  1. Hi, I am trying to finally sort my debt out after years of paying StepChange. My vanquis debt went to CAPQUEST. I sent cca request but all I got back was my electronic application and terms and conditions. I read through this site and saw someone else had same problem I then sent a letter to them saying they have not supplied what I asked. Etc etc and sent the t&c's back. I used the letter that was on here Then today, 2 weeks later they just send me the same stuff again. What is my next step Thanks
  2. I have a card with a £500 limit which is around £600 at the moment. I have buried my head in the sand and ignored them for far too long. I set up a payment plan before it went out to an external debt collector (I understand IMPACT is the internal team) - the first payment of £58.00 was made and then it goes up to £118 next pay day. I have not missed this yet. It will be difficult to make this payment but I still want to make a payment. What is the best way of dealing with them? I have to say that they have been very patient with me when they didn't really need to be I am not looking to kick off or cause myself more grief. They offered me a payoff fee which wasn't affordable at this moment but will be in a couple of months. Another couple of affordable payements will let me get back on the right track. Any advice? Thanks
  3. Have had this card now for approx 8 months, with a small limit of £150. Have been fine with this manageable limit, until this past week. My card was very close to its limit on the last week of last month (July). As usual I made my payment when I got paid (last working day of the month), the payment having to reach Vanquis by 1st of Aug. This has never caused an issue previously, but as last months payday was only a day before the first, this month it has. I received a text message informing me I had to pay £29 immediately as I was over my agreed credit limit. I went online and saw that my payment has been classed as late (not received until the 2nd). Therefore I have been charged £12 late payment fee and £12 overlimit fee, apparently I had gone overlimit by £1 due to the Repayment Option Plan fee being applied £2.11(which I didn't even know I had!) On phoning them a short while ago, I was informed that I will have been notified about the repayment option plan and agreed (I have no memory of this), and that the applied fees for this month would stand. So I asked what the option plan did, and one of the options was to freeze the account. By now I was furious (unfortunately I have a very short temper with these CS morons), so I asked to do this. I would rather not have the card than face extortionate fees. I was then informed the only way I could freeze the account was if was ill, and could PROVE IT!. They would be sending out a claim pack which I must complete and return with a doctors certificate and not until they had received this back and processed it would the account be frozen. The amount outstanding now is £179.00, not a great deal, but all this has made so angry. Any advice/help would be greatly appreciated.
  4. Just received claim form from cabot for credit card debt, original creditor vanquis,I know I have only a short time to respond but I have a feeling that this debt may be statue barred. Can I say I am going to defend it and change my mind depending on the information I receive as in last payment made and on production of credit agreement and notice of assignment.
  5. Hi All, Does anybody have any information on online applications for credit cards? I know that as of 31/12/2004 a written signature is not required on a credit agreement for an online application, but how does this affect the copy of the CCA that the creditor has a duty to supply under S78? Do the T&Cs still have to be within the four corners of the CCA? Vanquis and Lowell don't seem the think so. They have just supplied a screenshot titled 'Digital Signature Application Details' along with a generic copy of the T&Cs which states that it is a 'Credit Card Agreement Regulated by the Consumer Credit Act 1974'. Any ideas guys?
  6. I am having a problem with a vanquis credit card, not so much the card but the r.o.p they have been charging, I never use to check my statements ( MORE FOOL ME ) just paid my account, but a couple of months ago i checked it, to my horror they have been charging me r.o.p ( their version or ppi, but they don't actually pay anything if you are in differculty) I know for a fact, the times they have phoned offering me this I have point blank refused it. When I rang them to complain about this extra charge they said I agreed to it back in 2012, so would not refund me. But they won't send me the supposedly recording they have of me agreeing to it? I have sent off a letter for a subject access report with the £10 charge and am waiting to here back. I have refused to pay my account until they refund me. They are bombarding me with phone calls - which i just hang up or not answer. I don't want to default or not pay the card, But i refuse to pay point blank, something i did not agree to or wanted. any advice on where to go from here would be great thanks
  7. My credit limit is £150 I got a cash advance on the 17th June. I then paid on the 9th July £147.17 as that was what I used on card so paid in full. my next payment I used £149.94 so I paid that in full through on phone to them on the 5th Aug. I still seem to be in debt with them of £72.68 according to the balance carried forward. I am literally confused as I thought if I paid in full what I use each month I'd owe nothing.
  8. I am having a problem with Vanquis. I have had a card for nearly six years. Recently I havent been using it at all and wondered why my payments were not coming down re my interest etc. I looked into it and found that I was being charged insurance. As I never take this out I queried it. They sent me a letter saying I had taken the insurance out in 2008 as per a phone call. I asked for a copy of this phone call which they eventually sent and I have not taken insurance out on the phone call. I am having a terrible time with them cos although the insurance is cancelled they want the payment of insurance from me, although I have paid I have taken the insurance off. They have put additional charges on my account. I have taken the step of going to see a lawyer as I cannot get anywhere when phoning them. They are really not interested and cant seem to see that what they have done is so wrong. I cant believe they said I took this out then sent me a copy of the phone call where I have refused.
