  1. OK thanks - I guess I will have to wait and see. My case is for a total of about £2800 so I am worried that will defend as it is a larger amount.

  3. I just got this off MCOL:

     

    You are unable to take any further action online on this claim.

     

    The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly.

     

    Does that def mean they want to take it further or could it be their defence say's we will pay in full??? Worried now!! No money in account yet!!

    How much was you claim for? - hope you dont mind me asking!! What time did they credit the first amount yesterday?

  5. I emailed someone else at Eversheds and they say defence was entered yesterday so I hope I will get the money within the next few days! I guess it is possible they are going to defend for real athough I hope not!

  6. Great stuff!! I am in the same position as you were yesterday - I emailed and they say they have entered a defence. Hopefully, they will pay up my claim today as they did for you.

  7. If I get sent an allocation questionnaire what will come with it? Will it just be the form I have to send back or will I be required to include other items.

     

    I have read about Allocation questionnaires in the FAQ section but I was not clear on this.

  8. Would it be a good idea to enter a judgment by default?? I know this can cause delays if they try to get it lifted but I don’t see how they could - as they acknowledged they obviously can't claim to have missed any letters??

  9. My final day today - they have until midnight to put in their defence!!

     

    I sent an email to the solicitor at Eversheds and guess what?? SHE IS ON HOLIDAY UNTIL MONDAY!!!

     

    Will they have put someone else on my case - should I not know who that is??!!

     

    Wanting to get this sorted today as off on holiday tomorrow - can some answer me some questions about the AQ???

     

    Do I need to add a cover letter?? The form will be simple to fill in but will there be any other work required with it?

  10. If their defence says paid in full would MCOL online tell you? Maybe they are going to pay in full but the site just automatically transfers any cases that have been defended even when the defence is "we are going to pay in full"???

     

    Thanks for the email details - I will find the one I have when I get home and will email tonight just to see if they have done it yet.

  11. What they charged you was not a fee but a penalty charge, because you broke the terms and conditions. This point seems to be important because if they can prove it was a "fee" (i.e. a charge for a service) then it is harder to claim back (i think!).

     

    If it was actually a penalty charge (which it was) then these are unlawful at such a high level and so can be claimed back much more easily.

     

    I think we are in the bizzare position of having to prove we have broken their T&Cs!!

     

    Someone please correct me if I am wrong.

  12. Nationwide have until tomorrow to file a defense. What do I do if they don't - also if I do nothing what do the courts do??

    The problem is I am on holiday Thursday in Canada until 18th June so not really good timing!! My son is at home and will open all my mail for me and let me know if there is any relating to this case. I will also have internet access everyday if I need to go onto MCOL – will that say when a defense has been added?

    Should I ask for a judgment by default – as they acknowledged I guess they can’t claim they were not aware of the case?

    Any advise would be very welcome!!!

    I think it would be a good idea for us all to have access to the terms and conditions for Nationwide accounts (Flex in my case) for the past 6 years.

     

    I don't suppose anyone would know how to get hold of these?
