On the 31st January 2008 when HFO Ireland claim to have taken assignment they had no Consumer Creedit Licence to either carry out debt collection, purchase debts, or to act as a creditor, which is what they in fact became by taking assignment. There are different categories of licence and HFO had none of them - nor can they rely on their agents licence - (see Hicks V Walker & Frank Reynolds). In that case both the agent and the unlicensed trader were imprisoned. And the argument about having a licence a few weeks later is also nonsense as confirmed by the OFT - if they "traded" - i.e. purchased assignments - one minute before t1 point