  9. Hi All I need some help with Vanquis bank. I had a credit card from Vanquis for a number of years. After a divorce I went off the rails for a while. I have thankfully sorted myself out and Vabquis debt collectors have caught up with me. my credit limit was £250. I went over this limit and the debt was approximately £300.00. After the divorce I never paid them. Stupid, I know but i wasnt thinking logically. the debt had gone from £300 to a huge £975.00. This is a combination of their PPI, Purchase interest (Although id made no purchases) etc etc. What can i possibly do about this because i feel these charges are unfair. Please help
  10. Please accept my apology if this is not in the right forum. 2 weeks ago I applied for a vanquis credit card online and on 30th of December last month I got a call from vanquis asking my details and setting up direct debit, also adviser asked me if I would like a transfer to my bank and I said no, then he said congratulations I have been accepted and will receive my credit card with 7 working days (I am shocked at this as my credit rating is not that good) but just wondering if anyone can answer these questions for me. 1. Does all this mean I 100% been accepted? or can they change the minds and cancel/block my card? 2. How long does it take to receive card and pin? 3. I understand Vanquis is owned by provident? however when I was living with parents 3 years ago, I got a loan from provident but couldn't pay them back as I was sanctioned by Job centre, would this go against my application so they could cancel it straight away? or has anyone got a debt with provident and still got accepted/card? 4. do I need to pay my bill when my statement is produced straight away to avoid late charges/intrest ete? Any help would be great, I got this card to build my credit rating and also not buying any expensive things on the card, just a few items like a dvds from amazon, and shopping at tesco. I also going to look after this card and make payments on time. So any advice would be brilliant, thank you.
  11. Hi all, About 3 1/2 years ago my partner left me and my baby twins as I was alone and not working the only help I could get was from vanquis, I applied for benefits but they took months to all kick in and we had to eat in the meantime. various things happened, washing machine died a death, needed new fridge, had to move house due to mould problems so the credit card was used. One of my children has a chronic life-limiting disease and I get carers allowance. The problem is, the interest started piling up on the account, and my repayments weren't denting the total balance. I panicked and activated the repayment protection thing which has frozen the account and stopped the interest being charged. The problem I'm having now is that I can only do this for two year, and I'm coming to the end of the two years and will still have £2,500 approximately, to pay them back. I've been combing the internet for what to do but the only advice I can find is about debt management or ivas and the like. I don't have any other debt, just this. I don't know what to do, obviously I want to pay the money, I don't expect to get out of the debt. i used the money I should pay it back, I'm just worried that my payments will never clear the interest and it will get more and more out of hand. Please help!!
  12. Really need some help with getting rid of my Vanquis Credit Card please. Long story short because of a few missed payments a few years ago and Vanquis being very unhelpful and adding on loads of charges I owe over £700 on a £250 limit even though I have been paying them £25 per month for the last few years it hasn't made a slight bit of difference, my balance just keeps going up and up and I've had enough now. I've requested copies on all my statements, t hen tried claiming back all the charges on my account plus interest with totalled £1300 and got a refusal letter. I've also requested a copy of my CCA which has just turned up this morning and its just a digital print out from an internet request I did on 3/3/2007. I'm not really sure where to go from here, Impact have sent me a letter saying if I don't pay the over limit amount they are going to default me. Is there anything else I can do? At a push I'm willing to offer them a settlement amount just to make them go away but I'd rather not as they've had enough money from over the years.
  13. Hello, I am really angry right now, and I hope someone can tell me what to do next, I took out a Vanquis card about a year ago to build my credit rating, I have never gone over-limit to my knowledge. They have just put me over-limit and added a charge. What's worse, they have added charges due to be issued on the 16th (statement date) but they have added them on the 14th, putting me over limit again, even though I will make payment on or before the 16th. A few questions 1.What can I do about this, considering I have proof they have added the charges before the statement date?. The monthly statement balance carried forward is showing the amount with the 16th charges put on - which will be paid before the 16th! From what I understand this won't show up on my credit file in any way, is this correct?. Thank you, hereigo
  14. If I have defaults about 5 years ago, what success would I have applying for a Vanquis card to improve my credit rating? Thanks is advance M
  15. To cut a long story short, had a successfully completed IVA from 2005-2010 took out a CC with Vanquis in 2011 to help repair my credit rating, barely used it all the time I had it. I've got an unblemished credit record since a year after ending my IVA and have never defaulted on anything. I decided to close my Vanquis account on 10/2/14 by telephone after doing a balance transfer to another card, therefore not owing a penny to Vanquis. I also cancelled the ID Protection & Repayment Option Plan at the same time...they didn't do as I ask at all. I am now stuck in the trap I have read so many other people are in whereby Vanquis keep adding fees, interest etc until the account is settled, but no matter how much I pay, it never seems to be settled, so they keep adding more. Since 10/2/14 I have paid the following to settle the account: 19/2/14 - £40.65 25/2/14 - £6.00 13/3/14 - £22.98 10/4/13 - £10.00 Today, they rang up a few times asking for an outstanding amount of £1.07 but each time I try to discuss the account with them, they just hang up! I have written a letter demanding that they close my account, I have also enclosed a cheque for £10 and enclosed my Vanquis card all cut up. I will send it signed for delivery. Other than that, I don't know what to do, they are just forcing me to give them money each month. Any advice?
