serious illness cover you have choosen in accordance with the Egg Card Repayment Protection Policy document supplied to you The argument I am currently having with Barclaycard is they state that PPI was optional on the Credit Agreement, and I am stating the following No sign of the word optional against the PPI details on the first page of the Credit Agreement or maximum amount on the credit agreement I was made to feel that PPI was not optional once again after the on-line application with its pre-ticked box No where did it say interest would be added to the PPI I could only cancel the PPI policy if I took out a new credit agreement - this is now considered to be unfair by the FSA Are my arguments valid, I appreciate any comments and differing opinions, thanks in advance
  4. Hello people, I apologise for starting a new thread but I'm getting myself increasingly more confused by reading other peoples (forgive me I've just come off nights). I had a Barclays Student CC (lets call that CC-A) and also an Egg CC, which was sold to Barclays (lets call that CC-B). Both of these are still active with Barclays. I wrote to Barclays asking for information about the accounts which they studiously ignored for three letters but have finally got back to me. I am a disorganised soul so I don't actually have the details of when I took out the CC's but I think the CC-A was about 1998 and CC-B was about 2004 What Barclays have posted back to me makes little sense. . . . They only seem to have responded about the CC-B account (they sent a letter saying they are 'looking into' the other one) and have sent me two documents (separately), one is the original CC agreement for Egg, and the other is the standard agreement for Barclays. However neither contain any information about me, they are just generic, for example they don't say when I entered into the agreement and I was expecting them to. And neither say anything about PPI. What do I do next? I can see why people get companies to do this for them!! Many Thanks T
  5. I recently sent a SAR into Barclaycard as the starting point for a PPI claim. I received a letter back with details that I had PPI on my account and returning my own letter and £10 cheque. The letter noted (in summary) that my letter "was in relation to a claim for the sale of PPI" (my SAR letter made no reference to PPI) and that "this information is sufficient to enable... to progress a claim for PPI". I writing back and sending the cheque back asking for full details to be supplied. I couldn't help but notice though that the bottom of my original letter had been stamped with a large rubber stamp saying "PREQUAL". Does this suggest that they already believe I may have been mis-sold my PPI?
  6. Hi all, Some years ago I had major financial and personal problems. Managing to get myself on my feet again but am worried about this outstanding account. Pretty much all of my other debtors agreed to a one off payment to close my accounts after months of offers and writing letters. Egg did not accept my offer. I had been paying them a small sum each month ( as I had with my other debtors ) and then suddenly out of the blue, my account was passed to a company called Apex. I stopped my payments to Egg and waited for Apex to contact me. Nothing has happened for about 2 years. I checked on my credit file and although the account is in default and has been since around 2008, it shows as still being active and each month as no payments have been made, a D is shown in the payments table. I have just received a statement from Apex telling me the account is still outstanding but at the bottom of the letter it says for information only, no action required. In with the statement were a few photo copied flyers from debt management comapnies telling me to pay my debts etc and a ways to pay note. Im confused. I havent had any communication from Apex till now. I havent made any payments on the account for about 2 years. If the account is in default, will it automatically get written off after 6 years or does the account need to be closed to do this? Am I getting this confused with defaults on the credit file? I really dont want to get back in to the writing of letters again. The whole episode was very stressfull back in 2008 and made me quite ill. I dont want to go there again. I realise ignoring it might not be the best option but part of me just wants this to all go away. Head in the sand and all that.... The outstanding amount is only about £700 but I just dont have the money or the means to pay it off. Its taken years of careful budgeting to get where I am and I simply do not have the means to pay. Any advice greatly appreciated and received!
  7. Hello there. I'm new to this and have been doing a fair bit or reasearch to find out if i have a case for a PPI claim. I wonder if anyone has had successes with claiming PPI from egg and what justifications they may have used in their case. I have most of my paperwork for both my Egg loans. I initially took out a loan for £5473.90 in July 2005. This amount was made up of the loan of £5000, £473.90 of which was PPI. Interest for the term was then precharged on the loan and PPI credit figures. This loan was taken out using an online application. I took out a new loan for £8462.78 in Feb 2006. This settled the outstanding balance of the original loan and included an additional PPI of £1291.78. This loan was taken out over the phone. Interest was also precharged on the total credit figure of £8462.78. I actually dont remember the details on the website specifically or the details of the phoncall in which i agreed to the top up loan. I was however shocked at the value of the PPI when i received the paperwork but at the time was young and ignorant and accepted the terms. I really have no idea where to start and any help and feedback people have would be greatly appreciated. I guess a few burning questions i have are: - What justifications have people used to satisfy PPI claims with Egg online applications? Has anyone had experiences of the culture at Egg and selling PPI? I am aware Egg received a massive fine from the FSA, how may this affect PPI claims? Egg added the PPI sum and interest of the loan to the total amount at the start of the term, is this justification for a claim? I know Egg used pre-ticked boxes for PPI - has anyone had a successful claim using this a justification? How would the imlications of settling a loan that included an amount for PPI with a refinanced (top up) loan with a new PPI figure, esentially a quantity of the second loan should have been covered by PPI from the first loan and therefor a 'top up' PPI should have been sold. I can't remember is there was any sale pitch for the second PPI from the phone call where the loan was agreed. Has anyone had expereiences of this with Egg and cultural 'goings on' around this time? I have read through a few of the forums and Egg (now Barclays) seem to be quite keen to fight cases of PPI claims so i want to make sure that any letter drafted is clear and precise justifying any case there may be.   8. I'm still going through Mrs Sam's bank accounts and credit card accounts looking for mis-sold PPI. I have sent a SAR to Egg and they have finally complied with over 400 pages of information! Mrs Sam took out an Egg credit card back in 2002 which ran until 2008. During that time she paid an average of £30.00 per month PPI. I'm ploughing through the paperwork to see her signed agreement for PPI but I haven't found it yet - there appears to be everything else though. Mrs Sam cannot remember how it was sold to her back in 2002. Mrs Sam became ill in 2008. At this time she had her own business. Her illness has sadly resulted in her being unable to work. She has been on incapacity benefit since February 2008. She had to wind her business up at that time. She wrote to Egg on 22 November 2008 to see if she could use her PPI but did not receive a response. That letter contained a letter from her GP and her incapacity benefit letter. Due to her illness she did not pursue the issue until March 2010 when she wrote to Egg again. They did not reply to this letter either. She chased them in April 2010 and she finally received a response at the end of April 2010. Their response was that the insurance does not lie with Egg and she should have taken it up with the insurer. I do not understand why they did not reply to her letter in 2008 with that information. They said that this information was detailed in the document that she had read and agreed to in 2002(!) They also said that the PPI on the card was cancelled on 6 November 2008 as the premiums had lapsed due to her not making payments to the account. She was unable to make the payments due to her incapacity! They subsequently put the Egg account in the hands of their Collections Department and then to ARC. Neither of them were able to get any money from her (as she wasn't earning any!) and now the debt is back with Egg. They don't appear to be chasing her for it any more. So where do I go from here? I want to claim back the PPI payments which must amount to somewhere in the region of £2,800 before interest. What are the issues concerning her unsuccessful request for a payout on the insurance earlier? All advice gratefully received!
  9. I took out an Egg Card in September 2003, almost instantly transferred a balance onto it. For 12 months there was no 'Credit Card Repayment Protector'. Then all of a sudden there it was, now I know full well that I wouldn't have contacted them to add it on. Any idea why they might have suddenly included it? There was a 6 month interest free period, interest kicked in from April 2004. There doesn't appear to have been a specific outstanding balance that triggered it. Mis-sold? Seems more like it was just added on without actually telling me. Anyone seen this before? Many thanks Phil
  10. Can't make head nor tail of this PPI stuff and am hoping people can point me in the right direction. I took out an Egg loan in 2000 that I have now paid off. I had PPI but I no longer have any of the details. My first issue is whether 2000 is too long ago to count as claimable? If I can, can anyone give any advice as to how I go about getting things moving? I have messaged Egg to ask for some of the basic details of the loan some time ago but have never received a reply!   11. Hi all, I defaulted on a debt in 2001 with Egg credit card (approx £5600 and entered almost immediately in to an informal payment arrangement with Egg through Moorcroft. My initial payments after 2001 default started at £1 per month and in 2010 I was paying £35 per month. In Jan 2010 I received a letter from moorcrop saying enoughs enough pay full amount within 7 days or else. I sent them a CCA request Feb 2010 and and a request for a statement of account (which I have never ever had) continued to pay monthly £35. In april 2010 I received letter from Moorcroft saying their client/Egg could not at that time supply the document and there was no mention of my statement of account. At that time I then stopped my monthly payments as I dispute what is now owed. I have paid nothing since. To date I have received 170 phonecalls and 27 letters demanding payment from 5 different dca's. Today I have received a letter from Bryan Carter on behalf /ARROW and now Barclaycard who now own the debt saying that I should receive County court docs within 48 hours. Am I correct in thinking that the april 2007 ruling was not retrospective and that my case would fall under 1974 cons credit act. I.e. no CCA no court? I am doing my homework now as regards CPR etc as I intend to defend the case. Any advice and or comments would be greatly appreciated. I have all my copy letters sent/cca request/etc and letters received. I have never had a statement of account from Egg/Moorcroft/bryan carter regarding this account since 2001.   12. I'm currently working through all my my previous credit cards and reclaiming back my PPI and fee's. I SAR'd Egg and they sent me back lots of statements and some information about my account but they did not send me my account application, credit agreement or T&C's etc. The only confirmation I have of PPI is on my statements and in one of their internal account management screen shots that they have printed is shows 'PPI Indicator: 1'. Seemingly they cannot provide me with any evidence of how PPI was sold to me. I am certain that I did not take out PPI intentionally during my online application, I never did on any of my cards as I truly do not see the point of it, you can always negotiate with lenders on repayment terms if things get difficult, it's just another way of getting extra money out of consumers. In fact I have proof of me opting not to take PPI from my other credit cards (even though they have been charging me for it, but thats another story). More over this account goes back 4 or 5 years and ended up on a DMP with the CCCS. To be clear I During this time the account was having payments made to it by the CCCS (negating the need for payment protection due to a repayment agreement and 0% interest being made) but EGG were adding almost the same amount back onto the total outstanding debt in Payment Protection. Surely once the account had entered arrears and had defaults against it, then had special token repayment arrangements made on it, the PPI that I didnt want should have been voided as it would be impossible to use payment protection (lenders will accept token payments of as little as £1 through CCCS/DMP's if a the client has income difficulties). Where do i stand? Its most annoying that EGG have not provided me with any real evidence of how the PPI was taken out in the first place.
  13. I would be grateful if you could help me with my case. Things became difficult for me and I had to default on my loans and obligations. I had a loan with Egg. who transfered it to Barclays then Moorgate Britannica. I am registered with the cccs and have made the £1 to all bar these. I requested that they send validation that I owe them this money and the only response I have had is a court hearing. I appealed to the court and now have a Defence filed questionnaire. Have I done the right thing and what should I put in the questionnaire? Ps, I rang Moorgate this morning and I know I should have not to tell them that they are taking me to court through Earlswood and they said that I have to deal with Arden(Strange) I rang Arden (I Know) and told them that I had written to their solicitors and I had no response and they have now passed on the details to their legal team that will forward the stuff to me. Do you think that Moorgate have a legal claim to this debt and what should I expect to arrive in the post and will it be enforcable? Thanks.

I have recently made a successful claim for missold PPI from EGG I have concerns about the conditions they have placed on the claim payout Part payment by cheque and part into the account but long since defaulted and gone from CRA files, should i be wary of this payment into the "still open" account ? I have also done a SAR since the remaining amounts owed are charges and interest or penalties and i await an outcome I will scan and post the letters later today Many thanks
  15. Hello, I'm new to this website so apologies in advance for any poor etiquette. Last year Egg sold my credit card account (started in 2004) to Barclaycard. At the time the account was in dispute as Egg had been agressively rate-jacking the account. Because I had been writing to Egg to complain at one point I checked my account online and saw that the balance was £0.00 so I thought that Egg had accepted my complaint. However they had 'transferred' their rights and duties to Barclaycard who immediately started pursuing me for outstanding balance of approx £4500. I refused to enter into any agreement with Barclaycard as I believed my account with Egg was in dispute at the time they sold it to Barclaycard. Well you can imagine the following months. Barclaycard have sent every kind of letter - I've been contacted by at least six different DCAs all claiming to have some kind of right to collect the 'debt'. It's been pretty tiresome. Furthermore Barclaycard have registered that my account is in Default with the credit reference agencies. This particularly upset me as my credit rating - up to that point - was excellent. Also when you look at my Equifax file the default is stated as a default on a 'Barclaycard Agreement' - there is no mention of my Egg card agreement which was up to date and in good order when they sold it - the Egg card agreement has been erased?? So I requested a copy of my 'agreement' with Barclaycard under 1974 act and received a bad copy of my Egg agreement? and also they sent me their new terms and conditions which mad no sense as I had informed them I didn't wish to enter into an agreement with them - especially as their actions surrounding the Libor scandal showed them to be untrustworthy. So no agreement there. I wrote to Equifax asking for proof of the 'agreement' that they were saying I had defaulted on. In fact I sent them a very strongly worded statutory demand that they remove the information unless proof was provided as a precursor to my being able to take court action for libel. Equifax sent me an email saying they had spoken to Barclaycard and Barclaycard had told them the information was correct - So no agreement there. I am now nearing the end of a complaint with the Financial Ombudsman Sevrice regarding the above and this morning I received the following in an email from a FOS adjudicator: Dear Mr XXXX Many thanks for your e-mail and the attached documents. I have added the documents to your file ahead of a final decision by an Ombudsman. Generally businesses are obliged to report a true and accurate reflection of how an account is being managed to credit reference agencies. Whilst you have stated that the account is in dispute, payments have not been made towards the account for quite some time. Therefore, this has to be reflected on credit file. Barclaycard is not required to provide any proof of an agreement. As stated in my email dated 20 September 2012, the terms and conditions of your Egg account allowed Egg to transfer its rights and duties under the agreement to any other person or business. Egg transferred your agreement to Barclaycard and it is under this agreement which payments are due. If you do not wish to be in an agreement with Barclaycard you would need to pay off the outstanding balance first. It's the line 'Barclaycard is not required to provide any proof of an agreement' that disturbs me. How can the FOS stand up for impartiality when a bank harasses somebody for money without any proof of any agreement. Has anyone got any advice about how I can force/persuade the FOS to come to a fair decision about whether there is an agreement. Also I would appreciate any advice knowledge on whether there is an agreement. Is there one? What does it mean that Egg can transfer rights and duties when the third party (Barclaycard) are not named on the original agreement. Does my refusal to consent to enter into an agreement count for anything? I mean if Egg sold my credit card account to a criminal organisation I wouldn't be expected to contract with them would I? What is surprising to me is that when you look up Credit Card Agreement Law in google there is no wiki entry that deals with what kind of an agreement/contract a CCA is? Well - any help or advice would be hugely appreciated.
  16. Hi Ive have received a reply from Egg saying “After carrying out a full review of your account. I have etablished that you purchased the insurance through the egg website on XX Nov 2001 Our online sales process: - Does not require you to take repayment protecection insurance as a condition of obtaining the credit card. - Does not provide an advisory service - Required you to positiviely confirm that you wished to purchas this policy during the online application - Provided full terms and conditions of the policy and requested you read them before submitting” I was unhappy with this response particularly with the use of present tense and not past tense “does NOT require you to take repayment protection…” Can you please tell me my what the next step should be as I believ that the box was pre ticked or you could not go further unless you ticked the box. I have looked on the site and seen lots of answers but after reading so many Im a bit confuse. Thank you
  17. Hi, I've successfully made a PPI reclaim but I'm not sure if what they are offering is correct. The loan was for £7500 with £872 PPI added to be repayed over the term of the loan. The loan has been repayed in full but 15 months before the end of the loan term I entered into a debt management plan. Egg have offered me the interest on the premium paid plus the 8% compensation interest. They are not refunding the £872 premium paid as they claim this was rebated when the PPI was cancelled. I have the loan statements and I can't see any rebate listed, only payments I made. Arrears were cleared after 6 months and the loan was repayed in the normal loan term (54 months). The Egg loan PPI claim number is now fully automated and I can't speak to anyone, only write to them. Has anyone else had an issue like this? You'd think that if the case has been reviewed by someone then the decision would be correct s o am I just delaying getting the £526 they are offering by writing to them or is there a good chance they are hoping I'd accept and not question it? Any advice would be grately appreciated!
