Broken Arrow a Mackenzie friend is a term used in CRIMINAL cases, where a person (not being authorised to have right of audience such as solicitor) can sit with a defendant and assist them by handing them documents, look up legal books, suggest questions to ask witnesses (written notes) etc. They cannot address the court.
I,ve been a Mckenzie friend on 3 occasions, all in civil procedures and on 2 occasions I have been allowed right of audience, the term derives from a divorce hearing in the 70,s between McKenzie and McKenzie.

Although you,re not entitled to speak on their behalf, you can ask for" rights of audience", the Judge will probably decline, but the last time I did it, I was allowed, I ended up speaking more than the defendant, but as a minimum you can take notes, pass notes etc.

Yes you can attend the hearing as a Mckenzie friend, I will be doing this with my daughter who also has a claim against her from UKPC/DCB Legal.

Oh I am still here! Just keeping a low profile. HFO and their demise are still on my radar
Hello CD, Hello DB, happy Christmas to both of you xx

I got my CCJ and CO set aside, but that that about 2 years after the original CCJ.
Mine was set aside on the grounds that HFO Services obtained the CCJ, yet they had no legal standing in the matter and that HFO Capital should have made the claim.
You need to look at the original claim form and check the claimant and check it matches what they stated in the POC.

Turnbull has now given up on consumer credit litigation http://www.turnbullrutherford.com

Claim was 2009 and no I do not have the claim form, is there a way of getting a copy?
Your local court will have a copy

HFO services on behalf of MBNA.
Did not defend as I was "green" to their ways back then, big mistake.
How long ago was this?
Do you still have the claim form?

I got the letter yesterday. They seem to be shifting their assets to Ireland and, looking at the information in the footer, there seems to be a Maltese connection there as well. No doubt the completely legal tax arrangements managed through a Maltese holding company will be where the bulk of the money ends up. As a group they are quite adept at squirreling away money in one tax haven or another, so HMRC will probably want to have a look at this as well, I expect.
I only hope the FCA will be brief in their deliberations.
The Maltese based company is Concillian.

Thanks will do, I too have received "the letter" today from HFO Capital requesting all correspondence and enquiries to them from now on.
Capital are based in Ireland, Services used to do all the collections, they're based in UK, probably trying to collect as much as they can out of the UK as possible.

Can you give a little background on the original creditor, which HFO claimed Services or Capital and did you defend the claim.

The FCA have picked up the baton from the OFT and they will do a good job.

I've alerted as many people as possible, apologies for those I've missed, but I've no PM facility, could everyone who has had dealings with HFO/ Roxburghe please contact the OFT with their dealings with this rabble, can't believe they're appealing with the way they've carried on over the years.
-
All 3 of the group companies are appealing, so keep up the complaints.
-
Interesting development, is there a specific contact at the OFT?
-
Roxburghe recently had their licence revoked, they are appealing this, you should complain to the OFT, I'm sure they would be very interested with your issue.

As highlighted in the recent press release from the OFT http://www.oft.gov.uk/news-and-updates/press/2014/08-14 is this referring to the same 'Turnbull' as in the solicitors Turnbull Rutherford?
If so, should they be currently chasing any debt?
Yes it is the the same people and they can continue to trade as they're appealing the licence refusal.
-
Ok well I can't pm ya but he's more than interested in any details you have.
If you can PM me, or at least try, CAG have stopped me from sending PM,s, don't know if I can receive them, cheers.
