  1. Hi thanks again for taking time out of your sunday to reply I have sent and email to Drysdenfairfax to request an extension to my claim. I think the only grounds i have for defence is the claiment of proof, The orginal agreement was taken out in 1997/98 and it has been bounced around since 2006 with the last payment through CCCS in 2011. I will let you know if I hear from them, I will wait til wednesday and then call many thanks again

  2. Theyve already admitted it is unenforceable so dont pay them a single penny. They are playing the morality trick on you. Basically " We know we cant make you legally pay for this, so we're going to try and guilt trip you into it". Pity oft guidance says otherwise. Should they continue harassing, get the harassment letters off. basically theyre ****ed off you called their bluff and know they have never been able to legally collect, but they still want free money off you.

  3. You are coverd under the Equality Act and have protected characteristics due to your cancer treatment, even if in remission. Your employer will be on dodgy ground due to the staff head count in not being able to offer you a temporary role withing the business until your knee is fixed. They will have to show justification for your dismissal under capability grounds if you are currently at no cost to the business. Your cancer treatment should be discounted as an absence as you are protected, although they can record but not use against you. What is your total absence during the last 12 months as a direct result as to your knee complaint

  4. Yep sorry wrong thread. I had a the same problem once where I didn't give them an option in accepting a token payment. I paid it, they didn't send it back thus it was accepted. This was done via a bank account payment so it couldn't be rejected. Maybe I was lucky. I'm not sure where each party stands if you make a payment to them and they don't return the payment , because I'm sure it wouldn't look good in court if they returned what you'd paid.