  18. Hi, Sorry to start a new thread but can't find any of my old ones! So, following on from my previous post which was something along these lines: I sent Egg my FOS Questionnaire and SOC and they responded very quickly with a "NO". I had some fab advice here and DX wrote me a template which I sent telling them to prove the box wasn't pre-ticked and that I could have continued if I'd un-ticked, respectfully refer them to the news article of them being fined blah blah. well the 8 weeks is up and still no reply to my "prove it" letter so shall I send a LBA or go straight to FOS?? It's only £300 so was hoping they'd cough up rather than me take to FOS. Citi paid me out and the PPI was same time and same reasons given. Citi and Egg are SAME COMPANY! even the addresses that I write to are exactly the same and the same person always signs for my recorded letters. Is there a template to send or is FOS my best course of action?? Thanks in advance
  19. Hi folks, I'm enquiring on behalf of my wife, we wrote to egg 6 months ago and they said we had no PPI. We were going through some statements and found that there was PPI and wrote again. It seems that Canada Square Operations are looking after this now and acknowledged that PPI was taken out. The thing is she did cancel the PPI before the end of the PPI term. The offer has come as follows. Total PPI premiums which you have paid £xxxx PLus interest on premiums paid £ xxxx Plus 8% interest £xxxx Sub total £xxxx The Sub total is quite a healthy sum but the next line reads as follows Less any previous rebate paid £xxxx Now this reduces the total by quite alot, the thing is she has received any previous rebates or had any money back when she re structured the loan a few years back. Is it the case of the total premiums paid is the total amount of the policy if you were to full fill the whole term of payments? And the said rebate was the amount left of unpaid payments as she cancelled it early and never did the full term. The offer that is left is quite good, is it worth trying to get the rebate back as it is worded ' premiums which you have paid' or is it just the case of how the policies work that i outlined above?? Also does anyone have a phone number to contact them as it seems strictly writing as i can't find a number anywhere. Many Thanks in advance. Olliepup.

Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, I hereby request that you supply me with any and all historical data in your possession which relates to me and I am entitled to under section 7(1) of the Act. If you store any of the older records on microfiche, please be aware that the Information Commissioner deems this to be a relevant filing system under the Act. As such, any microfiche data must be sent to me in fully legible and comprehensible form. Additionally, where there has been any event in my account history over this period which has required manual intervention by any member of your staff, or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my business with you.   21. Hi, Getting some money back from Egg - not much about £600 - but the clowns seem to be taking much longer than the promised 15 days. Cannot get through to anyone as it cuts you off and tried calling Barclays who are just rude. Know Barclaycard took over Egg but need contact details of the loan bit - email or phone that gets through!
  22. Hi After a lot letters Egg have finally sent me my SAR information. It appears that I had been paying PPI since I opened the card account in 1999. However, it mysteriously stopped without my having cancelled it in March 2005, I am not sure how I would have asked them to stop paying something I didn't know I was paying. I closed the Egg account in 2007. It says that I applied via the internet for my card, I cannot remember ticking any box saying that I wanted PPI. I was reading something about this box being pre ticked on the Egg website in the early days, do you know if this happened in 1999??? If so did this mean I was mis-sold? I have calculated the amount to be £2277 paid in PPI on my credit card so you will understand that I am keen to pursue this claim. Can anyone help me with my case, I have got this far with the template letters on this site, but just need a bit of help. Many thanks
  23. Hi, I used to have an Egg Credit Card that was taken over by the delightful BarclayCard last year. As BarclayCard have taken over my Egg Card, who do I put te request to for a SAR. How would I ensure the who ever replies send all details of previous Credit Cards, for exmple I think I had a replacement card due to losing one. Regards
  24. I would appreciate if anyone could give me some advice on an Egg Credit Card PPI claim. The card was taken out online in 2001 and ended in 2007. I have obtained a SAR confirming PPI payments however can find nowhere to indicate that PPI was ever requested. The screen shots show all the application details however there is no PPI box to tick yes or no. I have read about pre ticked boxes but I cannot remember back to 2001 - would anyone know whether a pre ticked box would show on the screen shots or should there be something to show it was selected. I have read about cases where PPI has been added later (from a telephone call). There is nothing in the SAR to show this was done. We would not have required PPI as both my husband (who applied for the card) and I work for the civil service with good sickness and redundancy pay. I am going to apply for mis-sell on this but I am expecting a rejection (after reading posts on here). Egg appear to often argue that the box was pre-ticked to say PPI was required - if they use this argument can I ask them to prove this seeing as there is nothing in the original screen shots. Thanks.

    Egg Loan - Help

    Hi, I had an Egg loan in 2001 which was defaulted late in 2002 for various reasons. The balance was around 3.5k. I have since then rebuilt my credit history and on checking my reports i am in good health and have been able to obtain credit. It is now 10 years on and i have not heard anything about this loan - what could have happened to it? Is there anyone i can contact to find out as i would like peace of mind.
