  2. Can I ask why? If she has recieved a reply that would surely cancel the 14 day deadline? If the letter is the prelim letter from the site I believe it states something along the lines of As they have responded unsatisfatorily I would have thought she is right to proceed to the next stage, LBA. Would be interested in your views on this. For OP Ashley_Wirral If you are looking for a local buddy I am in the Wirral area and am a stage ahead having sent my LBA 7 days ago. They have 7 days left, and Im not giving them extra time for bank holidays as they added a charge to my acount on a bank holiday.

  3. Hi and welcome to the forums. It seems from your questions that you have not yet read through the Frequently Asked Questions (FAQs) which is an absolute must. Spend a day or two going through those, as well as the "Case Guidance Notes" etc. You will find them invaluable, and you need to do this in order to grasp the implications of the task that lies ahead of you...... Once you have done this, if you still have any unanswered questions, then post them here and they will be resolved in no time.... Many people here could easily answer those questions, but it really is vital to do some of the groundwork yourself. On the plus

  4. Costs such as paper etc are not worth claiming. What I do is a nominal claim of £100 for general damages and £50-£100 for 'out of pocket' expenses. You can claim for travel to and from a hear, either submit your fare ticket or if by car submit a claim for x miles as x rate - I think its still 30p per mile. If you tray and break down stationary costs etc you give the otherside a chance to demand receipt etc. Better just to assess what out of pocket expenses you have had, round it up 'a bit' and add it on.

  5. Well, the bank won the battle but we wone the war! In essence, I had a client who issued against a bank for charges of £1458, with a total claim of £1683 The bank offered the repay £1458 which we accpted with a proviso that the action would be discontinued once we had received a cheque. The bank didn't send any money or put in a defence so we went to judgment and obtained this in default. The bank then sent payment and requested that we agree by consent to allow the judgment to be set aside - we refused. So today there was an appeal the set aside. What the judge found was that although the judgment was obtained correctly,

  6. In response to the original points I would like to add my twopenneth worth. Firstly it has been ruled in one case that there is no obligation on anyone to check their bank statements. Now this is a little bit difficult to justify I know but all the same, the law is the law. Secondly, I have tried calling my bank. Most of the time I get spoken to like I am a child when I say the charges are unfair. It usually makes me very angry to be treated like that and when I get angry it ain't pretty. So I very rarely call. I like letters. No-one can say you said this or you said that. It can be looked back at just to check that we all know

  7. over xmas i deposited a cheque to cover my dd's , i was told it would take 3 days to clear.this would have been enough to clear and pay my dd's...but it took 4 days to clear and on the 4th day most of my dd's came out in 1 day due to the holiday..NW bounced the lot... and charged me £270 for the service..i then got charged another £20 for going above my od,and £9 interest on my od.followed by unpaid fees from at least 2 of the credit companys not paid totalling £350...from 1 days activity...now when i requested help from nw headoffice .they said our hands are tied unless your branch will verify your "STORY" that they told you 3 days to clear
