  1. Had a letter, 17/10/12, from Cabot saying they have bought my debt I have from Lloyds (26k). I signed up for the loan on 19/10/07 (are the dates significant?) and pay £10 per month (agreed with Lloyds) after losing my job 4 years ago. Am I now at the mercy of Cabot? Is it worth sending a CCA? or just start paying them the £10?
  2. If I own a property with a sibling, can a solicitor who asserts that I owe them £16,000, get a court order to force the sale of the property? Thanks
  3. I recently ordered some goods online, selected the correct address etc & paid for the goods including p&p charges. The money was debited from my a/c & I received confirmation of my order. Then I got this email Many thanks for your website order. Due to the weight of the items we will need to send your order in two parcels which would mean an extra £9.95 postal charge We could not agree resolution, my stance is that they accepted my order & took payment therefore owe me the goods, their stance is that unless I agreed to pay the extra charge, the would cancel my order & refund my money which has now happened. Can I pursue compensation for breach or contract? This might seem petty but because of the messing around, items I ordered for xmas will now not be delivered in time.
  4. Just received letter from MBNA stating they have sold debt to Arrow Financial under a Notice of Assignemt. My questions are Do I acknowledge debt to Arrow Global Can I ask how much they paid for the debt? Is it true that I have basically settled my commitment to MBNA in settling their balance (eve tho Arrow Global have paid it) I have no agreement with AW. Due to financial difficulties I have been paying MBNA £20 without misses for over a year now and the balance is £3450 Any advice please.

  7. While we all know an OC will assign when they can't be bothered to handle the debt themselves, and we end up dealing with a DCA. The entitlement to do this is usually written into the original agreement. However, even when they assign/sell off the 'rights and duties' to a 3rd party..does that 3rd party also inherit the right to sell off the debt to a 4th party, with all the rights and duties ? The reason I ask this is that where the Agreement defines 'we' and 'you' , the 'we' is described as the name of the OC (Barclaycard for example) not 'and/or' any subsequent 3rd party. This seems to me to state that the legitimate right to assign is solely the right of the OC. If the reassign rights were meant to be transferable then wouldn't it say 'we' is (name of Bank) or any company we have sold/reassigned the rights and duties to ? Where people are dealing with a 3rd, 4th or 5th DCA...is the process where one DCA sells to the next, or do the DCA's always return the agreement back to the OC for them to sell on again ? Has anyone any experience of how the process works ? In addition, if the OC sells to an Agent, then the Agent sells to a DCA...does the Agent have the right to sell too, or should they return the agreement back to the OC for them to deal with ?
  8. Hi All. I'm wanting to sell my house as I am moving overseas in the next 2 or 3 months but have a few problems with debt and negative equity. I have 3 charges on my property as well as my mortgage. Any offers I will get for my house will not cover the mortgage repayment and these charges as well. What are my options? Will the companies that have charging orders block the sale if they aren't going to receive what they are owed? Are they likely to accept a reduced amount as a full and final settlement offer before I sell?

I am pursuing a PPI claim and received a letter saying the lender has found my agreement and as it was a postal app with the box ticked and so it was non-advised and therefore I have no grounds for a claim. I may have ticked the box but the fact that even if I did I still don't actually know what the PPI covers me for, whether I would've been eligible to claim on it if, what I was excluded on and whether or not there was a different insurance on the market at the time that may have been better suited to me. If they say they have the postal app with a ticked box requesting insurance, is this the end of the road for my claim? Many thanks
  10. Hi all I am new to this and would appreciate any advice. In short i had mortgage problems due to my marriage breaking down in th emiddle of the GFC. I also worked as a recruitment consultant and lost my job. This all started withme falling behind with my mortgage due to losing my job. I secured a new position and informed Hl Interactive. They responded with a court date to start repossesion. I called and they said the only way to prevent this was to pay the arrears over two years. They told me no need to go to court as if i agreed to pay back the arrears 6 months @ £1200 - £7200 over 24 months I would lose my house. I asked about capatilising and to extend over the period of the loan as they would accept no less. In fear I agreed and had to take a job over seas in Australia to meet the costs. Six months after this last June I had a flood at hoome and had to pay £1000 to fix it. I called HL and they said to put a budget sheet in and they would review it. They continued to threaten repossesion and demanded more money. I stopped trips home and have worked 7 days a week for the last year. I have managed to get infront of the possesion order by defaulting on credit cards and loans. Due to the stress and missing christmas with my daughter I put the house up for sale. The property has sold and am awaiting exchange. The problem being that now despite 4 letters from my solicitor they have failed to give a settlement figure. Emailing them was difficult as the info email bounces back. I eventually found the CEO's email and emailed him. My frustration is that due to bad credit I will not be able to get a mortgage. If they had not miss led me in the first place about the repayments I would not have suffered as much as I have this year. I have lost 4 stone in weight through worry and barely enough money to feed myself. If anybody can give some advice it would be most appreciated. Scott
  11. Hi all, Sorry that my first post here is a question - I hope I'm in the right place I ordered a thermal binder through an Amazon marketplace seller a few weeks ago. The seller sent the wrong item, so I asked for a refund. They instead sent along the correct item, but I had already purchased it elsewhere, so I pressed the issue and demanded a refund, which I have received. In their last e-mail they made it clear they did not want the two items back - they asked me to destroy them. My question: I have made every attempt to return the items to them, but they explicitly said they don't want them back. Destroying and disposing of them will cost me money. Are these items now my property and can I sell them, for example on eBay? Thanks so much in advance to anyone who can advise me! edit: After looking around some more I suspect this may have been better on the "general consumer issues" forum. My apologies if this is the case. I'd be grateful if an admin could relocate it if necessary.
