  1. Good Afternoon,

     

    This is the recent reply received by Direct Auto Finance, rejecting the PPI claim.

     

     

    They also state due to the time i took out the agreement i cannot complaint to the Consumer Ombudsman.

     

     

    Does anyone have any advice or know if i can progress this?

     

    To confirm this debt was sold to Go-Debt,

    i have re-paid all vehicle costs to go-debt previously

    (I know please dont say anything but this was before i got a grip on my finances)

     

     

    Go-Debt are still chasing this debt but the amount only relates to the PPI aspect of the agreement.

     

     

    I feel it a bit wrong i am trying to reclaim PPI on a debt i never fully paid in the first place but i am simply looking to use this to close down my account with Go-Debt and stop them chasing me.

    Im just a little scared as i don't want it to go to court as i have been working so hard on clearing my file,

    also my job relies on no CCJ's now cannot afford to have one registered against me.

     

    I have been chasing the OC (Direct Auto Finance) in regards to the PPI

    they were unable to find my account and asked for more details,

    i supplied them and did not hear back so chased them again via recorded delivered last week and currently awaiting a reply.

     

    At the start of the year when i reclaimed some other PPI i was told that due to the date the agreement was signed they could not chase this PPI as it was before something came into effect (apologies cannot remember the exact wording).

     

    I have not yet started anything about reclaim from the Debt Management Company but will have a search here to see how to get the ball rolling,

     

    are you aware if anyone has been successful yet in a reclaim from Debt-Line?

    I have now received the attached from Go-Debt & TBI.

     

    Would anyone be able to help me draw up a suitable response?

    I am not entirely sure what the letter means,

    i know its a scare tactic but not sure what to do now?

     

    In a nutshell i have paid of most of the outstanding,

    but have now stopped paying the monthly repayments now i am getting back on top of my finances.

     

    The outstanding is currently around 1,400 which is the amount of the PPI the contract states

    (was told i must have PPI upon taking out that contact)

     

    sent SAR to Go-Debt and received a reply.

    I have sent a SAR to the original creditor at the same time but they were unable to find my account,

     

    i sent them further details they requested but nothing yet received,

    i have wrote to them last week to chase this up and i wanted to complain about the PPI aspect.

     

    I have also been advised that the agreement has the deposit coming off the insurance part of the agreement which it should not do, does this make it invalid?

     

    This agreement is not showing on my credit file but really unsure how to reply and what to do now as court is mentioned and don't want anything bad on my credit report as i have been working hard over the past few months to get this cleared up.

     

    Both the attached letters were received a few days apart, at a glance looks like 2 different companies but resisted to the same address.

  4. I have sent the below to NCO om the 19/08/16 and received the reply below, the CCA Agreement received was not a signed copy. Where do I stand and how do I reply?

    In regards to your recent letters, most recently dated 22nd August 2016.

     

    You have stated that you have now completed the CCA request and that i must arrange re-commencement of payments. The CCA request has not been completed as you must provide me with a true SIGNED copy of the credit agreement. This has not been received. Also the unsigned copy you have sent me has a date of 23/04/2016 on it, this is 3 months before the account was opened?

     

    I also have concerns around the credit file entry as you have this down as an Open, up to date account (Not defaulted). This entry on my credit file is showing as opened with Arrow Global on February 2013? This should be down as an account which was opened 09/07/2007 with the original creditor with a default date of at least January 2011. I have able to prove the account was in default then as payments were being made by my Debt Management Company.

     

    I would like you to treat this as an official complaint as all the letters / emails are becoming tedious.

    Thank you for your recent correspondence, the contents of which have been duly noted.

     

    In reference to the recently provided documents, when the request is generated we cannot guarantee that the documents will be the signed copy, however this is a copy of the original document. As such we have satisfied the request following the information provided.

     

    With regards to the a settlement offer, we have previously discussed this and an offer of £652.29 was made. This offer is valid until 14/09/2016.

     

    No interest or charges are being applied.

    Ref Debt Line / Charlton Lawrence - Sorry for sounding stupid.. whats the hidden F&F Pot?

     

    And with NCO I assume I can go back to them and and reject the CCA claim as its not signed / an Online agreement? If so are there any useful templates available?

     

    I also want to go back to them and get them to change my credit report correctly as its currently global arrow and not as a default but if it was reported correctly will soon drop off my credit report as a default.

  6. I would have applied online as far as I can remember,

    I can't recall ever signing an agreement.

     

     

    Also the date on the bottom of the agreement is before the account was opened according to the statement

    but not sure if that is the document version date

    but it did have my account number in the footer on the left side

    which I have blocked out prior to uploading.

     

    The DMP was with Debt Line who then changed to Charlton Lawrence.

     

     

    I stopped using them earlier in the year when I got a grip of all my finances and began challenging, etc.

    NCO have now responded in 2 different letters received today (attached below)

     

    1 - The Agreement is not signed - They do also state now I have this I need to re-commence payments, is this correct as they have not produced a signed copy of the agreement? If so how shall I respond?

     

    2- The statement refers to the default date as the 19/12/2012 however I do not believe this is correct. I have statements at home from my old Debt management company that dates back to at least March 2011 where payments are being made to NCO for this account. Am I correct in saying I would not be paying NCO in March 2011 had my account not have gone into default?

     

    Any advice would be appreciated.

  8. Sorry for the delay - I was waiting to be sent the information from them.

     

    They have responded with the below but i am not 100% sure the details are correct/confused by the details.

     

    The account was opened in 2007 and i believe it defaulted shortly after before 2010.

    They say it went into arrears in 2013 but i was already making payments though my debt management plan then as it had defaulted?

     

    The credit file states it as an open account with only 1 late payment (last month) not as a defaulted account.

    This is why i am worried now as if i don't not make payments will negatively impact my file

    i do not believe this account should be on there in the first place.

     

    Should this be recorded as an actual defaulted account using the correct default date

    as if so i believe this happened before 2010 and would have dropped off my credit file by now

    and the CCA request is still outstanding as i sent this to them back in April

    so cannot see them producing this any time soon.

     

    If i am correct this account should be changed and then drop off my file but i am not sure how to deal with this?

    new thread was aimed directly at the credit file aspect so thought I needed a new thread.

     

    A lot of people are saying not to worry as it already defaulted

     

    but I asked again as I am slightly worried as it is not showing on my credit file as defaulted but shows as a normal account;

    which is now showing a missed payment as I held it due to the CCA request.

     

    Attached is a screenshot of this.

     

    It does not refer to it as "Defaulted" like my other account,

    always stated "Up To Date" until last months report.

     

    I have been working hard over the past few months and my report is looking much more improved however do not want this to impact it so just looking for advice?

  10. I have been making payments previously to NCO Europe for an old debt with Littlewoods.

     

    However i have recently been getting more traction on my debts and fighting where able.

     

    I have a current CCA request outstanding with NCO Europe

    and they have acknowledged receipt and my account states "Hold" on their online portal,

    and i have a letter stating account is on hold pending documentation.

     

    I have not been making any payments since the original CCA request was sent earlier in the year

    however today checked my credit file this debt is showing as Global Arrow not NCO Europe

    but is now showing as a late payment for last month.

     

    Are they allowed to recored it as a late payments my credit file whilst my account is on hold and have an outstanding CCA request?

  11. The original debt is with littlewoods,

     

    I was making monthly payments through a debt management plan

     

    but took managed to sort most myself now after a PPI payout

    and coming to settlements with ones that have provided CCA information.

     

    only a few outstanding left to deal with myself and this is one of them.

     

    Although NCO is showing as global arrow on my equifax report, it does not show as defaulted?

    It states upto date

    detailing the payments made though my DMP that has now ended.

    I'm just not sure where to go with this one?

    Can I ask for some advice, I have sent a CCA request to NCO Europe and sent a chaser as had not received a response. They have sent the below.

     

    Do I need to make payments and can they reflect this negativity in my credit report until they supply the requested info?

     

    Would anyone be able to advise how I respond/any action I need to take?

    I was led to believe my account had to be put on hold during this time?

    - i have hit the DMP with the SAR ,

    this has been received and posted in post 27

    although I'm not really sure what i am looking for and if there is anything i can use in there.

     

     

    I have also sent one to DAF.

    In the first reply from them they could not find the agreement so provided the vehicle reg.

    They have now sent the attached.

    They are requesting a signed copy of the request,

    I do not really want to provide them with the signature so not sure how to proceed?

    Anyone got any ideas?
