I cant say this strongly enough.......dont accept any agreement as valid until you have had a second or third opinion. scan them and put a link here photobucket is best I have three credit card agreements and not one is enforceable I have had a loan wiped off for the same reason and I'm challenging two other loans the first thing is "Dont Panic" get all the agreements and get them checked properly...dont make your own mind up unless you know the cca1974 inside out. hope you get out of this mess my best wishes Dave

  3. Credit Allergy - these storecards are being pushed where ever we shop - and yes the 29% interest seems to be the going rates etc.. The best we can do is try to educate our own youngsters with what we know and try encourage our youngsters away from such deals. I was shopping with my youngest son in Debenhams recently and the checkout girl offered him 10% discount on his shopping if he took a storecard out there and then - fortunately my son was on the ball and declined the offer telling the lady "yes you'll discount this purchase by 10% - but the card company want 29% off me when they bill me in the New Year - so I would be paying 19% ab

  5. Hi R B 1968, As far as I know, your questions 1-4 are correct. I`m presently getting chewed from Lloyds TSB regarding a Credit Card. They defaulted around 2 months ago and I stopped payments, but like I said, the morons are still at it, still applying charges and interest. I have changed accounts and Banks, so they can`t help themselves. I`m also being chewed from a 2nd CDA regarding an Argos Card. Again, the morons haven`t shown up with a CCA, so they are passing the account around amongst themselves. Probably to see if they can work out who has the brain cell. I`m not sure how the Default thing goes I`m affraid. But if t

  7. In that case your daughter should expect to be paid as usual, unless told otherwise in advance. I imagine it was pretty hectic at the salon due to Xmas and as she said she didn't need the money till the new year - perhaps you should give the benefit of the doubt until tomorrow.

  8. If you take my advice, you'll forget the word 'bankruptcy' exists. As for reassurance, take it from one who knows after 30 odd years in business and a few life skills packed in to back it up (No, old folks were not born at 40! We've done all you younger ones have done and worse!) Don't think 'credit' or 'debt' think 'education about money' and always make sure you try and live within your means. Buy nothing unless you can afford it and if you do suffer loss of job, illness or other things experienced by thousands on the forum which change your circumstances, think about how you can raise money to pay off what you owe, not 'how can I get it w

  11. I think most people would have done the same as you B&E. Still, as you say the ball remains in your court as you still owe them money:p. I loved your post about the illegible judge's handwriting - I suspect our local court staff have a similar problem as we have just received an order in response to our AQ saying that 'the claimant must provide to the claimant ... a copy of the agreement etc etc'

Hope you are getting along well with your battle and looks like you will have to go all the way to the courts with this one, UNLESS they give in at the last minute. I am totally amazed that the Judge at Blackpool CC has'nt helped you out nire regarding the hardship case, maybe he is waiting for the hearing so that he can set an example to the banks that despite the test case they should still be honouring certain cases like your own and prevent the matter being dragged through the system. Case number xxxxx Hardship situation I refer to all previous correspondence and my attempts to convey to you that as a hardship case my situation , under the terms of the waiver agreement, my claim should be considered outside the court system. I have no wish to take this matter to court but as you have ignored all my efforts to resolve this matter before January 8th - you have left me with no choice.   15. Hi ABG, sorry to hear you have flu, hope you get rid of it soon. I have had my hearing changed to 28th Jan so was able to go off and enjoy my hols. If you want some company for your hearing, just ask I will be more than happy to come along and give you some moral support.:grin::grin:
