  1. Ok thanks, that makes me feel a little better :)

     

    I have just had a thought,

    anything I send to them (going to post out letters recorded on Friday)

    if I sign them,

    I can sign them in my maiden name as I have changed names

    and send them a copy of my marriage cert, decree absolute and birth cert to verify me, do you think this is ok.

  2. Ok just got the letter out from HSBC and it is telling me that the account has been sold on to Capquest. So the SAR goes to them or do I wait for them to be in touch as they haven't yet.

     

    Scratch that yes they have, they wrote out the same day as HSBC did!

    - the thing is, they didnt respond last time,

    well they said they sent my info to a local branch and when i went to collect it, it wasn;t there!

     

     

    I can't pursue this now as it was years ago I was originally going to go after bank charges as when I looked it up i had racked up about 6ks worth!

     

     

    No wonder they didn't respond eh, thing is had health probs and divorce in this time so never got back on top of things,

    1) the defendant entered into a Consumer Credit Act 1974 regulated with JD Williams under account reference XXXXXX (‘the Agreement)

    2) The defendant failed to maintain the required payments and a default notice was served and not complied with

    3) The Agreement was later assigned to the Claimant on 31/03/2014 and notice given to the defendant

    4) Despite repeated requests for payment, the sum of £846.65 remains due and outstanding

    And the Claimant claims

    a) The said sum of £846.65

    b) Interestpursuant to s69 County Courts Act 1984 at the rate of 8% per annum from the date of assignment to the date of issue, accruing at a daily rate of £0.186, but limited to one year, being £67.73

    c) Costs

  5. Hi all,

     

    I have recently been in contact with HSBC (don't bank with them now) about information I requested a long time ago and never received, they came back and just said tough.

     

    I think I have opened a can of worms because since I asked this they have sent me a letter saying that I owe them £4574.

    I was shocked to say the least.

    I had no idea where this had come from.

     

    I have just checked equifax and it states:

    Default : May 2014

    Default / Delinquent balance: £1204

    Current Balance £4574

    They updated this on 17/05/17

     

    Again, I have no idea why this is so high...

    .they have never been in touch with me regarding this, until couple of weeks ago

    and I was just shocked, I read it and filed it as I could not get my head round it.

     

    I have asked them to look into fees I paid for a bank account, I think this has rattled them so they are now chasing me for money.

     

    Any ideas as to what I should do?

    I have this morning received a Claim Form, it is from Lowells.

     

    i am confused,

    I am pretty sure I took this up with Shop Direct at the time and asked for documents etc but to no avail.

     

    This account was defaulted on 29/10/2013 and has been with lowell for a while.

    They have tried to ask me for the money back but I did not respond.

     

    The debt on the letter from solicitors 2 weeks ago states i owed 846.65 but this claim form says 914.38 then fees on top of that bringing it to 1044.38.

     

    My question is,

    do I fight this or do I offer them some payment scheme if they will allow at this point as I have had no communication with them.

     

    Any help would be greatly appreciated.

  7. Sorted the address thanks. all sent off. I double checked what I had put on there as per advice, and am pretty sure it is correct. I am sure they will let us know if there is an error as I presume they will still do their own calculation :)

    the first spreadsheet,

     

    I have gone from the date first premium paid (21/08/2001) and the amount of that upto and including final payment (21/07/2011) ?

     

    I don't want to get this wrong as by the looks of it, they are owed quite a bit!

    ALso, just another question,

    he also got a personal loan and instead of a monthly premium,

    his insurance was added to the loan total..

    .including charge for credit for taking the insurance!

     

    I presume as also missold, that this can be claimed back?

     

    He was charged Insurance of 829.83 and then charged 142.53 for the privilege!

    and this was all added to the loan,

    so a £5k loan turned into a £6831.36 loan

    - of which only 859 was actually the interested on the 5k,

     

    hope I have made sense!

     

    So in effect he was charge more in insurance than he was in charges for the loan itself.