  16. Hi I got a Vanquis card a few years ago, and (I say this reluctantly) I've been largely happy with it. For the most part, I used it only when necessary and paid of the balance each month or as soon as possible. I recently started a business and used my card a lot in the initial period to help with start up expenses. I reached near my max of £3000 and stayed there for a couple of months. I've just paid off my balance in full and asked to close the account but have discovered that I am being charged interest on my last months balance, even though it was paid before the due date, and I won't be billed for that until the end of next month. I then have to wait a further month to make sure I have a zero balance before the account is finally closed. I've never come across this before, I closed a cap1 card a while ago, paid off balance and that was that so what are Vanquis playing at? Just had a thought, if I wait for them to bill me will they charge me interest on the interest the following month?
  17. Hi, A bit of background history. I took out a Vanquis card about 4 years ago, 2 years ago I got into financial trouble and couldn't afford to repay all my debts, everybody except Vanquis agreed to let me pay a reduced sum for a few months to get back on track which I have done. However, while trying to repay everything Vanquis were getting a payment each month but not always the minimum payment and as a result the debt on the card spiralled with missed payment charges, then over limit charges and any other charge they decided to add. I will be honest and say that once the minimum payment got so high that there was no way I could afford it, I stupidly made the decision to stop paying them and concentrate on the other debts (1 bad debt as opposed to 4 bad debts is how i looked at it). In the past year or so I have had a couple of letters from Capquest saying they wanted the money etc, I just put them to the side and forgot about them. this weekend I get a letter from Drydens Fairfax Solicitors saying. "We have now received instructions to issue a claim against you in the County Court to recover the sum outstanding. It is not too late to stop the claim being issued, please call us on 0113 823 3386 or if you prefer write to us at the address below. "(The address is Capquest) They then have a paragraph titled: Information about our claim In here they then list the pre action conduct and how they intend to prove to the court the money is owed. My question is, I do admit I owe the money and do want to repay it so am not looking for a way out, but I do want to try and get it reduced due to the repayment protection policy i had at the beginning that did not benefit me as I was self employed so cancelled it after a few months and also all the charges added to the account. I am sending an SAR to Capquest but wondered if there is any way I can hold Drydens off issuing a cliam as they only give me until the 21st Jan to pay or advise of a dispute, otherwise a claim will be issued straight away. As the SAR takes 40 days that takes me way past the 21st, but I don't want to write to them and let them know that I am requesting the info incase they see that as a trigger to fire of the claim before the info comes through, on the other hand I want them to hold off. I was thinking of writing and offering them a monthly offer (it wont be much as I am self employed, made a loss last year, going to make a loss again this year, get housing benefit and tax credit with no real income) don't think they will go for it, but by making an offer do you think it would it then open dialogue with them enough to hold off claiming? I hope I have explained what I would like to happen, I am not very good at explaining things Any advice appreciated
  18. I have a debt with Vanquis which I could no longer afford to meet the minimum payments due to overtime being cut at work so have less money coming in. Debt has been passed to Mackenzie Hall and they phoned me last week. I offered to pay £20 a month by standing order starting 1st Oct, they accepted and they gave me their bank account number and sort code to make the payments to. Fast forward to today and I receive an email from Lowell Group regarding the same debt demanding full payment now or to contact them to arrange a payment plan. Did I not just arrange a payment plan with Mackenzie Hall last week? Are they the same company? I don't want to make payments to one company and have another company chasing me saying I haven't paid.
