  1. I thought I had finally got to a point with MBNA where real negotiation could begin (More fool me) but they insist they can take it no further without me disclosing my income and outgoings.

    Of course, I am suspicious but has anyone done this and its been of benefit to them?

     

    Personally I think its them trying to gather 'ammunition' but would welcome adive from those who have been in the same position.

  2. Thanks Meebroke- To be honest I don't really care about my credit record just the fact that they have failed to fulfill their legal obligations.

    So you think them asking for a token payment to delay the default is simply them stalling me or perhaps trying to get me to admit the alleged debt stands?

     

    If so is that tactic not borderline blackmail?

    Going to send another account in dispute letter but in the meantime MBNA have sent a letter saying "According to our research you are a home owner and we may enorce a charging order etc...."- is this their usual tactic?

     

    I have stated to them that I need to see the original agreement but have been met with answers like "There are 8000 of these requests at the moment so there is a backlog"

     

    Sorry, but if a multi-national bank can't source 8000 documents then questions need to be raised about their ability to operate correctly and within the law.

  4. Hi folks

     

    Went down the CCA route ( see http://www.consumeractiongroup.co.uk/forum/mbna/181685-fireyjack-mbna-fight-begins.html ) - nothing delivered in time so put the account into dispute. As you can imagine MBNA did not acknowledge this and continued to add interest and demand monthly payments.

    Anyway, unfortunately an 'account manager' got hold of me and started to put the onus on me- saying they need a statement of my outgoings etc and trying to sidestep the issue of MBNA needing to get their house in order.

     

    Could anyone advise as to if they are allowed to add interest on credit that has been withdrawn and what my next step should be as in my opinion they are simply trying to welch on refunding my charges, fees and interest in the hope that they can wear me down.

  5. Well, the Optima letter has now turned up. Should I CCA them?

     

    Also got a reply to my telephone harrassment letter- you probably all will guess that they are saying they are acting reasonably.

     

    Had a number of anonymous texts "Please call one of your banks".....misleading to say the least.

     

    Starting to wonder where to go with this one.

  6. Got a statement yesterday (Despite my line of credit being supposedly removed 3 weeks ago) that showed them still adding interest and fees.

     

    Still getting the one call a day- one to my bosses direct line the other day (I rang Aegis to make a payment from it 7/8 months ago)- they assumed he was me and started trying to get a payment. Surely that breaches all Data Protection rulings?

  7. Had some crackers since I sent the harassment letter.

    Only about one call a day but they must be getting desperate.

     

    "You might be aware of a court case on BBC- well that went in our favour"

    "We don't need to go through security to talk to you"

    "We don't need your credit agreement to pursue the debt"

    "We are a phone only bank, we don't do writing"

     

    Keep it up MBNA (No doubt someone is reading this from Chester)- you're giving us all more ammo than we could ever dream of!

  8. Well, they couldn't resolve my complaint by the date they said so have said it will take another month.

    Had a young chap from them on the phone last week:

    "What I need to make you aware of is that the case that was on BBC the other week went in the favour of the bank"....

     

    Me: "Did I tell you I was recording this call"

     

    MBNA: Click..........

  9. Had a couple of 'voice texts' left on the answerphone- is this their way of getting round the harassment letter I sent them.

    Anyway, still no CCA but a letter informing me they are withdrawing my line of credit and reporting the arrears to the credit reference agencies.

    This is despite the account being in default.

    Oh, and a letter came last week from 'Gail Powell' last week informing me that I should have a reply to my 'complaint' by 19th October.

     

    Can anyone advise on what the next step should be?

     

    I have a friend who is a tabloid journo and I'm seriously considering him doing a piece on MBNA with my case as an example as we've discussed it before and with the current low opinion of banks would be lets say 'somewhat topical'.

  10. All quiet on the (north) western front.

    No phone calls, no letters (apart from one saying a payment of £11 was due) and still no CCA.

     

    I have found what could be an ace up my sleeve- While sorting some paperwork the other night I found the statements for a Virgin/MBNA card that is now closed and I payed PPI on for at least two years.

    As its a closed account I'll be pursuing that right away.

  11. No we have no union here.

    The pay freeze was across the board (apparently) and as stated earlier we haven't even been told (directly) that our April pay rise was not going to happen.

    The people given these clandestine pay rises have been given them to stop them leaving. Us being the IT department see everything and its quite insulting to find out that it could just be our department that is being left out.

  12. The only letter I have had was to say that all the Alliance & Leicester branding was to be dropped and all future correspondence would reflect this.

     

    Could this be an organisation wanting to distance themselves from such sharks/shamsters???

  13. Well, the recorded post was something altogether nicer- a cheque of reclaimed PPI from another institution.

     

    But, had a call last night from MBNA offering "Good news" (their words) which was that they had teamed up with some company that could give me a loan to consolidate all my debts.

     

    Is it legal to offer such credit to someone already in problem debt?

     

    Its certainly not moral but thats never bothered MBNA before.

  14. ...and best of luck, I've been waiting for 5 months for mine and still nothing. Not even an agknowledgement of any of my letters (all sent vis Special).

     

    Has the telephone/letter harrassment continued during this period?

     

    Got a cracking picture of calls to my mobile- 8 calls in 10 minutes!! Think I'll bank that one.
