Sadly yes I did. I (stupidly) thought that as I had paid and it was a simple mistake that it would be quickly resolved. How wrong I was.

Thank you very much, all the above completed bar submitting the defence. I see you say keep the details of the defence brief, would you make reference to the fact that a space was paid for and it was a mistake imputting the reg on the app? Pointing out they didn't actually incur a loss?

What is the claim for –
1. This Claim is for a breach of contract for breaching the terms and conditions set on private lane.
2. The defendants vehicle *******, was identified in the Providence Street Pay & Display Car Park on the 17/11/2022 in breach of advertised terms and conditions; namely parked without purchasing a valid Pay & Display ticket for VRM. At all material times the defendant was the registered keeper and/or driver.
3.The terms upon entering private land were clearly displayed at the entrance and in prominent locations.
4.The sign was the offer and the act of entering private land was the acceptance of the offer hereby entering into a contract by conduct.
5. The signs specifically detail the terms and conditions and the consequences of failure to comply, namely a parking charge notice will be issued,
6. and the defendant has failed to settle the outstanding liability.
The claimant seeks the recovery of the parking charge notice, contractual costs and interest.

I have this morning received a claim form from "Money Claims online, County Court Business Centre, St Katherines House, 21-27 St Katherines Street, NN1 2LH. I assume I have to fill it in stating I intend to defend the claim?

Its says if I dont respond they will issue legal proceedings, is it time to hold my nerve?

Hi,
I received a PCN for the above back in November.
I appealed both to the operator themselves and then to the independent appeals service (I really wish I hadn't after reading this site!!)
The circumstances are that I paid for parking that morning via the "Connect Cashless Parking" App.
Sadly in my morning rush I simply clicked the wrong registration on the drop down menu and put in the reg of my other car.
I appealed because I figured that as I had made an honest mistake and HAD actually paid for the space that they would see that and accept.
Sadly now I know better.
I did provide the receipt showing I paid for a space.
Ironically I paid for a full days parking that day but left after a couple of hours because I had to collect my ill daughter from school!
I have now received a "Letter Before Claim" so was hoping someone could advise me on what my next move should be.

Good afternoon all,
So to update, I was served court papers to attend Wakefield Small Claims court on 23rd January 2024. I had booked a day off to deal with and prepare the admin for this.
Today, I received a Notice of Discontinuance from Excel. I'm so happy, I just wanted to say thank you to everyone on the thread who offered their time and helped me. A donation is on its way. Thank you all once again!