  19. I'll be as brief as I can. Vanquis incorrectly applied an over limit charge to my account in 2009, which took me over my agreed credit limit of £1,000. In 2010 I logged a complaint with the FOS, they advised me to take further steps before they would consider the case. In 2013 I was able to offer the FOS proof that I had taken those steps and they took up the case. Throughout this period until currently I have maintained the minimum payment to Vanquis. The officer dealing with my complaint requested Vanquis return all late fees and charges accumulated as a result of those accumulated fees, this request has been ignored. It is now waiting for consideration by the main Ombudsman. During this complaint it was noted that Vanquis had charged me ROP, even though I had never agreed to it. I had to go through their complaints process with this first, before the Ombudsman could look at this issue. Vanquis adjudicated that I had taken out ROP and they had listened to a phone call with me stating I agreed. When I pressed for a copy of this phone call, they suddenly said they had made an error there wasn't one, but I must have agreed to the ROP so they would not refund, but would now cancel it in the future. This complaint has now also been taken up by the FOS also. I recently SAR'd Vanquis to be given a lot of garbled scene print outs which I could not make head nor tail of. Copies of one line recordings of phone calls, which haven't noted the involvement with the FOS at all. Several weeks ago I also sent in a request for a CCA, again Vanquis have breached that request and sent a blank copy of an application form with no attached prescribed terms and conditions. Today I have notified them by recorded post that the account is in dispute. The over limit charges and resulting interest applied since 2009 have taken the account to double its limit, the current monthly payment is just over £100. As I am managing to deal with the above issues. But an interesting development occurred in December 2013. As soon as Vanquis were requested to return the over limit payments and interest, they began lodging the amount of credit usage on my credit report. Up until December the amount was always listed as zero. Bare in mind this account has been over limit since 2009. The account is still listed as satisfactory. But their recording of my credit usage has hit my credit in to the FAIR region, where it was excellent before - I have no other outstanding credit. It was only when the Ombudsman contacted them about repaying the charges, that they began recording information - this appears to be quite a vindictive course for them to have taken. I have contacted Credit Expert on two occasions to add dispute reports to the account, they have contacted Vanquis who will not agree to this. I have asked Vanquis to stop processing my data - although I doubt they will take notice. Does anyone have any advice on how I deal with Vanquis recording with the Experian?
  20. I am going to be putting in a claim with Vanquis for the charges and ROP that they charged while I held the card with them, I have looked and am finding it difficult to see if there are any recent(ish) claims that have been won so I can try and swat up on the likely tack. Anyone know of any claims that have been won against Vanquis?
  21. just got home from having a puncture on my mobility scooter lol, and came home to find that Vanqis are having a bop now ffs lol.... i sent in all required information to them recorded delivery ( i have proof of delivery and signature) disputed the excessive charges currently (£400)+ i do have repayment option plan and they have now said they will respond to my complaints for refund within 56 days, so using this snippet of info if i now get a DCA write to me i wait 56 days or near enough to reply
  22. So im on JSA and applied for an argos credit card direct from a link on the argos website and shortly after got a phonecall and sure enough believing this company to be argos went ahead with it and got a 250 credit limit with a 'Vanquis' credit card with argos written on it... Anyway being a typical 20 year old i near enough maxed the 250 limit out within a few days although within my limit this was 2-3 months ago, I paid over the minimum payment fee for the first month and everything seemed fine with it , Although this month they tried to take a direct debit of £11.27 from my bank without me having any money in there even after me already paying them £55.00 this month so the payment was reversed and now i have £72.69 charges including minimum payment a hell of a lot considering my minimum payment should be £11.27! Ill write down the charges that were applied here: 25/03/14 TESCO STORES - 19.50 03/04/14 PAYMENT REVERSAL 11.27 04/04/14 PAYPAL FLAVOURWARE 11.99 09/04/14 BILLED DEFERRED FINANCE CHARGES 6.76 09/04/14 PURCHASE INTEREST 8.02 09/04/14 REPAYMENT OPTION PLAN 3.57 09/04/14 UNPAID ITEM CHARGE 12.00 09/04/14 OVERLIMIT CHARGE 12.00 Within this month i made 55.27 in payments although my minimum payment was 11.27 Now my balance has gone from being within credit up until the payment reversal because they tried to take minimum payment from my bank account to 30.29 overlimit ( 280.29) from around (240.00) that it was beforehand although they didnt take a direct debit in the previous month where i also had a minimum payment which they DID NOT try to take. Now they are sending me 2 letters a day and are expecting to pay the 30.29 overlimit charge as well as a new 42.40! minimum payment!!!! Which is a far cry from the 11.27 that it was supposed to be they are expecting me to pay £72.69 in payments for one month just because I had already paid them 55.00 in that month and they tried to take a further 11.27 through direct debit is it just me who sees this as unfair!? Anyway i called up and gave them some grief and they hung up on me! I then got my mum to call and speak on my behalf which also didnt help the slightest is there anything i can do here because i really feel that they are punishing me for paying and i cant really afford to be giving them £70 something pounds being unemployed and on the dole, I have other credits which are exellent service and not absolutely ridiculous like vanquis and was very naive when going into it as im still only young , any advice on what i can do to help myself anybody?
  23. If I purchase something from PC World and it is on a buy now pay in 6 months, would this go on my credit report? Thanks is advance M
