  1. HEALTH WARNING

     

    Welcome are back to their old tricks again.

     

    Received two letters from Ashford, Middx branch asking me to call them.

     

    I have an agreement with their Customer Complaints Dept that all dealings must be in writing. They also have agreed in writing that their branchs must never call me. I changed my number as a precaution anyway.

     

    But feeling mischievous, I called them (witholding my new number, of course) to tell them the second letter was a load of tosh as I do not have a new Secured Loan with them. I also asid that the account number referred to in this letter relates to an old unsecured loan.

     

    They said this second letter was a mistake so they are still a bunch of pathetic amateurs and make up the rules up as they go along. It was just a trick to get me to call, of course. This letter threatened that unless I provide them with correct Direct Debit details, the mandate will fail and I will incur changes of £12 and up to £40 from my Bank.

     

    I cancelled my Direct Debit months ago and pay the monthly reduced instalment into their account by transfer from my account.

     

    Anyway this saleswoman said while you are on " Our company has changed the rules and require a monthly "Statement of Income & Outgoings" and 3 months Bank Statements ". Also you must come into the branch and discuss your account.

     

    So I politely said " I do not come into your branch as has been agreed with your HO ".

     

    She then said, " You will soon have interest and other charges added to your account " to which I said " I have a letter stating that these are all frozen."

     

    So once again these idiots who work for this awful company have not a clue what has been agreed in writing in the past.

     

    I then called the National Debtline and they said " All you need to say is that your financial position is the same as previously advised 3 months ago and will advise them if and when it changes".

     

    Also Welcome Finance cannot demand Bank Statements, only a court can.

     

    So another complaint letter will be on it's way to Nottingham.

     

    Oh yes, I said to this woman at the branch that if you change the rules then you have to advise your customers in writing and not subject them to high pressure sales techniques.

     

    So Guy and Girls, Welcome Finance remain the shower that they have alway been.

     

    I don't have these problems with my other Creditors because they work by the rules and guidelines.

     

    Welcome are pathetic aren't they?

    New graphics ....:)

     

    This morning I had a letter from my local branch from a person called Txx Exxx asking me to contact them.

     

    I already have a letter from their Complaints Dept agreeing that the branch cannot contact me by phone.

     

    I have changed my phone number anyway.

     

    So they must have been trying to call my old number so broke their Head Office instruction.

     

    So I called them and witheld my new number naturally.

     

    A man eventually answered and I asked for the woman Txx and he said that nobody of that name works here but is at another branch.

     

    Probably another Welcome lie.

     

    Anyway I said that my local branch is not allowed to call me and referred to the HO letter that confirmed this and he eventually found it.

     

    Then he said where is your three monthly Income & Expenditure form.

     

    I said that I sent it via Recorded Delivery in June and he said we don't have it.

     

    He then started to become very arrogant and said you owe us money to which I said " I am now going to call HO and complain once again.

     

    I then put the phone down.

     

    Tried to get through to their Complaints Dept but was put in a queue and gave up after 12 minutes ....:-x

     

    I then called the Post Ofiice and it was never signed for and must have been lost in the post.

     

    They also said that if it had been delivered and nobody was there to sign for the letter, then there would have been a report logged to this effect.

     

    So not only are my personal details lost somewhere but I have to send this information to them once again.

     

    This time I will send them via Courier who has to get a signature.

     

    Anything to do with this company just makes me mad.

     

    I loathe them with a passion.

    PS. Which reminds me, I had better check with the Post Office that they have received my SAR.

    to now read ( as it's more specific ):

    Do you mean I should also add another paragraph saying: :?:

     

    Copy of the Underwriting Sheet relating to the Insurance Policy relating to my loan agreement ( Account no: XXXXXXX )

     

    Oh yes, should I sign the SAR using my usual signature or just print my name in capitals.

     

    Gotta get this right as I am sure you will all appreciate.

    quite honstly i wouldn't trust them as far as i could kick them

     

    i've read several threads where once the SAR has returned, customers have found additional agreements were done by welcome when they 'asked for lower payments' etc etc.

     

    put your known numbers in AND include a line about and any other agreements under my name etc.

    also make SURE you include any old addresses that you might have lived at in your time with them.

    I require all information on details of all insurance products supplied by Welcome Financial Services. This is to include the statement of means, statement of price, details of all insurance premium tax paid, and underwriting sheets.

     

    If you are unable to supply this data because there has been no such manual intervention, then please be so kind as to confirm this in your response.

     

    I enclose the statutory maximum fee of £10. You have 40 days in which to comply. Furthermore, if I discover that you have levied disproportionate penalties or charges which are invalid under the Unfair Terms in Consumer Contracts Regulations against me, then I shall be reclaiming them together with any interest charges which you have levied on them.

    Just an update.

     

    My phone number has been changed and I am still ex-directory.

     

    So no more harassment calls....:D

     

    Just received a FINAL NOTICE BEFORE ACTION letter from Rockwell regarding my time expired debt ....:x

     

    The usual crap in it saying a Judgement Order may be obtained and if this remains unsatisfied, enforcement of your debt may be sought by one or more of the following.

     

    1)WARRANT OF EXECUTION BY BALIFFS AGAINST THE GOODS YOU OWN

     

    2)ATTACHMENT OF EARNINGS ORDER

     

    3)CHARGING ORDER ON ANY PROPERTY YOU MAY OWN

     

    It really is high time that legislation was brought in to outlaw these slimeball firms who use methods that a back street loan shark uses.

     

    Personally I think that Banks etc should not be allowed to sell on debts to 3rd Parties.

     

    They took the risk lending the money and they should alone take the risk of the debt going bad.

     

    This country in many ways still has bad laws regarding financial matters.

    PPS. Oh yes in the letter there was the usual threat of payment by the end of July to prevent legal action otherwise they will take immediate action against me.

     

     

     

     

    Time for a rant, I feel, bit off topic but I am sure you will understand.

     

    Over the last two week's I have received letters from Allied International Credit(UK)Ltd and Rockwell Debt Collection Agency relating to debts that are "Time Expired".

     

    Of course, I ignore them (and in the past they go away and give up ) but then I get a phone call from Rockwell and put the phone down once they told me who they were.

     

    I have now instructed my Phone Company to change my number.

     

    It's time that Government legislated against these parasitic companies from contacting people after the debt is no longer valid.

     

    The type of individuals who run and work for these firms should get proper jobs and not harrass individuals who have hit hard times.

     

    So Debt Collection Agencies are at the top of my list of most hated organisations and people.

    A debt would become expired after 6 years under the Limitation Act 1980.

     

    The Limitations Act 1980 outlines the time limit within which a creditor can chase a debtor for outstanding debts. The Limitations Act 1980 only applies when no contact has been made between the creditor and debtor within the given time limit and only applies to residents of England and Wales.

     

    Creditors are given a fixed period of time to chase their debtors, which is outlined in the Limitations Act 1980. The time scale mainly depends on the type of debt and can be extended at the courts discretion. The time limit begins when you last admitted owing the money or made a payment.

     

    Should the creditor fail to maintain contact with the debtor, for a period of 6 years or more, it is possible to claim that the outstanding debt is "Statute Barred" under the conditions of the Limitations Act 1980

    So ask Rockwell for a copy of the original contract when you took out your loan or credit card.

    Even better, start an unenforceable credit agreement application enquiry. It costs nothing to do this and you are protected by the consumer credit laws.

  11. Going back to the virtual doubling of their Compensation Offer - WHY SAY I ??????

     

    They have to be worried and hiding something surely !!!!!

     

    I was always very polite in my recent calls but was very firm and businesslike.

     

    They said on Monday that if I am not happy with all their letters and this most recent one, then I should complain to their Customer Complaints Department.

     

    But these last 3 letters are headed Customer Complaints Department anyway !!!!

     

    So in effect, I would be complaining about their own department but I suppose they would say " But it's a department within a department ".

     

    Duh !!!!!!!!!!!!!!!! :confused:

     

    Hence I feel the need of an expert financial lawyer now to save me getting the runaround by Welcome Finance and any other financial investigation body that might take months getting around to my case.

     

    Perhaps I should get the lawyer to apply for the SAR's on my behalf as it would look more official.

     

    I am sure Andie 303 and Postggj will also be interested when they see this matter .....;)

    My financial position is such that I can apply for Legal Aid and see an expert solicitor regarding this matter, so should I forget the FOS and go straight to the lawyer?

  13. Hi everyone,

     

    I am somewhat flabbergasted as I received the third letter from Welcome Finance this morning enclosing (1) Explanation of Compensation and (2) Customer Acceptance Form.

     

    All of a sudden without explanation their offer has almost doubled including the £100 award and 8%.

     

    At the top of (1) it says " My compensation offer will put you in the financial position that you would have been in, had the PPI policy not been purchased "

     

    It also says " If the original loan is in arrears, we will take this into account whn working out your compensation. This means that I will use some or all of the PPI compensation now being offered to bring the account up-to-date."

     

    Then they list various amounts relating to the Original Loan ( which is closed ) and the Renegotiated Loan which, of course, is still open.

     

    There is an amount of PPI Rewritten from the previous loan (£) under the present (open) loan.

     

    So as I see it, they have effectively admitted adding an amount of PPI that was mis-sold with the original (closed) loan.

     

    So this makes the current loan void if there has been a secret commission paid when the original loan was taken out?

     

    No wonder they have almost doubled the compensation and trying to get me to sign that I accept it.

     

    No way am I going to do that until the FOS have seen all the letters and documents that WF have sent me together with the SAR documents that I am requesting.

     

    These being:

     

    (1) Copies of the two Loan Agreements

    (2) Copy of the Underwriting Sheet relating to the 1st Loan Agreement

    (3) Copies of all Statements for both Loans

    (4) Copies of all phone calllink3.gif notes

     

     

    These people have not changed one bit, have they ....:-x

    Oh yes I forgot to mention.

     

    In their second letter to me detailing the compensation amount etc, they enclosed a fresh Loan Agreement ( and Direct Debit mandate ) for me to sign which with the compensation deducted from my arrears, would have meant a marginally lower monthly repayment.

     

    When I spoke to them last Friday, I said " No way am I signing a new agreement with an amount you know I cannot afford as we already have an existing deal with me paying a far lower amount each month."

     

    Yesterday they accepted this and I am awaiting another letter confirming all this.

     

    WF have not really changed as they also enclosed another document titled " Customer Settlement Form " for me to sign agreeing their Compensation Offer.

     

    I am not signing anything at this stage until the FOS have seen all their letters and other docs that I am sending.

    you only need to send 'an' SAR, it covers all their history on YOU in whatever form.

    all you do to NAIL them down to supplying EXACTLY what you want.

    is to do as you are doing

    SPECIFICALLY mention those docs you are most interested in.
